Side note: my 4yo’s middle name is Bea 🥰 I wanted it to be her first, but I’m proud she shares a name with your child Anyway, THIS is what unschooling done right leads to. Thank you, Bea, for sharing your insight This country is so cruel. The housing crisis has directly impacted the rise in the unhoused population. But we also have a worker crisis bc companies don’t want to pay workers a livable wage so we need more labor. Best way to get more labor is prison labor so let’s criminalize something that is a CREATED problem. I truly hate it here

Well done, Bea! One of the holdups for our small county in Kentucky providing funds for more shelters and more affordable housing is that people have freedom of movement. Unhoused people hear of shelters or housing assistance and are drawn in from other areas not providing that support. So any county or city is almost immediately overwhelmed with Unhoused people seeking help. I've seen this happen when a new shelter opens. Then municipalities who wanted to help their citizens wind up with populations of people that have to be helped, and the welfare and employment levels actually decline. The politicians and councils are blamed for making their County more attractive to "the wrong sort of people" and the wealthy people flee the area. So the tax base declines. One possible solution to this is either statewide or nationwide Universal basic income. Hopefully that will help.

Thank you Bea for the explanation. I live in Spain and it was very informative. Not only on the subject of homelessness (a problem everywhere) and this specific ruling, but on the legislative part. I too work with the unhoused… and the process in LA right now take at least a year to even get close to securing affordable housing!!! This is such a setback to our movement!!!😢

Private jails are paid for with public money, have a work force that has no minimum wage and almost no safety standards, and can sell the products they produce on the open market (or contract to government entities, like providing uniforms). They also sell basic services to the incarcerated and their families at exorbitant prices (think phone calls, mail).

Amazing talk. Thanks for sharing your thoughts and experience on this very sensitive and important issue in our culture. I find it beyond ironic that Clarence Thomas is an originalist when he would absolutely not have been allowed to serve as a Supreme Court Justice in the original interpretation of the Constitution.

Thank you for encouraging your kids to continue fighting for great things. I remember being so passionate when I was 19/20 about many causes, social and environmental, and so many adults would quell my dreams by saying that it's hopeless, nothing will change, etc. It's so great you are encouraging them to be their passionate self because that WILL create change.

Awesome video. I'm only 3/4 through and think Bea is such a lovely and articulate young woman. Where I live in Australia we have homelessness in my little town like I've never seen in 30 yrs living here. What we need is governments here to release more land, reduce red and green tape. A house now cost $47K more just because of green building regulations. The only people that seem to be able to build a house are corporations and pension funds. The idea of owning a home in Australia has dropped by 80%

Very well explained Bea, especially and including the dynamic of "originalism" vs "living Constitution" stances and how those schools of thought have played into these legal cases. That context is important in understanding this and other decisions, especially with the current SCOTUS. I also appreciate that you brought up the legal distinctions "a protective class" brings and precludes into the discussions as well as who has "status". I applaud you for your interest and energy spent on an important topic and intelligently examining the legal aspects of the issue rather than just giving opinions alone. The people who take the time and effort to understand the legal/courts issues are the ones most likely to make a real difference. Be mentally ready for any jerky comments that may come when one puts themself out there as is the way of the internet and know that it is just part of the reality when anyone makes an intelligent effort to change things. It's not hyperbolic to say that efforts/actions like yours are the ones that begin to change the world. Nothing in history would ever have changed if everyone sat at home. You didn't just put out some opinion on Tik-Tok and let that be the end. You have studied, observed and strategically thought about the legal issues in this video. You and those like you are the people who are strategic enough to make actual change happen not just noise. With young people like you I have some hope in times that are often dispiriting. Well done.

Thank you for your time explaining Bea. Homelessness is growing in Canada too. Landlessness is another growing problem. People who have ended up in RVs with no where they can afford to live. Whole families, who are a breakdown away from being homeless. Hand them fines too? Whose going to collect these fines? English style workhouses are next? Sanctioned slavery is where that leads. Have you studied the Magdelene Laundries of Ireland, Bea? (I don't know how worldly American education is, but my Canadian impression is, it not very worldly). Europe has been very good at criminalizing state of being in uncomfortably recent history. I agree, you can't talk about homelessness, without including conversations addressing addiction. To further disenfranchise people is to give them more reasons to not make the effort to become a contributing part of society. I have always thought, the first step to helping anyone, is to help them find a way to belong, to feel like they could belong to a greater whole. Throwing money and clothing at the homeless and /or addicted and sticking them in a bachelor suites to face their demons all alone solves nothing. Yet, I have so often heard people claim that the lack of success of that approach is proof they don't want help. Ugh. Makes the pacifist in me want to hand my other potential a baseball bat

Great well informed and well thought out comments. Here is something else to consider/ponder. Homelessness is often the consequence of a more fundamental urban issue. Urban settings offer benefits (jobs, services, etc.) and that draws people BUT does not increase land (it actually decreases it). This causes the price of housing to go up due to increased demand and decreased supply. On the low end this creates people that want to live in those urban areas but cannot afford the housing but it even causes problems for people with good income and even college degrees. Currently a 1BR apartment in the Portland area costs $1800-$2000 / month - with the recommendation of max 30% of your income going to rent, that means minimum income to live in Portland is $80,000/year ($40/hr). That is crazy!!! The homeless problem is just the symptom of a bigger problem. If we really want to address the issue, we really need to address the bigger problem of urbanization. Maybe the solution is rewarding remote work, I am not sure, but if we can reduce urban population density, I think the homeless issue well get solved as well.

Thank you for the information. This was the first I’ve heard of the ruling and I’m an advocate for freedom of movement in public spaces. I’ve followed the law a bit as we have a prevalent homeless community where I live and it’s something that always draws my attention. I’d be curious to debate a bit but I wouldn’t want to come across the wrong way. I’m grateful for the content thanks again. I hope this can help someone somewhere learn what’s happening and help people grow. ❤

Different bit i think it is similar, amond bundy and his family have been grazing their cattle on public lands for years in violation of the courts and yet 10 yrs on they are still there. How is it that people cant sleep on public lands but they can graze cattle?

Federal lands are managed differently than city lands. Federal lands have had a fourteen day camping limit forever and the agencies don’t have the manpower to enforce the rules so people do end up camping for years with no pushback.

​@@nate4fish​@nate4fish I think his point was they hypocrisy of it in general. He has been knowingly stealing resources off federal land for a decade as he let's his cattle heard graze. That's thousands of head of cattle stealing resources while his neighbors pay to do it right. He has been in that land for 3636 days past his 14. The point I believe was why does he get to use/abuse/exploit public land however and be left alone but not someone trying to just sleep for the night.

I believe this ruling is a first step to the problem of homelessness camps in communities. Yes we need shelters and treatment and long term housing, but we also need safety in our communities. Mostly homeless people just don’t have a tent and sleeping bag and a duffle bag. Often they come with a big mess. Most are mentally ill or addicts. Also the way it has been going it takes an incredible amount of resources to have them on the streets. Police, ambulance, resource officers etc. It’s going to take a long time and a huge shift to come up with solutions to fix the homeless problem. Thank you Bea

That was a great breakdown of the Grant's Pass Case and the Boise case. Thank you Bea! Now I'm curious to see how this ruling will affect the local homeless population in my town.

You also need to talk about if you’re ever relying on a judge’s interpretation of a right/law you’re in a very precarious situation and it can easily change in the future. Oregon wrote a couple laws after Martin v Boise and that is the proper response to court rulings.

I think for me, as someone who was fairly ignorant of how the judicial process works in this regard, Bea has educated me a LOT about how impactful one judge can be based on their worldview and how they choose to interpret the law and implement fines/sentences. It's really shown me how important it is to elect folks who take nominating judicial candidates seriously and how important it is for us to be educated voters - be they elected judges or folks who put judges on the bench

So I volunteer at a community kitchen that feeds a lot of homeless and low income folks. This is such a complex subject and problem and the few places that have actually tacked this somewhat successfully have only been able to do so with a multi-system approach which requires a fair number of people and resources to sustain. Unfortunately, places like Hawaii and California which have the mildest climates also have the highest housing costs to begin with so more homeless, but even more economic obstacles.

Anyways, what I wanted to end with saying that I am so impressed with Bea and happy to see young people that are engaged and articulate and trying to understand and ultimately find solutions to some of these difficult societal issues. Hopefully, the cycle of frustration and then revolution and war does not continue to play out as it has for most of human history and that we are finally able to find solutions that are acceptable for everyone and eventually lift everyone up rather than the usual alternative of inequality in favor of one group.

It should be noted that circuit court rulings affect the entire country but in this case nobody expected for another circuit court to concur with the 9th.
