The plaintiff purchased a car from the defendant. He wants his money because he claims the vehicle broke down the day after he bought it. He’s suing for the deposit he put down. The defendant argues the plaintiff can’t just return the car as he pleases. Plus, it’s not his fault the plaintiff’s mom and girlfriend didn’t like the car. He’s countersuing for the balance on the deposit and loss of business.

The defendant is such a crook! He didn’t even tell him that he added the 18 month warranty. Then plays dumb and flat out lies about the parts being covered. I really wish JM would’ve admonished him more for that stunt. I feel the plaintiff shouldn’t of had to take the car back for the repairs. He’s the poster guy for what a Sleazy Used Cars-man is!!! I’m gonna predict that more issues appear -that aren’t covered by the warranty.

Nothing wrong with a use 22k car it’s the miles that’s the problem… nothing wrong with paying 22k for a year to 3 year old car with low miles.. I paid 20k with 5 year warranty to 80k miles what ever comes 1st on a 2019 car in the year 2022 with only 15k miles

When I was broke I could have easily gotten a car loan, but instead, I took the bus for a year until I could pay for a car in full with straight cash. Being poor isn't a crime, we all struggle, but you should always be smart no matter your financial situation.

Not all of us even live in places with public transportation. I give you another view and picture as you project your situation on others. I think all places should have public transportation but there are urban places that don’t even have public transportation in the US

I'll add yet a different take: it would cost me more to take transit to and from work, and my kids to and from school, than the price a car to drive all of us (including gas, insurance...) So how would I be able to save? Like the last person wrote, ppl have different situations. Your way works for you. Be careful judging others.

I can relate to the plaintiff and having bad credit, you have no choice but to deal with people like the defendant, but we also are responsible for our bad credit so we can't blame anyone else for that and we know what we are getting in to. I am sorry for him. The defendant should stop with his I am a good guy act, you are who you are but without people like him, we could not get approved anywhere else. It's life in America.

You definitely have a "choice" to not deal with people like the defendant - If you are poor and/or have bad credit, then the solution shouldn't be to run to a used car lot and finance an over-priced old car with 100% interest - Save money, build credit, read contracts fully, don't be impulsive and uninformed.

I feel so badly for people whose car breaks down with the paper plate still on it. You see them on the roadside all the time. The bloodsucking crooks who sell these hunks of junk to poor people need charges brought against them.

There are probably a high percentage of those vehicles you see coming from auctions driven by dealers or want to be sellers of these vehicles, they buy them cheap at auctions attempt to get them home where they maybe put a wee bit of work into them and then back up the price ...don't feel to sorry for these guys. I have known many of them.

I had an old car that ran but I didn't know how long it would last. I couldn't sell it in good conscience, so I gave it away. It last less than a year and they sold it to car recycling for scrap.

I don't like shifty sellers, but unless there's fraud (stating ACTUAL facts that are knowingly lied about - "runs great" is an opinion), they haven't broken the law. Buyer beware! Do a test drive, and pay $100 more for a mechanic to check it out because afterward, you're screwed. And people HAVE to know the FULL, FINAL AMOUNT if they're financing. In this case, it doubled the price! If the shifty seller says, "Don't focus on that right now," you need to know even more because he's obviously trying to hide it.

If his credit is bad he may not have ever purchased a vehicle before. It's astounding in 2023 what individuals don't know because they were never guided/instructed. Many college students don't have a clue about American History much less doing every day common transactions. Also, that salesman sold the vehicle through a finance company that charged such a high-interest rate I believe he should've been brought up on usury charges. He knew exactly what he was doing to the buyer. Fortunately, the repairs are covered under the warranty, but you could tell he's going to make the buyer's life hell while he's trying to get that car fixed.

This is kind of messed up. A warranty would pay for a Failed Timing Belt. It sounds like the plaintiff's mechanic saw a worn timing belt and recommended it be changed. A bad alternator would be covered but warranties don't cover things that MIGHT break but only things that DO break. The plaintiff got what he paid for and the judge is 100% right that the defendant isn't a nice guy, he's in it for the money. A truly nice guy would have said, "Why don't you get something a little cheaper?"

@@rodboijones7390 Yes, after they fail, not as part of a maintenance program. And even then parts that have a scheduled replacement often aren't covered as they are considered wear items. Like spark plugs, oil changes, brake pads, even brake rotors aren't covered under a warranty.

@@1967davethewave Once again @1967davethewave is speaking facts. I'd like to see that warranty contract where it says the timing belt is covered. The small print almost certainly limits that coverage to a very specific type of failure and then will most likely limit what is actually covered. As in, if it's an interference engine and that snapped timing belt destroys the entire engine, will the warranty cover replacing the engine or just the timing belt? Also, unless 'chain guide' is describing something else, the only way to know that is to pull the timing cover. That is a handful of hours of labour to remove and reinstall. Highly doubt the plaintiff paid for that since he is calling the loan company to delay payments already.

Decided to check this company for reviews, couple of reviews I found, 1 of which was back in March this year was that the stickered price was $22K, but the real price was $30K+. Does the US allow those sorts of deals.

Yep, having bad credit will cost you dearly for anything that you try to finance. The interest rate was reduced by the defendant, which is absolutely correct. The dealerships that sell cars to people with bad credit are usually "buy here, pay here" businesses which means they are basically the bank and financing the vehicle to you knowing that you are an extremely bad credit risk so they charge you exuberant interest rates. The good thing is that if you buy a car from them, make all your payments on time for at least a year and keep your other debt current, low and in good standing, in a year you would probably be able to get a regular bank loan to refinance it at a significantly lower rate. The only way to get good credit or repair bad credit is to get a loan with a higher rate and keep the payments current. You also need to open an account with the bank that you think you would like to finance it through later so that you have some financial history for them to go by. You don't have to use the same bank but it is definitely easier to get a loan from someone who can look back on your financial history and use it to help determine if you qualify for the loan and often times your interest rate will be lower than iif you use a bank that you have no history with. Creating a financial credit history is extremely important these days, and if you don't have one, you will probably be turned down for almost everything dealing with buying on credit. The way the planttiff was trying to fix his credit was absolutely the worst way. Start out with a secured credit card. It's a credit card that is a real account, and the limit is determined by how much money you can send in to secure the card. You use the card as usual and after a couple of months of using and paying the balance off each month, within a few months the deposit you paid will be credited back to your card making it a normal unsecured credit card. As long as you make the payments on time, you will have a regular credit card that will start being reported to the 3 credit bureaus and as long as you have made your payments and not went over your limit, you will be on your way to a great credit score. For the fastest impact on your score, pay off your balance every month. Whatever you do, DO NOT take out payday or car title loans. The interest on these loans is 300% or more, it's not worth it.

The defendant has a business, he didn't force the dude to buy a car. The plaintiff had horrible credit could not get a car a dealership, he got a car where he could, yes he is paying MORE bc his credit sucks. The plaintiff should have read the paperwork and he knew he had a warranty but he did not want the car bc of the interest rate. That's ALL on the plaintiff, he did not take it to a mechanic before buying, just bc it needs repairs does not make it a "lemon". It's used and AS IS.

ALSO, the next item on the list of things that the mechanic said the car needed was a chain tensioner which doesn’t exist on a car with a timing belt. That would make sense as that Honda Accord likely has a timing chain. Either way, one of those line items is a SCAM.

How is he a nice guy putting a person into a contract that has 100% interest?? That is getting your money and screwing someone over. Not everyone is knowledgeable enough to know what they are doing when purchasing a car.

I just don't understand how there are so many people and so many cases who go and buy a used vehicle and do not test drive it! Even if I was going to buy a brand spanking new vehicle I would 1,000% test drive it! I understand that the payments were extremely high and people think that the defendant is a bad person for that but that's what happens when you have extremely bad credit and you don't pay your bills, the plaintiff was lucky that he was able to get into any vehicle without paying 100% of the cash to get it, the plaintiff is a grown man he knew what he was doing he should have looked at the Blue Book value of the car, the miles and did his research before he took the vehicle! I'm not saying that the defendant is 100% innocent I'm just saying that somebody should do their research and homework before just signing a contract and taking a car off the lot, a used car is as is by default even if the person doesn't verbally tell you or put it in the contract, had the plaintiff test drove the car he would have smelled the smell he talked about and he would have seeing the issues with the car in advance before getting into a bad situation.

The defendant is anything but a nice guy & clearly lacking in integrity & he only did business with the plaintiff to enrich his own pockets. The plaintiff is now in debt for $21.000.00 for a used vehicle that was originally priced at $7,000.00. If that is the type of deal that you can expect from a "nice guy" then I'd rather do business with the local bad guy. As for the plaintiff, it was his own stupidity that put him in this position. I can't imagine any logical individual buying any vehicle without test-driving it & having a certified mechanic look under the hood. I would suggest to the plaintiff to take the vehicle into the shop & have all the mechanical problems, which are clearly covered under warranty, fixed & then try to resell the vehicle. If you're lucky you'll find someone as dense as yourself that will buy it.

This plaintiff should make the dealer a cosigner because the dealer took the loan for him. I would consult with a lawyer to see if i could prove the dealer liable in fraudulent measures.

So the plaintiff comes all the way to court and tried to get out of a contract that he has not even read. The defendants clearly saw the fool in his eyeballs. They knew he had a warranty but since he didn't bring it up they didn't either. He lucky Judge didn't like the shady defendant and helped the plaintiff handle his business. He was just worried about getting his money back after he realized what a dumb move he made but Judge was fair .

Of COURSE you need to know the total cost of the car. And if the seller tells you, "Don't focus on that right now," you need to know it even more!!!!! And I don't believe for a SECOND that the bank knows he loaned him $500 of the down-payment. The defendant is shifty, not nice at all (usually, if a person says how nice they are, they aren't nice at all). He INTENTIONALLY snowed him on the total cost, then claimed there isn't a warranty, and the plaintiff is a fool to allow the former (and not test drive it). 100% financing, and he doesn't even test drive it. ALL second hand purchases are 'AS IS', unless there's a warrant (which there is here). An adult should know better. I would have asked for my court costs because the defendant refused to fix it initially.
