The plaintiff says she rented an apartment from the defendant, but it was a hellhole. She claims every time she flushed the toilet, it came back up through her tub drain and flooded. She’s suing for her security deposit and damages. The defendant blames the plaintiff and claims she ruined the plumbing by flushing baby wipes. He’s countersuing for additional damages.

I have to disagree w/ the judge. I’m not reusing no sewage towels or matts. I’d just have to buy some new ones.

While she did put a point mentioning cloth diapers going into the washing machine, her point directed to the towels was that it was her choice to mop it up with towels, that she then chose to throw out, and that she has no proof of it's value. Personal choice is nobody else's liability. Same as if you took your blanket to smother a buddy's fire, legally, that is damage you assumed, not him.

OR she could have been a responsible adult and moved her and her child to a cleaner and safer place. She CHOSE to stay there, so she has no grounds to sue. She also CHOSE to use her towels to try and clean the place. If the place is bad and unlivable, you move out, not feel entitled and try to sue.

That's kind of ... disgusting, not to mention unsanitary. No sane, intelligent person would even THINK of doing that. Once the towels are covered in crap, no amount of cleaning will get the stains/smell out - best bet is to toss them and buy new towels - don't risk a potential health hazard by re-using them.

The judge actually was showing other suggestions to point out that using the towels were her choice and throwing them out (regardless how logical) was also her choice, and a person's choice assumes the consequences.

I have a toddler and we always have wipes on the back of the toilet and we NEVER flush wipes of any kind down the toilet. The Judge is a mom and totally gets it!

You may but not all women do, many flush them, as my dad is a plumber and can testify to that fact! The judge doesn't get it because she isn't a plumber having to deal with it.

The point was that she chose to stay there and chose to use her own towels. If the place was unlivable, she should have moved out. She can't decide to stay there and then sue over it...

She chose to stay there, whether it was because she wanted to, or like you claim apparently ''had'' to is not the owners problem. People think they have all kinds of rights and entitlement when renting, but they don't. They have basic renters rights and that is it! Just because your life is tough, does not mean you have the right to my property. Not directed at you, but in general. If they don't like the place. LEAVE, no one owes them literally anything.

LMAO Yoooo I was legit thinking the same thing! The plaintiff has the right to get new towels and not reuse or rewash sewage soaked towels. 85 dollars seemed very reasonable, especially since the good bath towels are about 10-25 dollars per towel/mat. This wasn't an unreasonable amount.

'flushable' wipes arent really flushable. none are. they will stay in the system and will come up when the plumber comes with his snake. sooo... pulling those out is proof that those were flushed.

Did Judge Millian really suggest for her to just throw the those filthy towels (that is covered with other peoples feces) in the washing machine? Not only is that a health hazard, but that is absolutely disgusting. The plaintiff should have been awarded the $85 for new towels and a rug, that price is very reasonable for those items.

I do not agree with re-using towels that were soiled with feces, no way. If you washed them 100 times, I would still have anxiety about using them again. Into the trash they would go.

Two points. Number 1 NEVER flush baby wipes down a toilet even if the package says “flushable” most if not all wipes are too strong wet to disintegrate in the pipes and will cause issues down the line. Number 2, the lady should have gotten the money back for her towels. Even if you put them into a boiling pot in hell nobody would want to use them again. That’s other people’s waste and it just gives a very nasty feeling.

You cannot wipe that up w towels if you were to use towels for that , then they are garbage . You cannot then put shit soaked towels in a washing machine , it would completely destroy the machine.

Marilyn I think you made a huge boo boo on this case. If the only thing this poor woman had to clean up some of this mess were her towels you should have at least given her a lousy $50 for them. You can see she used the in some of the pictures. This wasn't just HER sewage, it backed up from the entire building. You messed up big time on this one. That landlord should have been over there trying to do something himself. I would have started plunging the bathtub and/or the toilet, etc...Many things could have been done. You can rent snakes too so the landlord is a total jerk because he didn't try to help. I'd give her $5K just for having to deal with crap everywhere for over a week. It was a total health hazard.

Ok, the judge knows DAAAAAAYUM well, if it was her towels, etc. she would throw them out too. SMH. That mess is a biohazard and does not belong in a washer machine. I also had this exact thing happen to me in my old apartment. Landlord tried the same mess with me and said I was flushing tampons. Me a single guy who lives alone who rarely had people over... I Spoke with the plumber directly and he told me that there were roots and vegetation not tampons in the main exit line... Best believe I withheld the charges from my rent and sent them a copy of the $550 bill. I had statements, pictures, mitigated the damages for both ME and the property by diverting water/sewage away from the original hardwood floors. Told that nasty woman to sue me and she had no reply. You have to know your rights. These landlords will take you for a run and judges (-even Millian) are prone to side with property owners...

Good info. Yes I felt the judge wasn't fair in this one, nobody would want this sewer water damage in their home and have to use/reuse towels. Plaintiff's health is at risk and she should've got more compensation.

True, besides,there was a training potty in the bathrm, so if her child has pooped in the diaper or pull-up,(since the training potty doesn't flush), she'd need wipes for a better clean bc toilet paper can stick to the poop& you have to pull the poopy toiletpaper off that is stuck to their bottom!,&mom wldnt need to use enough wipes to cause that kind of overflow!, And is anyone going to mention the photo of the tub filled to the top with brown water?? (sewage). I've never heard of a tub filling up with "shit water" to the top, from overflowing a toilet with too many wipes, or too much toilet paper, or a flushed toy,etc. 🤷 I work in a preschool, where there's always a poopy surprise, including clogged, &overflowing toilets! I also babysit many different children on the side, that are still in diapers or pullups. Sometimes when ur taking a child's diaper or pullup off in the bathrm before they get into the bath tub, the chld is standing up, so U have to have wipes accessable in bathrm for a mess-free quick clean up.& then its wrapped in the diaper/pullup,&thrown away, duh! But im sure the know-it-all defendant that says he's changed diapers b4, hasn't!!, Is there any reason why anyone would wipe the poop,& put the wipes in toilet&diaper in the bthrm garbage can?🤦 (Just like the judge said.) I would NOT want to see how that guy cleans up a poopy toddler w/no wipes in bthrm!! Washing the child w/a wet cloth works "if" its accessable ontop of toilet tank,& "if" you want to throw that cloth away afterwards!😝 And... While the adult is going to sink or tub to get the cloth wet, A LOT can happen in those seconds with a curious toddler!!!😲 like...smearing poop everywhere!!,& who knows what else! It only takes a second or two for disaster to happen!!🤦 😜

Althought the judge said the baby wipe problem could have come from any of the other tenants, I am surprised she didn't say to the defendant if could have come from the PREVIOUS tenant, as the current lady had only been in the apt one month (because she wanted her first months rent back).

We had sewage come up in our dirt basement onto the plywood floor... I called the Health Dept and they came out with meters to measure any mold. It came back negligible but I hated going down there. We moved out soon after ...

I keep baby wipes in my bathroom and NEVER flush them. They go in the trash. And the majority of parents do the same because it tells you on the wipe package not to flush these type of wipes.

the towels wouldn't go near my washing machine EVER. I've had to wash some pretty gross items in the past but that would make me heave. The woman would wipe her child's bits before putting it into a bath, probably with no poo on and just wee, so that tells you where her mindset is. She looked so damn tired bless her.

Listen. I can relate. We had an apartment like this and the sewage problem was completely disguising! The toilet overflowed and sewage was always backed up in our bath tub. Neighbors all had older kids, so baby wipes weren't the issue. The true problem was from the sewage lines being too small and crossed. A plumber said the owner cut corners to save aka pocket money---- They wanted to build units for cheap. Everyone kept getting sick. Years later--- Now, I know why. Unfortunately, that was all they could afford. Sad. BTW: Why would anyone want to wash towels or rugs off the floor behind sewage juice!? Really??? That's just nasty. REPLACED!

Yep, same here...slum lords make places appear appealing to the eye, yet the most important work is shoddy AF... which leads to BS like this case. It should be illegal to financially rape & deceive people, but as much as the government does it, that’s why everyone else is allowed to, too!!!!!!!!

Once again, Judge Milian demonstrates just how detached she is from “regular” people’s realities. There is NO WAY IN HADES that SHE herself would ever clean up public sewage with a towel, and then simply wash and reuse it, so why would she think it’s appropriate to suggest that this woman do that for her and her child? That the problem was primarily in her apartment and that baby wipes are present in her bathroom can lead to a probable conclusion that the problem may have originated with the plaintiff. Because a REASONABLE person would not flush wipes down the toilet when they have a diaper in hand does not necessarily mean that the plaintiff acted in a reasonable manner. Many people on this show DO NOT act in a reasonable manner., Assuming the plaintiff was not lying (she did seem trustworthy) there is one other probability that the defendant could have proposed. With the 1-year-old in the house there is a probability that the youngster may have been the culprit flushing the wipes (that were easy access) down the toilet. Anyone with young ones can tell you young kids are fascinated with this phenomenon.

"Well why are they in the bathroom?" Does the judge wipe her or her kids' behinds in the living room or the kitchen? Where else does someone reasonably use baby wipes to wipe someone's behind? You use them in the bathroom and throw the wipes in the trash can.

if the main sewer line is clogged, the sewage will back up into the lowest unit. This landlord is to blame.. he should have gotten the roto router co. there ASAP.. not two days later.

When you apply logic to stories someone is telling you, most of the time you will flush out the lie. My wife and I used to do exactly what she stated when changing our 4 kids diapers. Those and all the other wipes went into the trash.

I don't care what anyone says, Judge Milian is incredibly condescending and, at times, rude. I definitely respect a tough judge, but this can be done respectfully (e.g., Judge Lynn Toler). Holding a title doesn't give you the right to be rude. She shows a lot of negligence in some of these cases. It's so disappointing.

I totally agree... I actually don't like Judge Milian. She rolls her eyes at people, she talks down on people and then she has her days when she shows some heart but then those days are far few in between and you cant trust in that moment when she is showing some heart, that she is real because in the next sentence after showing the heart she says or does something condacending.

A lot of landlord's are opportunists. When they see an opportunity to take advantage of a Tennant, they will do just that! Just do the right thing especially when you have a good Tennant that pays on time and doesn't cause problems for other residents or for you as a landlord. I had to deal with a situation where a landlord tried to charge me for things that needed to be repaired before I moved in. They weren't detrimental so no biggie. When the lease was up, he tried to keep my 600 deposit and told me to do what I had to do. I got my lawyer to send him a letter and I had my 600 plus an additional 150 due to a deposit on gas.

I specifically have body towels and floor towels. I get new towels every couple of years and the older set gets shifted to floor status. It sounds like this lady had to use her body towels for the floor. Now she needs new body towels, right? The judge is disgusting to suggest reusing floor towels for your body. I love this judge. I think she is beautiful and classy. Well, she's still beautiful....but pretty ghetto if she's using floor towels on her body! That's seriously low class.

I disagree with the Judge's smart alec remark about plumbers not always having the right equipment. There is limited space on their vehicles for all of the parts needed... not to mention a lot of the jetters and cable machines are VERY EXPENSIVE so they are usually shared amongst several people. Try walking through a plumber supply store sometime!

The companies that produce those flashable wipes ,that aren't flushable at all, should get sued by cities bcz their products are misleading when they are marked as "flushable ". They have caused serious damages to sewers, not only here in the US, but in Europe too. Millions of dollars spent to clean up the sewer system.

Having helped someone clean after such a problem we were told by the plumber you can not use the towels and any clothes touched by the water. They have to get so many new clothes and towels! Thank goodness I had work boots
