The plaintiff says he hauled tons of dirt to the defendant’s property, and now he’s refusing to pay up. He’s suing for what he’s owed. The defendant claims he was given a lower estimate, which he was willing to pay, but says the plaintiff lied. He also says the dirt is septic, so he’s countersuing to have it removed.

That's what I thought. If I believed contaminated soil was right next to my house, about to make my family sick, I would immediately have it tested....especially if I was going to claim it was contaminated in a court case. That guy didn't make any sense to me.

He probably wasn’t concerned about the soil condition until he got a citation from code/planning/environmental, whomever is responsible for issuing permits to ensure any alterations to natural geological features are permitted. Just because you own a piece of property doesn’t mean you can go ham on it however you want: there are long term repercussions to anything that changes the natural geological features, and I’m guessing that “ravine” was a natural runoff for snow/storm runoffs.

There would be no wires in septic refuse, and if it had come from septic, he would have SMELLED it before the first load even hit the ground. Defendant absolutely had that soil tested and it came back fine and he tried to pull a fast one.

there is often a float or sensor that triggers a pump to pump the tank into a leaching field. So yes, there could be wires.

@Beaz_Nutz JJ also reads all the evidence before the case. All judges do. And I like that JJ cuts out all the crap where as other judges let them talk about things that don't matter at all.

I honestly figured $100/hr is quite reasonable. My husband used to haul aggregate products, so that's a decent deal.

she doesn't mean it literally, she is essentially saying that you don't need the contract to be formal, but you need it written down. although a verbal contract is legally binding, you need to prove that verbal contract, having it in writing, regardless of the paper or writing implement, as long as you have the terms and signatures its all there and no one can argue. Like the text messages, where the defendant tried to say it was $80 a truck instead of per hour, the text messages proved otherwise

@Almost Lancelot In addition, @Wanna be Lancelot, Soil testing, or a soil analysis, is usually required for building permits and almost always mandated here in the state of California. During construction, the soil engineer may need to make further soil tests to make sure subsurface soil conditions are compatible with those observed in the initial investigation and modify the design recommendations as necessary. Where I live that dirt would be illegal to reuse without cleaning. Guy down the street got a ticket for putting yard dirt in his trashcan and not in the green trash. We have so many city rules

The plaintiff advertised it as FREE and 'clean' but it certainly was NEITHER. Had the defendant had a toxicology report done, he could have won his money back AND had the fill taken away at the plaintiff's expense. Why didn't the judge just ask to postpone the verdict until the report came in? I think it was very negligent on her part because if the fill is toxic, then the plaintiff is very much in the wrong...

Judge Milian herself says People's Court has been on for almost 30 years now because of people (including business owners) DON'T document ANYTHING. Thank goodness for what is now the tens of thousands of people who don't.

Where I'm from selling this type of service per hour is the first Red Flag! It should be per load and that changes if the truck size changes. A contract is very amendable in that instance. It's not rocket science.

What is with this guy suing? He has NO proof the dirt isn't good? All he did was google what the rules are IF the soil was contamninated. AND he is lying too, the text proves he knew the worker charged per hour.

So, ALWAYS get documentation of where the fill material is coming for as well as proof that the soil was tested and shows it is not contaminated. Look for facilities with certified clean fill material. This will save you a lot of headaches and money. There are so many sites nowadays that have "Historic Fill" material, which is often contaminated with a variety of undesirable compounds. Even if you think it is clean soil, it can still be contaminated. The contractor should have removed the larger rocks and concrete casts, AND had the soil tested... For the defendant, he should have had testing done before court. A simple test for Metals and Semi-volatiles (and biological testing if he was worried about a septic system) would have yielded him valuable information. If it was contaminated, you are looking at many times the amount to remove and dispose of the soil than he paid for it. Hopefully he takes that step going forward because contaminated soil is definitely not something you want to be sitting around for prolonged periods.

THIS is a SIMPLE CASE! The DEFENDANT want to get OVER on the GUY! Plain and SIMPLE! Everytime he drop the price the plantiff agreed, then he continue to low ball him again! He clearly didnt want to pay this guy! He want the soif for FREE, FREEE FREE, and also trucking INCLUDED!
