The plaintiff says the defendant hired him to produce karaoke at his bar, but when he plugged in his equipment, the defendant’s faulty wiring fried it. He’s suing for the cost of the gear. The defendant says he didn’t hire the plaintiff, who’s a subcontractor. He claims the wiring is fine, and he denies any responsibility.

Outside of an electrician inspecting the outlet and wiring at the bar the plaintiff really doesn't have a way to prove his case.

Precisely! A credible expert witness who was able to inspect all involved equipment would be needed. Being a small claims case, it may not be worth the price or hassle buuuut here you'd have to rely on being able to convince the judge that it's more likely than not.

@@CNinjaa Small claims or not it would still be worth it to hire the expert witness IF what they say will be in your favor. Judge would add extra money to the final judgement cost in order to make sure they are reimbursed for the cost of hiring an expert, but I person would only recommend payment when you know 100,000% sure that you are in the right & going to have a good shot of winning the case with the experts help.

@@Ampacityelectric right but it's all about preponderance of the evidence. Either way my point was that short of the defendant admitting fault then there is no chance the plaintiff can win without and expert witness. Perhaps he won't win with one even.

As a professional sound man, let me see if I can clear this up. First, about the only thing a surge protector will help you with is a sudden momentary voltage spike due to a nearby lightning strike or something similar. They protect against nothing else. The less expensive ones are pure snake oil and don’t do much at all. I use a power conditioner that smooths out the roughness and noise in the electrical sine wave. These are much more expensive than your garden variety surge protector and I’ve never seen a DJ with one (not that none of them do.) First make ALL of your connections BEFORE plugging the system into the wall. This will prevent any damage from arcing. I carry a volt/ohm meter to check for out of range voltage and an outlet tester to check for proper wiring to the outlet. I have had excessive voltage blow all of the internal fuses in my amps, but thankfully Radio Shack was around at the time and a few bucks got us up and running. As for the computer, Google and KZfaq can be your friend. I had the same problem occur with my USB ports. Most laptops have internal protection for this. You can search for laptop USB ports not working and find a simple reset procedure that will take about 5 minutes and will require no tools, disassembly, or MONEY!

Judges cannot be expected to be experts in all fields. And people representing themselves, even if they are technically savvy, must understand that they cannot be taken at their word in these matters, because they cannot be unbiased toward themselves. Even if every word he says is true, when dealing in technicalities, he has to have expert testimony from an unbiased source.

That is the purpose of proof and an expert witness... You need to be capable of explaining the facts of your case... That is called burden of proof...

she's bashing the plaintiff for not proving his case. The guy provided no evidence that the defendant was responsible. He didn't have any evidence regarding the bar's electric system; hell, he didn't have any evidence of even what happened with his equipment, specifically. His case boiled down to "something bad happened, it must be his fault."

Surge protectors... Like good ones, that are hundreds of dollars to buy, have insurances on them. You have to register the warranty on the surge protector and if you can prove the protector was faulty, he may be able to make a claim with the surge protector company that makes them. It happens! That usually only applies to actual 8ncoming surges. That doesn't apply to open grounds. This is the venues problem. The venue has an open ground and needs to rewire the circuit. This is incredibly common in the live sound industry. Source: I'm a professional audio manufacturer.

This guy's equipment is also old. Powered mixers haven't been popular for atleast the last 15 years. The market switched to powered speakers and passive mixers a long time ago for this level of production. Not to mention he should be carrying an outlet tester around to every gig to test every outlet he plugs into.

I bet the clubs ground was not grounded. Had three equipment failures in the past that where from bad grounding. That's why I spent $40 on a surge protector with a built in ground loop detector. The guy should of brought in an electrician as a witnesses

Judge has no clue about a ground fault surge protector. I knew soon as i saw the title of this, i was not wanting to watch. Drives me crazy when some has no clue but act like they do and they are being the one that makes the final decision. lol

If you expect every judge to be an expert in every field you're going to have a bad time if you're ever in a court battle. The plaintiff doesn't even know how an outlet is wired, he didn't have a chance of proving or even suggesting what kind of problem it might have had. If he'd at least been able to articulate how something like an open neutral might cause something like this he might have had a chance.

She never said she knew anything. she actually claimed the opposite. She said it was way to technical and needed an expert witness to help. Judges dont know anything which is why expert witnesses are brought in to give their insight. So he didnt lose because she knows it all. He lost because he just came with his mouth and no testimony from someone who actually understands. I hate the judge btw

I think the best thing would have been to get a professional electrical Company to go and look at the buildings electrical outlet to determine if it was their fault or not

Even if she did have a better understanding the plaintiff would still have lost bc he had the burden of proof and he had no way of proving a freak ground surge that only happened to him was the cause of the damage and not his own negligence.

He has to prove it. It could have been his own wiring. He has to prove something happened before in that place. He didn’t get an expert.

While things like the plaintiff explained do happen, there was no way to prove what he was saying was true unless he used a multimeter/voltmeter to test the outlets current the night it happened. There were too many electric-regulating components between the outlet and the USB port to conclude the damage was caused by the outlet.

These court shows actually review statements and documents prior to the case and they do research. Somethings are sensationalized for TV. The litigants agree to abide by the judge’s decision. Even after all reviews are done prior or after, the ultimate decision is the judge’s and it’s based on evidence. You must be able to prove your case. Also Judge Milian has stated that she comes from a family of contractors. So it may be little, but I would think she has some knowledge.

@@JloveLamar no, most small claim cases are not reviewed prior to the case, there just isn’t time. I’m sure they are reviewed by this judge prior to hearing the case only bc it’s national tv and the cases are very limited.

I played lots of bar gigs years ago. Having the stage polarity wrong is common enough that (good) guitar amps have a polarity switch in the back. You should always power up, then touch your guitar strings to the microphone and if you see a spark, flip the polarity. I've been mildly electrocuted more than a few times, but have been working with guys who have really been hit with a jolt. I think a lot of dive bars pay their electrician with free beer.

There's a very simple question to ask here. Does the defendant's distribution board have a residual current detector fitted? If it does then it would trip if there was a current leakage to ground as the plaintiff claims. It only takes a 30 mA leakage to trip an RCD. A picture of the distribution board would demonstrate that. This would also be an easy way to settle the argument if the defendant's distribution board does not have RCD protection. Just fit an RCD and see if it trips under the plaintiff's conditions. Talk of surge protection is irrelevant by the way.

There was probably power in the cord because he hooked up incorrectly. The audio cord between the board and the computer should have been hooked up before the board went "on juice".

While the plaintiff couldn't prove that things happened the way he said they did I believe they did happen that way, and the reason I believe that they did in fact happen that way is because the defendant acted very sketchy when questioned about the TV and the speaker with the other karaoke company, he was very hesitant to answer the questions asked of him, he didn't want to give very much detail, and when asked if he was there or not he had to think about it for a minute, why is that something that you would have to think about? you would remember if you were there or not, I think in his mind he thought if he gave too much details or told the full story in detail it would show some guilt on his side that the bar May in fact have old or faulty wiring, while that's still not sufficient proof he doesn't know that. The judge asked the plaintiff why the other karaoke company paid for the TV and ate the cost of the speaker if it wasn't their fault well that's easy just like the plaintiff said they rely on doing karaoke two nights a week, reputation and word of mouth is everything in the karaoke community and that line of business, they probably didn't want to risk the bar owner bad-mouthing them around town so they probably weighed the pros and cons of just eating the cost of that stuff. That's too much of a coincidence that the speaker went out with the other company, the television, and now this guy's equipment, something's going on with the wiring in that bar but I guess somebody would have to get an expert or an electrician and then the bar owner would have to allow them to come in and inspect and we all know that's not going to happen.

Pretty sure the plaintiff is correct here too. And the judge doesn't understand electricity, that is plain to see. And she isn't required to. Unfortunately the plaintiff had no actual proof to provide.

I had this exact same thing happen. It fried 2 of my sound mixers. The outlet I was plugged into was on a dimmer switch which means the voltage varies. This variance can cause fires and in my case, a shortage that fried my equipment. This guy may have plugged into an outlet that was on a dimmer switch. But it wasn't mentioned

Was likely a regular switch, because switched outlets are common. And could be the owner who whoever had a dimming lamp connected so they swapped it to a dimmer. Not knowing any better.

@Brendan Butler LOW voltage = more amps? You're being ridiculous. Talking absolute crap. It's the other way round. Ohms Law : V = iR. (V = volts; i = amps; R = ohms) Look at the equation. Increase volts = MORE amps. Decrease volts = LESS amps. For a given R. (Understand maths?) Apart from some semiconductor devices and devices controlled by potentiometers the equivalent series resistance of a device can be considered constant. You can't increase current without increasing voltage. You can't even have current without voltage. Current doesn't exist without voltage. You have to increase voltage in order to increase current to the point where it exceeds the capacity of the device to carry it at which point it will overheat and fry. Electronics only get fried when they have too much voltage. Not too little. I hope you don't mess about with electricity at any time. You don't even know the basics.

See that with my thinking. That it would’ve fried everything that was plugged into the mixer not just the computer. In my opinion it should’ve fried the mixer, the computer, speakers, the microphones, or anything else that was plugged into that mixer. But for some reason it only hits, fries, the computer? I don’t think so.

How is he "on notice" when there is no actual proof? No expert or professional testimony that there is an issue with the club's wiring. Just the plaintiff, sans evidence, saying "they did it".

I have lost 2 TVs due to electrical surges WITH a surge protector. It only helps against mild surges. And if there is live electricity going thru the ground the surge protector would do nothing to protect against that.

"Equipment varies." The plaintiff summer it up himself. The only other incident was with equipment someone else hooked up wrong. I'm not a DJ, but I was always told all secondary connections should be made BEFORE the plug into the outlet.

Cheap surge protectors you buy off the shelf are garbage. If you're a professional and rely on your equipment to make money, you invest in a real power manager. If he found a spark in a audio cable then current was getting past his "surge protector" and his power mixer.

Not all surge protectors protect against power issues. We had a master power unit for our development had a power surge and it forced more current to go through the system before it shut down. This sent a huge power surge to all the local homes and burn't out things like freezers and refrigerators, computers, electronics, microwaves, thermostats, etc. Our power company reimbursed these expenses for their customers who were harmed. I had some things on power surge protectors on others it did not. My surge protector for my music equipment and TV actually burned up and the equipment was not protected.

He lost his case when he said, surge protector... What he's trying to say makes nonsense. If I'm following him correctly that there was voltage in a ground/common wire? If that's the case it's his equipment that wasn't properly grounded. That's if I'm understanding him correctly?

It's hard to prove, especially if you don't know anything about electrical but some surge protectors doesn't protect on all lines ie hot, neutral, and ground. Some are different but alot of them usually monitor from the got to the ground for shorts and sometimes from the neutral to ground. If everything is hooked up correctly from the outlet and the surge protector isn't bad then it should be good to go. Everything is usually grounded though such as the bare metal cases, ground of the audio cable(hence why sometimes you here a light buzz in the background). So if the hot and ground was switched on the socket which is very bad bc then the bare metals or cases are now live and if you touch them and then touch another object you can complete the circuit and fry your self. There are a lot of variables at play here so my advice is before you plug your equipment up to anything get your self and outlet tester and make sure that both of the orange/yellow lights are lit. One orange light usually mean open ground or no ground and if the red light turns on that's very bad and means the hot or neutral is either hooked up to the ground or is in reverse

I’m no electrician, but wouldn’t it fry everything that was plugged into the mixer? Including the mixer, microphones, speakers, and anything else that was plugged into the mixer. Why only the computer?

My dimmer switches in my 52 year old house would fall under control of ghosts..on and off..dim to bright for hours.ir was incredibly annoying..I should have demanded that they do the dishes instead.

I'm curious. The laptop shorted when plugged into the wall power. There was no other source of power from the mixing board or elsewhere. Therefore, the only source of the short had to be via the wall power, correct? Presumably, the surge supressor either failed to protect against the surge, or, like the plaintiff said, the surge came through the grounded leg of the power, correct?

That was a faulty ruling but the plaintiff didnt know enough to present his case. Restaurants, bars and night clubs are notorious for faulty power. But bad grounds wreak havoc on sensitive electronics. Electricians are equally at fault. Just because you have power doesnt mean its good. Anyone ever hear of a ground guard? Theres a reason that exists.

As long as the outlet is providing 120 volts then end of story! If there was an issue with a power surge it's a problem caused by that City power plant! The only way he could win was if the bar owner wired a 220V to a 110 outlet he didn't tell him. That's it!

If there is anything going through ground, that means ground isn't ground. It's literally attached to the ground and will not pass electricity toward equipment but rather to the ground. That is the entire point of ground. Blaming anyone but whoever the electrician is would require proving that this is a known issue that was not addressed.

This has nothing to do with surge or surge protector. He is not plugging in the laptop's power cord; he is plugging in the audio cable when he said he saw a spark. In normal operation, audio cable don't carry enough voltage or current to create a spark. The most likely culprit is static electricity.

This is what insurance is for. If he’s going to run a business and have expensive equipment he needs to invest in insurance. Even without using my items professionally I’d have my computer insured.

Hot ground is very common it's usually caused by a loose outlet touching the metal box. It damages equipment with DC batteries because it has a ground to the batteries

there isn't much difference. Unless you spend hundreds of $$ on a surge protector. The cheap $50 MIGHT save you in a mild surge.........if you are lucky. And most don't have protection on the ground

I imagine the bar has a liability waiver. Plaintiff only had a chance if he had brought an expert witness. A lot of people improperly install outlets. Old buildings often are not properly grounded, even if a 3prong outlet is installed does not mean it is grounded. . Buying a simple plug in tester is not enough. Surge protector only protects surges, not faulty grounds.

the defendant needs to learn how to explain things. he's basically talking around everything. fumbling his words. most of the time if anything sparks when hooking it to power its usually the equipment

He needed an electrician, lived with power issues. Sometimes a random spark brakes the surge protector & turns power off. When you flip power back on the plug still works. Not shore the bar owner was 100% honest.

I don't care how he tries to dress it up it has to be his equipment that's at fault. My understanding is he plugged all he's equipment into the surge plug. And then into the outlet plug and got a spark. Surge plug must av had a fault because it didn't protect any of it. Plus I'd like to know what happened to the main fuse board did the circuit trip out.. 🇬🇧

pretty sure the electricity was at fault on this one. A surge protector would have no effect on current going thru the ground.
