The plaintiffs purchased a vehicle from the defendant. When they got the car home, the plaintiffs say they discovered there were multiple problems with it, so they're suing. The defendant claims he gave the plaintiffs a two-day warranty for the engine and transmission only. The vehicle only had leaking oil. The defendant insists he agreed to fix the car for free, and he owes nothing.

It has *got* to be illegal to drive a car with the fuel tank being stabilized by bungee cords! 😧 That is absolutely insane!

In a state with a safety inspection it would not pass the inspection. But only about half the states have a safety inspection. I live in Missouri and we have a safety inspection and a properly secured fuel tank is on the inspection. I am 10 miles from Kansas and in that state there is no safety inspection. If you have the title and the money your car gets a tag. And I have seen many Kansas cars break from issues that would have been caught in Missouri at the inspection. Here's the kicker though, Missouri may be dropping the inspection as it is currently $12 and has gone from annual to every other year but at that price no shops want to do them. When labor rates are $125 an hour or more and it takes 30 minutes to do a proper inspection, that $12 is a loss for the shop.

​@@1967davethewave I used to live in Missouri and those safety inspections, it's hard to find a shop that will do them as not every mechanic shop is state licensed to do them And there's plenty of shops that will see you drive up and tell you that you passed without doing the proper inspection.. I know personally..lol..

so, the way appeal works is that if the higher court finds it in his favor, it goes back to that judge . and to appeal, cost several thousand and takes forever so he would be out of his mind to appeal a 2,000 verdict since it will cost him more to go through the apeal process. Also, he would probably have to have a lawyer draft the appeal since he would only have 30 days from the final judgement to appeal and can lose the appeal on technicality if it is not done properly.

That was a ratchet strap... I know cause my brother had one on his truck after he took the fuel tank off,for replacing a fuel sending unit,then he drove around with his family in it for another year or so before it broke down. Then he gave it to his nephew 😀

gas tanks are supported by metal straps or strap like supports so its actually not that unusual but metal straps are of course stronger .

The judge felt bad and found a way to refund that money to the plaintiff... There's a strap holding the gas tank. The defendant said I don't know anything about that.

No she didnt. If the cost of the repair would have exceeded the cost of the car, then there is no sense in doing the repair . The seller thought in this case, he would have been able to get one of his crooked friends to do it, but it would have had to go to a mutual repair shop which mean that the repair shop would have no relations with either party and the labor cost to pull down a engine is 2500 and thats not including parts and the seller would be responsible for covering the cost. Now, what she did was , she knew there would be more problems with that car even after that issue was fixed so she also did them a favor.

​@bjvu9460 the plaintiff didn't have proper evidence. If judge didn't allow the phone call to the mechanic, they would have words and pictures. Judge saw through the shady defendant and found a way to uphold a flimsy 2 day warranty.

Agreed. She did some of that "rough justice " because she felt sorry for the pitiful plaintiff. Hec was dead in the water on this case, having come to court with no real evidence. Plaintiff may not realize how fortunate he was to get a verdict in his favor.

@@bjvu9460 the so called mechanic was not specific about what exactly needed to be repaired . all he said was that he saw oil and coolant leaking at the bottom of the engine . thats not enough , ANYTHING can cause those type leaks and its usually something simple . they never claimed the car ran bad or overheated or made noise .

This is one of my biggest pet peeves; crooks who sell junk cars to trusting people or very young people. It breaks my heart when I see a car broken down on the side of the road and it still has a paper plate on it. 😢😡

My husband was a used car dealer many years ago. He bought them at auction and worked on them for days. He would pull the seats out and clean everything, and if anything needed fixing or replacing he did it. The entire engine, tires, brakes, everything. He only sold cars that were sparkling clean and in great condition. Never had one customer with a complaint. Every single customer was happy and felt like they got a super-good deal, and he had a lot of pride in that. His good name and good reputation meant everything to him. The defendant's name is MUD. He has zero honesty or integrity. I hope the plaintiffs left reviews & pics on the internet to warn other people about this crook.

well their friend who supposedly was a mechanic was not specific as to what needed to be repaired . many simple things can cause oil or coolant leaks . there was no claim the car was overheating or making noise so unless the mechanic gave a specific repair that needed to be done then i think their proof was insufficient and i dont agree with the verdict . they most likely found a better deal in those two days and decided to make a fake claim to get their money back on this car , buyers remorse .

You'd be surprised as to what dealers will get away with. We had a customer come in a week ago with a car she wanted to buy, we lifted it up because we smelt burning, and saw the muffler being held on with one bolt and about 50 feet of duct tape

A 2 day warranty sounds like he did a quick fix and was expecting it to last a few days and once it began to leak again it would past the 2 day warranty…but that wasn’t the case

I hope I would never be so desperate, as to screw people over for $2000 dollars. Good thing he had that 2 day warranty on the engine, for otherwise, he would have lost. Beware buyers... "as is" on used sales is standard.

Have to admit JM was very lenient in this case by calling the mechanic - who could have been anyone, and then basing a judgement on that phone call with nothing in writing. Surprising result.

yes , alot of simple repairs can cause oil or coolant leaks . the coolant leak could have been from a leaky hose which is easy to fix and the oil leak could have just been from a leaky oil gasket or oil seal which is also a simple fix . there was no claim that the car was overheating or smoking or making noise so im thinking they got thier friend who supposedly was a mechanic to claim they were gonna spend alot in repairs but he never was specific about what had to be repaired so i dont think i agree with the verdict .

that fake mechanic convinced the judge , but a more knowledgeable judge would have asked the mechanic to be specific about what repair needed to be done instead of settling for him saying he just saw some oil and coolant leaking , because alot of simple things can cause that .

I spent $13,000 on a 2002 S10. I can't figure out why people think they can buy a used car for a mere $2K and think it's going to be reliable. I still had to stick another $5K into my truck to make it road worthy to my standards. Granted it was an old truck but it had only 44,000 miles on it so it was well worth it. I just sold it after having it for another 9 years and virtually gave it away for $3K to a nice family that didn't have much money. I knew them so it was more of a donation. Good people. They're still driving it today 2 years after they bought it from me. I'd never sell something to another person that I wouldn't buy myself. Being honest just feels good.

Judge M can be so inconsistent...sometimes she allows plaintiffs to call their expert or potential witness on the phone, sometimes she doesn't. It should either always, or never, be allowed.

Everyone is saying that the 2 day warrantee is crazy. It seems legit to me. And then people are crying - As is sale!....yes, as is with a 2 day warrantee! So they bought it and they took it to the mechanic within the warrantee limitation - to find out that the tank was strapped in with a bungee cord? The mechanic also said that it's not worth repairing.....and to those who say that they shouldn't be allowed to call witnesses. What do you suggest? That the mechanic take the day off to be on People's Court?

I'm not familiar with a Chevy Malibu as they have never been sold here, but if the fuel tank is as bad as described the car shouldn't even be on the road. Here in Australia it wouldn't pass a roadworthy and if by chance a mechanic was stupid enough to pass it he would be in serious trouble.

@@mickm6309 yes, I think that's the reason the plaintiff won. JM said - You bought what was being advertised as a working vehicle. And then the mechanic said - Repairing it would cost more than it's worth.....So in order for them to pass the inspection, because it wouldn't pass as is, with a 2 day warranty. The salesman was hoping that they would take more than 2 days to figure out that it's a piece of junk.

@@LoveChild71 Yup the 2 day warranty is the only thing that saved the Plaintiffs - Otherwise it wouldn't matter whether it passed inspection or the car blew up on their way home. Glad the defendant stupidly offered a warranty though since that car sounded like a rusted out death trap that I'm sure he knew about.

That car salesman was a complete scammer. Selling a car with the gas tank held by a strap should be a criminal offense. The car was shooting oli out. That engine was going to blow eventually. The plaintiffs were lucky the judge spoke to the mechanic. They should have gotten something in writing.

I get it. All sales final... you need to bring a mechanic with you. I get it. But everybody doesn't have a mechanic on hand or have the money to pay for one...Hints why they are buying a used car...Either way, scumbags like him should NOT be allowed to get away with sht like this! This is disgusting. Too many of these people take advantage of the law, and it's not fair. A two-day warrantee, who does that? A scammer or a crook. And he claimed he would repair the leaks, but not the gas tank that was being held by bungee cord. In other words, the car was junk held together by bungee cords and leaky tanks.

What happened to buyer beware. What happened to there is no warranty when you buy a used car. This judge is not the first time she has done this. She keeps favoring people and thinking that a car sale is not a car sale. As is means as is you yourself judge have said it many times and now that you feel sorry for this young kid is there going to return his money wow talk about an unstable judge

SERIOUSLY? EITHER THIS CASE WAS SCRIPTED OR ?? BUT WHY DIDN’T JM ASK TO SEE THEIR CONTRACTS OR BILL-OF-SALE, which would have all their signatures on it and any fine print, which could have helped her make an informed decision about this case? Regardless, she just opened a huge can of worms by her ruling! I understand the Plaintiffs side, BUT definitely don’t believe they were that dense in buying a used car that old with a “2-day warranty”?? Cause “WOW”!! Even Dougie poked fun at their lack of smarts more so than he normally would??

I buy a lot of vehicles and before handing the money over I check it over thoroughly. Look underneath, let it run and watch for leaks, check the frame, check the oil, and look everything over top to bottom.

The 2 day warranty is a good idea if you are allowed to return the car and get your money back with maybe a small penalty of say 15% of purchase price

When I saw the video I thought that isn't oil, it is water, or a mixture of both, the car possibly had a blown head gasket. But in all honesty with a strap holding the fuel tank in and all the mountings rusting, the car shouldn't even be on the road.

Yup, it is a blown head gasket and to repair that is over 3000 and even if they allowed the car to be repaired, the seller would have had to take it to somewhere the court approved which means to a reputable repair shop. The seller thought he could have had his home boy patch it up with black pepper so it runs for another week or some other tricks I have seen people use , but that would not have happened and its better and cheaper that the judge ruled in this manner
