The plaintiff says the defendant let a truck park in his parking spot, which is right next to the plaintiff’s spot. She fell over the truck’s chain and now she’s badly injured and disfigured. She’s suing for pain and suffering, medical bills, and a detective fee. The defendant argues the plaintiff went onto his property and that’s how she tripped. He says it’s her fault that she fell because she trespassed.

What a lot of people don’t understand is that a fall like this can be the start of decline to death in a person of this age. All it takes is one major fall and it’s downhill after that.

Happened with my mother. Accidentally fell and quickly went downhill afterward.

Yeah, it concerns me that the medical staff who attended to her wanted to x-ray her hip. It might just be a precaution, because the thing is, hips break easily and often in the elderly, and as my mother (a nurse) always says, "They're never the same after that."

When I saw her son move to the podium like he was about to start saying some words I knew the dear lady is going to be well cared for, bless them both, I hope she has made a full recovery and is enjoying life with loved ones.

Right? They would have gone after his insurance or that of the HOA. I’m surprised the judge didn’t dismiss without prejudice and suggest something like that to her. She got cheated.

I agree and my thought at first was that she didn't have a strong enough case to go bigger than small claims court. But after listening to the case I believe she did!

she sued the wrong person and the judge should have known better . as soon as the defendant told the judge he did not give permission or know about it then she should have told the plaintiff that she would have to sue the owner of the truck .

That's got to be heartbreaking. At that age it's great to be up and moving around, and to lose that over negligence is just awful. She may walk again but I can guarantee she'll never be back at 100%

The landlord needs to make sure the idiot is not parking commercial vehicles and its HIS responsibility to know who he is renting too and to give a copy of the cCCR to the tenants. He was rightfully sued. The tenants do this shit all the time

There does not have to be PROOF. The standard for negligence is “knew or SHOULD HAVE KNOWN” and an attentive landlord who obviously lives on the property because he’s on the board SHOULD HAVE KNOWN. See, this is the stuff you learn in ACTUAL law school. Then you get to stay up until 2 a.m. working and correcting arrogant morons who think the law is whatever they feel it is. Sit down.

I don't understand why the plaintiff didn't sue the person who parked the vehicle illegally. That person clearly put others in danger by have obstacles outside of the parking space. The plaintiff also needs proof that their will be future medical expenses due to this specific injury. I think this case should have been dismissed so that the plaintiff could get all of her paperwork in order and sue the negligent person. Landlords don't know everything that is going on until something serious happens.

I don’t think she can get anything down the line or in the future. They sign a waiver when they go on the peoples court whatever they win that’s all she gets. The man got lucky . The peoples court pays that $1500.

If judge gave her 3,000 at least, she shouldn't 'have to' pursue anything further. She is elderly...could have had a serious head injury or fracture. The man should have paid her himself....a gentleman would have. Commercials vehicles are not allowed there...no-one is expecting a chain or cable there...tied to a pole...where it should not be!

Everyone saying watch where you are walking, what about those who are blind or sight impaired and have gotten accustomed to walking by there only to fall. Definitely negligence by the other party. The landlord should sue the tenant now lol

What a dear, sweet, kind lady who was more thrilled of meeting JM than anything else. I would have fallen over that cable as well bc it was at ground level, and no one would expect a cable to be there. She deserved the $5,000, but I get why she didn’t. Hope she makes a complete recovery and doesn’t have to make any changes to her living arrangements. She has a good son too :)

no matter how sweet people may think the plaintiff is , there was no evidence that the landlord knew about the situation and i think the woman fell because she is elderly and did not see where she was going and its just something that can happen when we age , we cant go around suing the world because we got old . bad verdict . and one more thing , i dont believe for one second that this elderly woman is not on every possible govt program she can get and i know damn well she has medicare so she was just looking for some easy cash becuz she got mad that she fell and wanted to blame someone else .

It clearly stated in the CC & R’s of the DEFENDANT’s complex that no commercial vehicles can park there overnight, period. So whether this woman was just elderly or not, the chain she tripped over should not have been there. Second… damn, you know nothing about that woman and your assumption is she's on every public assistance? She’s lived in the same place that she OWNS for 49 years, stated she had HMO and JM would have been able to tell if that was BS by looking at the medical paperwork. “Medicare pulled me out of there…” . I wish we could have heard more, but most health insurance companies will question certain injury claims. They will send a questionnaire or a specialized nurse to find out where the accident occurred and how it occurred. If they believe another entity is responsible,they can refuse to pay or attempt to recoup any health related payments. It’s a regular practice amongst home insurance, insurance for business properties, vehicle insurance companies and health insurance companies. They sort it out amongst themselves. This woman deserves so much more than what she can get in small claims court.

maybe medicare knew she was exaggerating about needing a walker . i saw how she was walking with it when the case was over . she was walking fast and normal with no limp or odd movements but she appeared to be just pushing the walker like a shopping cart . i think she may be lying about needing a walker to get easy cash .

Older people's bones are more fragile the older they get, and once they fall its downhill from there. Some of them be bound in the bed for months and not able to help themselves. Sometimes it takes years for them to recover injuries and their stuck in the house disabled.

It is weird that she went to an ER and didn't get the typical knee jerk work up for head injury or fall. Also an ER or urgent care would have sent her to follow up with a primary care doctor afterwards who would have outlined a treatment plan. Not having collaborative medical documents is suspicious.

He should now sue the truck owner for any damages he has to pay. At the end of the day the truck owner has to properly announce the cables with lots of flags at least. Also, I’m not sure how the defendant has to pay anything for something he didn’t know or authorize.

Even if it's a shared parking area, she had no reason to cross where she did. That's on her. How can the judge say he is responsible for the spot, but at the same time claim it's a shared space? It's not his property.. it's not his problem.

When I first heard the intro I thought this woman is at fault, but upon seeing the details completely changed my mind. That wasn't even a chain, which would've been more visible, it was a cable. No wonder why she didn't see it and she wasn't on anyone's property. She was just maneuvering through the parking lot. Shouldn't have been a commercial vehicle there in the first place. It's lucky she didn't get hurt worse than she was. The defendant really pissed me off. Did he not see the photos of that poor woman. If she has gotten more medical proof, I'm sure she would've got $5000 judgement.

this was a legally terrible ruling! she only awarded her money because she felt bad. 1. the tenant would be responsible. 2. the owner of the vehicle would be responsible. 3. she's responsible to see a chain in the air. 4. the association would be responsible.

not necessarily true. she can sue the landlord and then he, in turn, can sue his tenant. in an HOA the owner is responsible for "RULES", even if the tenant breaks them. so, go learn some law. and no, the association is not responsible unless it was reasonable they would know., or they caused an issue in a common area.

Well it's the fault of the property owner's tenant. So essentially I believe both tenants as well as the owner are joint and severably liable. So even though the owner isn't responsible, he's at fault. He could likely sue either tenant though or deduct his damages from their security deposit since they were directly responsible.

This is my 1st time ever learning that Medicare will not pay for an injury. As a rule, if it's a benefit that's covered, they don't care how it happened; they just pay the covered part of the claim. However, I suppose if you told the providers NOT to bill Medicare because you want someone else to pay, then the hospital & doctors may not file the claims.

Even if you bill the claim Medicare will deny it. I work in medical billing (at a outpatient radiology facility) and I have seen medicare deny claims that were related to a car accident. They might pay for the emergency room visit (I have no experience with hospital or emergency room claims so I’m not sure about that).

As someone who's worked with Government payers, this is emphatically untrue. All payers have guidelines and rules about what, how and when covered services and benefits are actually medically necessary. Medicare and Medicaid are governed by CMS. Why wouldn't a person have a RIGHT to secure equipment and tools with a cable or chain? She knows the person does this and cut the corner anyway. Tripping is her fault.

If that is the color of the chain the person should have put a colored rope or something so people can see the chain....The defendant is at fault....He's the President of the HOA and knows the rules....

Wow as him being the president of the HOA, he should be more responsible for the rules and regulations and be held accountable, despite that parking spot being the one he owns. I hope after she sees a doctor that she files for further damages.

That happened to me - tripped over a chain that was anchoring a gate into a parking lot. It was dark. There was a big fight among a group of people, so I walked around where they were - sidewalk - to avoid the fight. I went down hard, threw two laptops into the grass and held up the third one (I had them for work) so it wouldn't break. The people stopped fighting, ran over to see if I was OK. Me: "Forget about me! Are the laptops OK???!!!!!"

Omg i feel so sorry for her 💔 i worked in the nursing home for 5 years and then started doing in home health the last 8 years. Once an elderly person falls things start to instantly go downhill for them. Their bones are very fragile at that age! And for the ppl saying she should have watched where she was going... shame on you! What if that was your elderly mother???? But besides all that...the vehicle and the chain was NOT supposed to be there!!! End of story!!! Whether she was looking or not! Yall sound ridiculous 🙄

This is the most ridiculous lawsuit I've seen on here. How is he responsible for something his tenant did? Also, if the truck was parked there for days as they said then how was she unaware of that chain being there each time it was parked and tied up?? Sounds like a damn cash grab by ol granny.

This is a terrible ruling and I sincerely hope it was made just to boost the show ratings. The owner cannot be liable unless he is proven to be negligent in not taking steps to tow or otherwise take legal action against the driver. But even then that is still a stretch. She absolutely has a case against the truck owner for doing that and she should be pursuing the driver with a lawyer.

Having the chain there was negligent and if the incident happened on the landlord's property he owes. Period. There shouldn't have been a chain hanging and the landlord should have been more observant while having the commercial vehicle on his property.

It didn’t happen on the landlords property. It happened in the common area, but he was the landlord of the person who ran and secured the cable to his car and caused the accident. Too bad the person that actually caused her to fall by his careless action didn’t get sued. I hate when owners are sued for what their tenures do.
