What diagnosis do you have?
Currently, I have Complex PTSD (primary diagnosis) and Borderline Personality Disorder as a secondary diagnosis. I am also on the waiting list to be assessed for ASD conditions, such as autism and ADHD.

I'm waiting for my PIP tribunal - I have bipolar 2 (primary diagnosis), autism, ADHD, anxiety with agoraphobia, and spent nearly half a year off sick until I went into my current job, part time. I have massive issues with budgeting, cooking, binge eating, washing and communicating amongst other things. I got 0 points and told there's nothing wrong essentially because I can drive, have a degree, and go on holiday when I am well. Luckily, I have a *lot* of medical evidence and I have a charity helping me and representing me at tribunal, so I'm feeling hopeful it'll go in my favour. I appreciate this video because I want to know what to expect as it's a scary prospect for a lot of people.

Hi, from my experience to date, ensure you explain in detail how budgeting, cooking etc impacts you on a daily basis, i.e can you cook every day, are you motivated to cook are can you cook safely and do all these reguarly or not, and if not say why. do you need support some or all of the time, do you need someone to prompt you or encourage you for all the descriptors on the PIP form. Do you wash regularly or do you struggle mentally or physically and what does that look like for you. look into all your conditions that you state via NHS website or similar and link the symptoms to yours as evidence and say how those symptoms impact you on a daily basis. If a conditon impacts you more than trivially part of the day then legally it is classed as impacting you for the whole day, so you need to evidence via medical notes, your statments written or verbal or any other form of evidence that your conditons impact you over 50% of the time and as they are most or every day they will impact you over 50 % of the time overall. If you are also going for mobility, you need to explain if you could not undertake an unfamiliar journey without support of someone else and if you had not got a car you would need someone with you on public transport as you would not have the ability to plan a journey or it would cause you overwhelming psychological distress. How are you impacted when driving, ie do you get overwhelmed if there is a lot of traffic or sudden changes/diversion, you could argue that you are been discriminated for going on a holiday when you are as you say well enough as you are not taking regular holidays. although it would help if you stated these were familair places or that you did not travel to new places alone. you should not be discrimated against for having a degree, as mental health issues can impact anyone, it is how your conditions impact you. you can have a degree but things may take you far longer than another person or you may need additional support. I could say more but do not want to overload you too much as i know it is hard to think properly when going through such processes on top of health issues. I hope this helps in some way, good luck with it all and do not fear anyone in the tribunal, tell or write down for your representative from the charity everything you want to say to ensure it is put across to the tribunal properly, if the tribunal start asking you lots of questions get your represetnative to help you, do not rush to provide an answer without thoroughly considering their question. I am currently waiting for a PIP tribunal. I did go heigh the DLA process about 10-15 years ago. It was (as far as I can see), an identical process and treatment. I was treated awfully at the tribunal, I would even go as far as calling it abuse. As you said, it is like being interrogated like you are a criminal.

I had a good process. They were very kind. Even the Judge was nice. No Dwp rep, was present at my tribunal.

@@dawnyandandy the best thing to do is communicate that and say that you're struggling if you are etc. Always remember they aren't mind readers and will only know something if shown or told

Thanks for this! I have a tribunal tomorrow which is online. The answers to my assessment were bizarre because they weren’t correct! For example: I’d said I need prompts to take my meds and I often forget- their reply was “you remember to take your meds every day” lol, what?! Oh and here’s the best one “you’re not taking any treatment for your autism” Eh?! There’s TREATMENT?! Well I look forward to this tribunal where they tell me exactly what “treatments” are there for Autistic adults 🤨

Good luck for your tribunal, I hope it goes well. My response to the medications would be "I can only take and remember to take all my medication and take it appropriately and at the right time with the aid of others, timers or a dosette box" (only include what applies to you). Sometimes you have to be very straight forward and direct in order to get the answer you want. Don't be afraid to over explain. Also the judge at the tribunal in my experience was really good at stepping in if needed.

100% but also the amount of times I've been told to lose weight by doctors is pretty much every appointment I have. It's not nice.

I haven't been to tribunal YET but I fully intend to go! I'm at the mandatory reconsideration stage and you are correct it is very stressful and degrading. I have heard many people say that the DWP won't change their mind on the mandatory reconsideration stage- they need a judge to tell them they need to change their mind. They made me so cross with their first decision (I don't think anyone owes me a living) but the things they said I had said were just WRONG. They say I claimed that I can't make budgeting decision, why would I say that? I'm a qualified Chartered Accountant! They also said I can walk 200 metres! I told them I can only walk 1to 10 metres and even then not safely, reliably, to an acceptable standard or even unaided without someone supporting me. Sorry I'm ranting now but I would love to see someone face to face. My PIP assessor didn't even seem to know anything about PIP. Since then I have done a lot of research so II will be prepared next time. If I'm not entitled to it I'm not entitled to it - but I didn't write the rules but I have read the rules and I definitely AM entitled to it.

I would say from what you've said you seem entitled to PIP. Obviously I'm not a decision maker. I would say dont get your hopes up for them to change their mind on the mandatory reconsideration because they probably won't. Keep going and go to tribunal. You've got this.

@@nishagrant5990 Yes but only after I'd written to my MP who in turn wrote to Mims Davies the Minister for Disabled People and the MIRACULOUSLY my decision came back based on facts so I didn't need to go to a tribunal. thanks for asking - it is a terrible system

Thank you for the video, I am going through an appeal at the moment, which hasn't been good, the case manager was to ring within 5 working days of my phone call to appeal, the have rang twice for 3 to 5 seconds, not enough time for me to answer, then for me to ring the DWP to tell them this, then to be told the case manager has up to 3 times to ring, still no 3rd phone call and it's past the 5 working days, so it will be most likely that I will be facing a panel, the assessor phone call from as bad enough, I take strong meds for my chronic pains conditions and I get counselling and I'm on meds for depression and anxiety, but apparently on the phone I showed signs of distress but not anxiety 🤔 and that I responded well to questions, even though I was told at the start that I have to answer the questions and was crying at points during the call because off the stress and anxiety, how can these assessors tell if someone has stress and anxiety over a phone is amazing

Yeah they seem to downplay how the person is actually feeling. My best advice is to keep saying how anxious you are. Reinforce your feelings over the phone. Explain what anxiety symptoms you're having, fast heart rate shakes etc... Also explain how you remember to take your regular medication, do you rely on someone else to prompt or remind you? Or do you use a dosette box. I know how hard it is to loose weight it makes me feel so sad that they focus on that . Especially with constant pain metal health is a big enough battle as it is xxx

Im waiting for a tribunal, I have pain, discomfort, fatigue plus other ailments in both knees that limit my mobility, currently its been undiagnosed but its not arthritic; my GP says I need more tests and have to see specialists. I received 0 points for everything, utter jokers. Hopefully my letter from GP saying my problems will get worse will help at the tribunal, but since things have changed during the appeal and you have to disclose changes, the DWP are citing a legal term saying the appeal should be thrown out and I should start my claim from day one...they definitely don't like giving PIP do they, they try and find any excuse.

No they don't like giving PIP. I'd still wait for the tribunal especially if when you started your claim all the information was true and correct. Things change in health conditions daily, weekly, monthly and yearly. Remember that the DWP say it's more about how the condition affects you rather than the actual diagnosis. Focus on the symptoms and how they limit your life. Always reach out to citizens advice for appropriate individual advice, they really helped with my claim.

I'm feeling a bit overwhelmed because I have over 120 pieces of evidence as I have lots of chronic illnesses, did they focus on the evidence or was it more on the initial assessment and descriptors? This entire PIP process since the initial application has been a year and a lot has changed in a year so its hard to explain everything

@@AmyClarkesinger it's a bit of both. Do you have the write up from your initial assessment? I would start by writing where you feel they didn't give you points where you think they should have at the time the assessment was done and then in a different colour I'd write an update if there is one. Then I'd look at your evidence and pull any really important ones out and mention those at tribunal. Usually they ask you questions from the initial assessment but also additional ones. Usually the judge is the main person speaking and asking questions and then they offer the space to the other professionals attending. I wish you the best of luck for your tribunal and I hope you get awarded what you need/deserve

I applied for my adult son who has anxiety and agoraphobia.But they casually ignored everything and said he didn't have anxiety as he attended a mainstream school and only got support at primary school.Nothing but mindless subtefuge

How long did it take until your actual tribunal date from when you have applied intially? My claim has been 8 month now and I'm still waiting for my actual tribunal date they just kept sending reminders for more evidence. Did it take that long for you ? Glad to have come across your video very happy you got there in the end xx

From the start of my application to getting my result it was about 2 years. But between wanting a tribunal and getting one I think it was about 6 months. Have you gone through your appeal and then asked for a tribunal?

Yes so after my mandatory reconsideration I got awarded only 4 points so I obviously went for the tribunal which I initiated in about march I think and now just wondering how long it will take until I can actually get the date. @@xjessgoonerx hi, you're most welcome, I try to reply to everyone as fast as I can because I really wanna make my audience feel like they matter to me, because they do. I would say if you haven't heard or got an appointment for your tribunal by September maybe try calling the PIP advice line and ask how long the tribunal appointments are usually taking as of now. Like on average how long is it taking to get a tribunal appointment. They should be able to tell you or advise on who to call to get an answer. I wish you the best of luck with your tribunal. Please remember that citizens advice is there to provide help with PIP claims. They helped me with mine and got me to think of things that I wouldn't have ever considered.

Finally got my tribunal date this Friday. Really nervous about it and I think I'm super prepared just really anxious about how it's gonna go and how the outcome will be I've been through hell this past year and my conditions have only gotten worse. I’m getting so pissed off had appeals rejected tribunals lost now the upper tribunal has it has to go back to the first tribunal because my arguments are strong, now am I gonna wait another 6 months for another tribunal? I’ve been fighting this since 2021 and its annoying

after 18 month waiting for Pip Review They score me like 6 points less, they award me Pip for 4 years only Standard, now waiting for DWP to review again, if they don't get back where I was I going to tribunal, I got 0 points on 2018 after 2 tribunals Pip and ESA got rewarded for 4 years, my health is life time will not improve, GOV keep saying for long health problems will be 10 years light tuch review DWP only award me 4 years lol, Worning if you deal with DWP get ready to get more sick than you are... I am outpatient in Euston London Hospital since 2001 I get checked by hospital 4 to 8 times a year still not good for DWP

Yeah it's horrible, the pip process. Gov did say 10 years for conditions that won't get better. Mine has been awarded for 2 years but it's unlikely to get any better. I think it depends on the chances that it will get better. Like if there's a 100% chance you won't get better they'll do 10 years but for any chances less than that they'll do less time guaranteed on pip.

o wow so i think i did not get my tribunal at all i thought that was written in a letter ,i dont remember having a tribunal on the phone with others present ,i am even more distressed now ,talk about bias .

Tribunals happen after you ask for a reconsideration if you are denied first time round. If the reconsideration is also denied you can request a tribunal. That's when you get multiple people. But mine was over the phone as it was during COVID. They might do them in person now.
