A woman who was outed by "Baby Reindeer" fans as the alleged stalker of the true crime drama's creator and lead actor said she felt "used" by Piers Morgan in an interview about the Netflix series.
"Baby Reindeer" tells a fictionalized version of creator Richard Gadd's experiences with stalking, and has become a worldwide phenomenon since its release in April. That month, an unnamed woman who was outed on social media as "the real Martha Scott" told the Daily Mail she was considering taking legal action against Gadd and Netflix for the harassment she has faced as a result of viewers trying to track her down.
On Wednesday, Morgan revealed he had interviewed Fiona Harvey, believed to be the woman first interviewed by the Daily Mail. The interview will be released Thursday at 3pm ET on Morgan's KZfaq channel, Piers Morgan Uncensored.

The woman who allegedly inspired Richard Gadd’s hit Netflix series Baby Reindeer will give her first TV interview this Thursday (9 May).
In the series, comedian Richard Gadd plays a fictionalised version of himself who gets stalked by a lonely and mentally ill woman called Martha, whom he meets while working at a pub.
Following the series’ success curious fans have tried to discover the inspirations behind the show, which members of the cast have vehemently discouraged.
Scottish lawyer Fiona Harvey, 58, who has been labelled the ‘real Martha’ has received death threats from Baby Reindeer viewers and will speak on Piers Morgan Uncensored to “set the record straight after being unmasked by fans”.

She can sue Netflix, or attempt to, for not protecting her identity - to an extent it doesn't matter if the allegations made are true or not, they had a duty of care, they do to anyone portrayed in 'fact based' programmes.

For what condition exactly? He's the one who took lots of drugs and has made lots of money. She's a professional person. If you know anything about npd for example they take something with a grain of truth and twist and exadurate it. The grain I'm referring to is the mp part of the story. She doesn't strike me as being unwell in any way.

I can't help but imagine that maybe Richard Gadd wrote the show because the police didn't do anything about it. Maybe in some way, him being picked up by Netflix could allow the full story to come out and he could get some closure in real life as well. He might have embellished some of it, but if it's going to trial then he might also have just caused his "stalker" to out herself. I'd hate to think that in order to get any judiciary to look at a case like this that someone would have to write a whole drama about it though.

It used to be called. ‘Articles’ She mentioned she was an intern and was headhunted (?) by the woman who terminated her employment after a few days & later filed an interim injunction against her. I doubt whether she’s ever held down a “proper job” although she likes to say this of Richard Gadd. 😂

⁠@@wearequickflix maybe the public records are in fact publicly available but they’re only viewable on request and must be released by the courts? Other clauses might apply under the Freedom of Information Act and the Human Rights Act. Has anyone looked into it seriously? I’m just asking, because all I’m seeing is tabloid, lifestyle and mainstream news, with not much clarity on the criminal record matter. And on the internet anyone can say anything.

all her interview achieved was to confirm that she's still crazy. Imagine if she'd gone on to Piers show and said, ''i wasn't mentally well back then. I 'm so embarrassed now. I'm so sorry I harassed Richard. But I feel a lot clearer now. I've had a therapy since then, I've been in a psychiatric hospital I take medication now''. EVEN IF SHE'D BEEN BULLSHITTING AND WAS STILL SECRETLY 100% WHACADOODLE, everybody would feel bad and back away drawning a line between ''back then'' and the 'here and now''.

I used to work in mental health and can say that its classic personality behaviour to use legal actions or company bullying policies etc to attack others and usually without merit. Its just another way of being aggressive towards others.

Me too. I watched the Piers interview and said, "wow, her behaviour screams personality disorder." Then I searched for stalking and mental health diagnosis and found personality disorders are the diagnosis associated with stalking. I didn't feel the Martha character necessarily showed as much personality disorder behaviours. The Martha character was also much more sympathetic. Fiona came across as mean and dangerous. When I read about how she behaved with the family of the lawyer she was hired by on a trial basis before being fired after two days who then stalked her family and other employees, it was terrifying. I had a couple of clients who stalked me that were borderline and of course we take this risk as therapists and know how to lessen the results and also how to help prevent them from doing it to others.

They made the character so alike to the real person ,they didn’t have to make her do identifiable down to accent,hair and shape,if it’s a drama they could have changed that slightly for the story to protect her more ,it’s not so much the internet-I’m sure a solicitor working for her could argue that was something they could have done to protect,so they didn’t do everything and they could have ,also said based on true events,another grey area a solicitor could argue I’m sure ?

'Every reasonable precaution to conceal identity....' by portraying an overweight, short, brunette, Scottish undergrad at law as an overweight, short, brunette, Scottish undergrad at law. Same age (as she would have been at time set). Using exact messages that were easily searchable and referencing her previous stalking case (which never went to trial I believe), also searchable. I'm no lawyer but I think she has a case. And I'm not excusing her stalking behaviour either, but it's irrelevant to whether her privacy has been compromised.

She doesn't have funds for a case like this against a team of Netflix lawyers. If you are claiming certain benefits you can apply for legal aid in UK but it absolutely does NOT cover things like defamation/slander/libel. The only way she could fund this is if a publicity hungry law firm agreed to take the case on a pro bono basis. I don't see that happening.

I dont think you guys understand the law or the facts. Beard Lawyer has the law wrong. The test is whether the person can be substanitally identifiable from the show. The fact tghat she has the same accent, looks like the character and also words have been repeated which Richard Gadd himself knows are public would suggest NF didn't do their due diligence. Also, if she had a criminal offence she would not be allow to practice law (which she is). So, its clear she does not have a criminal offence. This is a clear case of defamation and libel and I think Richard Gadd has alot of problems ahead for him.

@donnamcgrath_Lawyers_Coach Thank goodness for your post. The key word of course is 'identifiable.' People keep saying that a disclaimer such as: 'this is based on a true story but some events are fictionalised for dramatic purposes' gets a media company or writer off the legal hook. It does not.

This is a 10 year old “relationship” that had been in a play by Richard Gadd a few years ago. Where was the lawsuit then. This is not new news about what went down.

Netflix has made an error, however, after every episode there is a disclaimer that essentially states - names, places and some scenes have been fictionalised etc etc. The question is, whether or not, it’s clear enough. I believe the crux of it is absolutely accurate other than Martha’s conviction.

It’s based on a true story, a purposely vague phrase to say parts of it will be fictionalized. Even if people searched the quote and found it on Twitter it would have never gotten this big if she didn’t go on a tv interview and sue over it. Lol idk about Europe, but in North America lawsuits filings are public. She self reported and is playing victim.

I think the only error Netflix made is that they should have put “based on” in front of “a true story.” However, I think the disclaimer at the end will save them from liability.

3:53 the show didn’t say it was BASED on a true story. It said it IS a true story. And that’s where the lawsuit comes in. If they’d have said “based on” or “inspired by true events”, they’d 100% have gotten away with this, but they’re claiming all of it is true.

A bunch of ppl jump on you if you say you have empathy for her. Just gonna say this: you cannot possibly be more offended than the victim himself, Richard Gadd, who literally spells out in the series he felt sorry for her. The show begins with saying he was worried she needed help, and ends with him in tears over a vm of her describing childhood neglect. If all you want is for her to face punishment, which she does deserve if she crossed legal boundaries, you’re not getting the point of the show.

I dont think she has a case for defamation and libel. Frankly even if its found to be defamatory, Richard Gadd has a good chance of defenfing himself. If he can show all the evidence of stalking, harrassment and threats then he's got a good defence of justification and fair comment. Plus the show akso portrays him as troubled and the "Martha" character was pitiful and someone who needs help and care. She should have just laid low and not given the interview. She comes out badly and Richard Gadd comes out smelling of roses 🌹

My question is how can he legally put this out in a show/series and not have her grade to this or Netflix have her agree to this a sign over the rights because legally you have to get the rights from the other person like if you write a book you can’t write a book about someone without getting them to agree. I can’t see anything has been disguised the actress has the same body shape the same accent the same job how was she protected? I’m not saying that she doesn’t have mental problems or that he wasn’t a victim but now he’s done the very thing to her that was done to him and she’s being harassed not by one person but by the public at large apparently and if he’s going to make money off this situation why wouldn’t she have that same right given it’s her life as well? Clearly there was not enough done to protect her identity.

They are incorrect. The mini series explicitly states that "this is a true story". That's significantly different than being "based" on a true story. This wording gives Netflix no wiggle room should any portion be inaccurate.

i was wondering that myself, but then, shes so out of it, i think hes instead just trying to use that to his advantage. if and when we found her, it will be his word vs hers. but her privacy was not considered, not in the least, so in that way you are correct.

4:20 I believe they didn’t put “based on a true story” or “surrounding real events “ From what I heard it was claimed to be 100% true . If that’s true that’s where Netflix will have a problem. Because if there’s even one small thing in the series isn’t true then it’s not 100% accurate and would be defamatory. That’s just what I’ve heard though I haven’t even watched it.

To be fair the ending depicts the huge amount of trauma her character faced in her early childhood. In the end it is a sad but more than real story of things that really happen. We needed this.

When MM took the newspaper to court about the paper publishing parts of her Dad's letter--the British Court basically said that even though MM wrote the letters and sent it to her Dad--the letter was her property and the newspaper had no business publishing the letter without MM's consent. On this logic and apparently British Law--do the letters, emails and texts belong to Fiona and Richard and Netflix and the internet sleuths had no business publishing them on the series or on newspapers or the internet with out her consent?

Very interesting question, I think it was that it was like a normal story, then there were unpredictable unhinged bits that shook me. When that had happened enough times I had to turn it off and watch the rest in daylight.

In the beginning of the film, "this is a true story," comes across the screen.....not "based on," or "inspired by." Any expert guest, like this lawyer, making comment should know the facts of the film....and he did not. The creators wrote...."true story," NOT, "based on."
