Dr. John Haas presents the challenges that lie ahead as we seek to restore a rule of law that protects unborn life, now that a Supreme Court ruling has pushed the decision for determining legalized abortion back to the states.
Dr. Haas reveals how a false premise led to the original ruling that resulted in abortion becoming legal up to the third month of pregnancy, for any reason. He tells how the Doe vs. Bolton case expanded the word "health" to mean anything from mental health to a widely subjective term that could allow abortion on demand through all nine months of pregnancy.
Now that some states have made abortion illegal, the new landscape sometimes makes it illegal to have a morally licit procedure done, one that has an objective to save a mother's life but results in the “Double Effect” of the unborn child being lost. Other states have chosen an arbitrary week in gestation that designates one as an abortion and declares the next week, hour, or minute is not.
By definition in the Catholic Church's teaching in the Gospel of Life and the Catholic Catechism, an abortion is "the direct and willful" act to kill the unborn child. By the time a child is in the fallopian tubes, it is past the point of conception. So what is to be the guiding principle? Dr. Haas presents a case for why the USCCB should update its definition and encourage the laws of our country to consider two patients in every case, not just one. While the mother's life is a priority, the viability of the child is another. If the rule of law recognizes both human beings as deserving of protection and dignity, the number of abortions would be vastly reduced.
