Yes it IS about experience in business. Something most wimen do not like to have. That's why God has given the responsibility to their close relative men. If THEY fail in their responsibility, they will stand before God on the day of judgement for failure in their responsibility

Actually there are cases where men witnesses are not accepted at all only woman witnesses are accepted and that is in the case of (breadfeeding from the same mother ) , so we can know from this its not a gender superiority issue , but its context related issue to make sure the truth and justice are protected.

How do we decide which verse is universal and which verse only circumstantial, especailly when it hasnt been mentioned? Because this explaination is given alot. Shouldnt it be said at least that this is applicable in this circumstance only?

We don’t decide judgments otherwise it would be subjective and this would give way to misinterpretation of the Quran and sunnah. The commentary of the Quran and sunnah already explains how we should apply these texts. The commentary is the explanation by the prophet and his companions and their understanding. We shouldn’t be taken the Quran and sunnah to decide whether it’s time specific or not. That question is already answered in the commentary a.k.a Tafsir.

People are forgetting that most narrations of haidths came from the wives of the Prophet(pbuh) mostly Aisha(RA) People relied on their narrations soley !!!! Plus if ALLAH wanted two women to equal to one man in all situations, he would have just said in all situations. He mentions business contracts for a reason !!!!!

The womens witness rule for contracts is in the Quran, its not a hadith. The problem is that in Islamic jurisprudence some literalist scholars use their principle of qiyas (analogical reasoning) to generalize the womens witness rule to other situations.

I really liked your answer, it was very informative and well put. Thank you for showing us the real Quran and Islam. However, I wanted you to elaborate more about the passages that was only revealed for specific time and situation (hence the business transaction) that we shouldn't follow it literally in our modern times. What makes you think that there are indeed passages that only about certain time? Like how do we differentiate? Does it depends on the tone and the context for example? Hope to really know because I enjoy learning more about the real Quran that isn't influenced by anyone or pre-interpreted. Thank you Dr. Shabir.

There are situations that did not occur in the time of Muhammad(pbuh) and thus were not resolved by a revelation. But it happens today and, folowing the traditional view, we are made to ask ulemas for answers. Those ulemas will use Quran then hadiths then past occurences to give us a response. It is clear that some matters were related to the time of the prophet.

I guess the answer I'd that the general rule is that majority of the Qur'an is relevant for all time although there may be some passages that may be in a certain context or maybe time relevant. We differentiate this based on individual circumstances that may arise and let the scholars of Islam do this part since they would be more knowledgeable. not any average joe can do this. This can be seen in the quran itself, but the context should be studied thoroughly though. The example of this aya in surat al-baqarah: you should know what surat al baqarah is talking about, what is its maqsid (goal it wants to lead the muslim to), and how it explains that maqsid. Following out of this, is the aya part of the maqsid or is it giving examples which illuminate what direction the maqsid goes to? As for surat al baqarah, it tells about the mistakes the previous muslims (jews and christians) made, and the maqsid of the surah is thus warning muslims of not making the same mistakes. To make clear how to understand this maqsid, Allah tells us what one should or should not believe, and how to act in our daily life on these beliefs. Then He illuminates the subject of spending money; it can be mandatory (eg zakat), rewarded and good (eg sadaqah and spending on orphans), forbidden (eg riba), hated (eg being too greedy), or just mubah; and for this last one the aya of business (ayat ad-dayn) is given in which the 2 women are given in place of 1 man). So from looking at the entire context of this surat one can extract that this verse is referring to an example, and as thus can not be generalised. Then, to make sure that we understand this aya correctly, we should do taqrir (taking all ayat and ahadith about this subject together) to form a solid, correct view. As for this subject, the shaykh already mentioned the vowing situation in which 1 woman is equal to 1 man. Ulama also agree that for women business (pregnancy and childbirth, menses and breastfeeding eg) one female women outnumbers 1 male. Her testimony is more powerful. So by looking at all this we can indeed say that the aya in surat albaqarah referringcto women's testimony is indeed ONLY a given example, which makes it changeable to times and circumstances. For this reason the linguistic scholar Abu Hayyan wrote in his tafsir on this verse that the arabic word for witness used is 'shaheed' and not 'shaahid', which means it is a superlative. It is not someone who SAW what happened, but one who UNDERSTOOD VERY WELL what happened. It was an expert in this field. So Abu Hayyan says the verse is in fact not referring to male and female, but to experts and amateuristic people. And since commerce at that thime was ruled by men, the example is used as the male expert and the female beginner. But any case in which a female is an expert and a male a layman, the court would need 2 men for 1 woman. So it's in fact just stipulating the difference between people of knowledge and people without thorough knowledge.

Oh and by the way, did you know that the khalifa Umar ibn al-Khattab (who became khalifa 2 years after the death of the prophet Muhammad) made a woman the highest official of the market trade business? So her word was the highest. The Companions themselves knew that this verse was not gender related. It's just the modern world with its concentration on gender related isues that sees it like that.

We not the same we have a different anatomy as a result women have the mensteration period which make here change physical and behavior and that is a repetetive cycle that's why u need another woman there so they comfort and help each other in case one or both going through ther period.u could check what physical and emotional changes women go through so it makes a lot of sence by

Quran is for BEST INTERPRETATION for implementing on the society. If a woman of village who has never dealt with such contract is being involved, extra precautions need to be taken.

@@ather319 In your history? LOTS? nope. No you don't. You have very FEW women scholars and they DON'T have the respect nor hold the sway that them men have, nor have they ever. Islamic tradition has never given women their share of power, education, respect, autonomy, freedom, money...and it's even worse now unless you're a muslim in a christian or secular nation, where we don't force women to live like mushrooms in the dark.

While the explanation was right, it sounded defensive. The Holy Quran states the other women is there if the first one forgets (as womens didn't generally partake in financial matters at the time). If she doesn't forget, what happens then? You only need 1 and that should suffice

Ok then why isn't verse followed by "as society progresses, eventually men and when should be equal in witness". At what year does this rule become nullified? It's a subjective thing in a book that is supposed to be objective

This only applies in BUSINESS matters IF there is no written contract between 2 people. So if a businessman and a businesswoman have a written signed contract between them, there is no need for other witnesses. Both are equal. But if 1 of them is illiterate, then he needs witnesses to the sale, in case of disputes. if there is a dispute, then 1 of the witnesses will be called. It doesn't matter if it is the woman or the man. Only if the business people don't agree to this wo/man's testimony, will the other witnesses be called. If the business people are happy with the testimony from 1 man and 1 woman then there is NO NEED for the 2nd female, whose role is to remind/correct the other female IF she makes a mistake. But if there is still a dispute then the 2nd woman's testimony will be taken into account and she could overule the man's testimony or the other womans. Her word will be final. In other much more important matters, we always rely on the testimony of 1 woman alone such as a midwife or a female judge giving rulings or female Doctors / translators / advisors etc etc or MOST IMPORTANTLY, a female hadith scholar teaching men the religion of Islam and this testimony is the greatest of all, and it is perfectly OK for a woman to teach men. It is well known that biblical law does NOT allow women as witnesses and in cases where the husband accuses his wife, she is deemed guilty until proven innocent. In the Quran, her word is equal to the man's.

first of all, it says two men witnesses for when a financial contract is signed - not if. second, nowhere in the quran it says that if the parties are happy with 1 man and woman its all good. it clearly says two muslim men, and 2 women if a man isnt available. please check your facts before trying to make quran look and seem normal :)

Question: If Mohammed was doing all the financial transactions and "heavy lifting" for his wife...how was she conducting business before they met? I mean when they married she was already a business woman and she was a bit older than he so she was doing this for a while so.... I dont understand.

Man has been asked to care for her in financial matters, it is man's responsibility according to Islamic law. But if she wants to contribute she can do so happily.

Not a satisfying answer at all. If woman were not business savvy back then, then an additional woman would not be useful because the transaction would go over both of their heads. In addition, if this was about being business savvy the Quran would have specified that the two men would have to be competent, after all, it is not necessarily true that all men knew how to handle complex transactions. Another issue is that the Quran is literally just talking about a debt for a specified term. A third grader is capable of understanding that sort of a transaction so this can't be about being business savvy, it makes far more sense if it is referring to an inherent difference in intelligence between the two sexes. This understanding is backed by the story Shabir tells of testimony of man and woman in the adultery example. Of course their promises cancel one another out because these promises regarding whether or not they cheated have nothing to do with intelligence, and presumably the loan spoken of in 2:282 does require intelligence which explains the difference in number of witnesses. The fact that it also says that so one can remind the other suggests that a single woman may understand the transaction successfully but due to a memory deficiency she may fail to recall it correctly. This verse is unjustifiable.

Even today, there are cases where some female witnesses are intimidated or afraid to be assertive during cross-examination (usually in harassment, assault or domestic violence cases but even in some other cases, etc.) and don't make great witnesses but can improve once they have victim advocates there for their support. I've tried assault cases with male and female victims. The male victims generally made better witnesses bc they are firm, unafraid of giving their testimony. The female witnesses sometimes would change their mind about testifying last minute or worried what others would think of them, etc.

Ally is using the contextualist approach to interpreting the Quran, which in my opinion is the correct approach, and he provides a reasonable and logical answer. But in Islamic jurisprudence some literalist scholars will use qiyas (analogical reasoning ) to generalize the womens witness rule to other situations. If Ally tried to promote his contextual opinion in Pakistan he would probably be run out of the country with threats to his life on grounds of apostasy (as scholar Fazlur Rahman Malik was.) Scholars should issue fatwas to repudiate the following hadith, which appears to be general: Narrated Abu Sa`id Al-Khudri: The Prophet (ﷺ) said, "Isn't the witness of a woman equal to half of that of a man?" The women said, "Yes." He said, "This is because of the deficiency of a woman's mind." Sahih al-Bukhari 2658

Except that the Hadith needs to be non-genuine in order for that to happen. Sahih Bukhari is considered the most genuine collection of hadith.

It needs a lot of time to understand such scholarly knowledge. Just mastering the Arabic language can take you 20 years long. Can't imagine being certified to give legal rulings in Islam.

@@mabrookalayk8277 The womens witness rule in the Quran 2:282 is pretty clear, and it clearly conflicts with the modern approach to gender equality. You do not need to hide behind "scholarship" and "certification". The only reasonable explanation for it is that it was historical and no longer applicable. On "scholarship" - there have been a host of silly fatwas issued over the years by scholars.

I think that it's genuinely not a problem now. Women are just as educated as men, and we shouldn't mix religion with government to the extent of providing benefits to some at the severe expense of others when they are both qualified and skilled. Now we need to abandon old systems, both theocracy and democracy. Monarchies work in the Islamic world, but a heavy, forward thinking councilor form of government, taking the best parts of the American one, namely it's three branches of government are an example of how power can be divided many times, not just 3, something I call "the corridors of power". There could be room for an "In God we trust" sort of theme like the American one, but only if God wants us free, which I firmly believe. We could allow people of all faiths to live and thrive, we could live by the shariah, both Qur'anists and traditionalists, but make it entirely personalized and not political outside Muslim values.

Very logical answer but the problem still remains. Quran doesn't mention after everyone of these "out of date" verses that it will remain relevant to all times. It's a slippery slope where this way, we are picking and choosing and the book becomes confusing. A simple saying included after the Quran verses as such would go a long way: During the current times, 2 women are considered to 1 men due to inequality of power. But with changing time due women empowerment, they will not require another person to aid them under serious questioning since they are considered equal to the opposite sex. Muslim world at the most extreme locations, uses the literal statements/verses like these in their benefit to advantage to justify their extreme views. This is 1 of the "few" difficult verses which scholars try not to answer. If I am god, I would write simple statement rules in a bullet points to follow and talk about the prophets that came. I think religious book complicate following the religion in general. Anyway, it's the best answer ever responded by a Islamic scholar which is why he's my favorite scholar to listen to. We know this verse is time-sensitive because there are two other verses in the Quran which deal with witnesses, both are gender neutral. If it was something wrong with a woman they would not be neutral.

With due respect, first time I am not satisfied with your explanation. Forgetfulness during and after pregnancy is a common phenomena known as "Preg Head" or "Baby Brain". That is the reason Allah clearly mentioned " If one woman forgets, other will remind". And being pregnant multiple time was a common phenomena on that time. Its even scientifically proved. Henry and Peter Rendell, a memory researcher at the Australian Catholic University in Melbourne, reached their conclusion after examining the memory performance of 412 pregnant women, 272 mothers and 386 non-pregnant females. Pregnant women experienced the worst problems in memory tasks which were more challenging, the authors said in the report published in the Journal of Clinical and Experimental Neuropsychology.

Mariz first of all let me thank you for the wonderful piece of information you shared with us on the issue. I think we need more research on the pregnancy related memory deficiency to reach a solid level, and once that is done a literary and permanent understanding of the related Quranic passage would hold true. On the other hand Dr. Shabir did a good job to enlighten the issue particularly in the light of marital conflict situation in which testimony of both parties is treated as equal. Thanks again for the information and if you have further knowledge on the issue I would be more than grateful to have it.

What a great answer. Best I heard so far, makes soooooo much more sense. Plus I'm sure it would be pretty frightening to have to be a witness as a woman at that time or even any time except for our modern day women lol so that second woman to support and maybe even remind her of something she might have left off that could be a damaging detail related to the case. Just my opinion not saying this is fact.

How anyone can say some of Allah's orders are not valid today. As Muslims, we don't have to seem cuter than we were to the western or modernized people. if anyone says Allah is the only and exact resource of the truth, beauty, and justice then there is already no problem... Allah is above the time, and space Qur'an is valid and necessary at all times. If you are curious about the hikmah of this ayah you may consider women's biology, special days, being pregnant. Being equals doesn't mean justice though.

You claim this book to be timeless and perfect, yet as you've just demonstrated through this particular verse, it is not timeless (rather time-specific as you stated) and far from perfect. Restricted to business transactions is still discriminatory to women, be it now or in the past. As a leader you should acknowledge these flaws and strive to improve them, rather than defend them and stagnate into irrelevancy.

nabz the Quran is not time specific, but rather conditionally specific for certain circumstances. It just happen to be the case that back then women weren’t as savvy in this matters like today. Although this verse would still apply regardless for example in regions around the world that still lack a lot of education. Similarly goes for the war verses, they would still apply only under the same circumstances they initially were applied for. The conditions must be met to make any judgement and proceed in actions.

It’s to do with loan contracts, business. The women at the time of the prophet (S.A.W) were educated and literate but not all of them, there were plenty of cases where women wouldn’t be literate and would be educated on the matter because not all places put emphasis on educating women. If one of these uneducated women wanted to create a loan contract, a second woman that was educated would be there.

Some rules r applied based on the circumstances at the time and some rules r always applied regardless of the era we live in like Praying. Quran teaches us to how to deal with things under certain circumstances and conditions to reach certain goals. we have to be dynamic in the way we think as social rules and conditions change in order to reach the same goal that God wants us to reach.

David - a real life situation will be as follows; This only applies in BUSINESS matters IF there is no written contract between 2 people. So if a businessman and a businesswoman have a written signed contract between them, there is no need for other witnesses. Both are equal. But if 1 of them is illiterate, then he needs witnesses to the sale, in case of disputes. if there is a dispute, then 1 of the witnesses will be called. It doesn't matter if it is the woman or the man. Only if the business people don't agree to this wo/man's testimony, will the other witnesses be called. If the business people are happy with the testimony from 1 man and 1 woman then there is NO NEED for the 2nd female, whose role is to remind/correct the other female IF she makes a mistake. But if there is still a dispute then the 2nd woman's testimony will be taken into account and she could overule the man's testimony or the other womans. Her word will be final. In other much more important matters, we always rely on the testimony of 1 woman alone such as a midwife or a female judge giving rulings or female Doctors / translators / advisors etc etc or MOST IMPORTANTLY, a female hadith scholar teaching men the religion of Islam and this testimony is the greatest of all, and it is perfectly OK for a woman to teach men. It is well known that biblical law does NOT allow women as witnesses and in cases where the husband accuses his wife, she is deemed guilty until proven innocent. In the Quran, her word is equal to the man's.

I think that it’s because the way God has created women. Because the nature of women is become mother some day and overall women have to take care of many things in the same time, like take care of the baby and be wearing about maybe food in oven and doing something else in the the same time. This nature of women takes away some of full concentration from only one thing so she has her mind in every where in same time. But mans doesn’t have so much duty so God has created them to concentrate of one thing at the time for example hunting animals or other things so while mens have concentrated only in one thing they also remember that thing much better. They have tested women and mens, they gave both groups 4 simple thing to do at the same time, all women did all of them in time but the best men did only 2 in time.

(Qur'an 2:282, Dawood) Why is it that the testimony of a woman is only worth half that of a man? Muhammad explains in the following hadith. This can be answered by common observations. Anyone wont disagree that women are more compassionate, agreeable than men. This is due to biological differences. Women brings out emotions and the past and all the irrelevant things for a particular situation. Men just sticks to the point. Women have more interest on people and men have more interest in things.
