A legal analysis of Frank Castle's trial from season 2 episode 7 and 8 of Marvel’s Daredevil. As Vulture eloquently put it: “In the Marvel Cinematic Universe, the “trial of the century” does not concern O.J. Simpson, but Frank Castle. It’s finally time for the Punisher to stand trial, and thanks to just about every imaginable thing going wrong, Nelson and Murdock must defend him against District Attorney Reyes, who has a stacked deck and enough clout to steamroll our favorite tiny firm with ease.”
The trial starts with jury voir dire. For inexplicable reasons the judge is mad at counsel for their inability to find an unbiased jury. Things go off the rails from there. At lot of good procedure, but right off the bat, the judge should have declared a mistrial. Still, fun to talk about reserving opening statements, federal rules of evidence, and expert cross examinations.

I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. I love watching legal movies and courtroom dramas. It's one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are ridiculous.
Today I'm taking a break from representing clients and teaching law students how to kick ass in law school to take on lawyers in the movies and on TV. While all legal movies and shows take dramatic license to make things more interesting (nobody wants to see hundreds of hours of brief writing), many of them have a grain of truth.

For context's sake: Foggy isn't an experienced lawyer, that's why he was so nervous and thought that woman was good. Foggy has a bit of an impostor syndrome when Matt isn't around, which he overcomes later

@@peronafanman Imposter Syndrome is when a person thinks themselves to be unskilled or fraudulent, despite evidence to the contrary that they are in fact very capable. For example, in _Harry Potter and the Order of the Phoenix,_ Hogwarts' students are amazed by Harry's successes against Voldemort, but Harry writes them off as the result of luck or his friends helping him.

I surprised that none of the lawyers I've seen react to Daredevil ever mention the fact that the SECRETARY (Karen) is far too involved in the court proceedings. This would breach so many ethical codes, even for small law firms.

That's exactly what I was thinking the whole time I watched it. Like... I get why they have her in there show-wise(because it shows how important she is to the plot or whatever) but like, she really had no reason for being there.

In Matt's defense - the Frank Castle trial was one of Matt's worst moments as a lawyer in the show on purpose, so I think it's a little unfair for this to be the test of his Lawyering.

It's not about him being behind on events. It's about his physical presence looking better to the court. It looks bad if the lead lawyer is late. It's like playing a baseball game with no pitcher or playing football with no quarterback.

God I miss Daredevil, it may not be the most accurate lawyer wise, but it was such a great show. I’m rewatching it right now and I LOVED the whole Frank Castle prequel and season 3 is so damn dark and good. I wish it wasn’t cancelled, S3 got rave reviews.

The show is great and I adore watching it...up until Elektra's on screen. I know she and The Hand are what Daredevil's meant to be all about, but I really liked everything else. It's mostly just Elektra. I don't hate The Hand, I just don't like her.

Hostile witness means that your witness has an adverse interest to you and its shown while theyre on the stand. Instead of cooperating with you, they speak and act otherwise. That is why they are hostile.

"If trial is tomorrow, you need to talk to your client beforehand." If I recall correctly, they only had like two days between Castle taking them on as his lawyers and the trial happening, he wouldn't talk to anybody but Karen, and Matt was constantly being dragged away by Elektra. Not saying it's an excuse, but, it wasn't particularly easy for them to communicate either.

I don't think there even is a need for a motion to delay. A trial wouldn't happen that fast in the first place. 3 days from the moment the defendant first meets his lawyer to a trial for 30 counts of murder? That's insane.

And in Matt's defense as a lawyer, this scene is from the 2nd season, which is basically about Matt's personal life and vigilante life falling apart and him not being able to balance the two. That's why he was late and a bad lawyer, he's usually brilliant in normal circumstances (not talking about the realist lawyer stuff, just his professionalism).

He did not name any participants aside from himself and Castle. He also did not name the organization or group of combatants they were fighting

He did give a location and details of the conflict. "Close-target reconnaissance in the vicinity of the Hindu Kush." The close-target recon details are arguable. But the location - especially if the US isn't officially engaged in any conflicts there - would _certainly not_ be a matter of public record.

@@comradepoolio7414 I'm not sure Matt had much of a legal defense outside of insanity and jury nullification once the Medical Examiner was cut out of the case and Frank flipped out and admitted, on the stand, to being an unrepentant mass murderer. There was not a lot to work with. Sure Matt was kind of half-assing everything non-Daredevil, but it's not like he had much to go with anyway.

You should watch the whole series. The reason they haven't spoken to Frank Castle is because the case was essentially rigged, insanely fast tracked, the DA was trying to take down Castle for political points. Honestly it may have led to a conviction but should also leave the door open for a mistrial or at least an appeal.

The writers used a courtroom setting to talk about the morality surrounding Frank Castle's character. It's good for writing but it makes it difficult to make a really accurate trial

I hate that writers think portraying an accurate trial scene is too smart for the plebs. It subverts expectations for real jurors. Lawyers in real life HATE these CSI and Lawyer shows because they advance unrealistic expectations for a jury. If it's written well, proper court room decorum and rules can still be engaging.

Pretty sure collateral damage on the scale it happens in those movies goes a bit beyond what good samaritan laws would cover. Definitely would be interesting as a topic to address, both in the light of the time (before those laws) and modern law (with good samaritan laws helping). Pretty sure the "resucing attempted suicide" one wouldn't have much of a case though. Unless they're somewhere euthanasia is legal *AND* the enactment of that right to suicide was being conducted properly, neither of which seems like it was applicable to the situation in question.

"there can't possibly be any classified information left"? There absolutely can. He refuses to disclose the objective of the mission, the exact numbers or location, or even the precise date. Telling a lawyer that they had a mission in a general area and faced an unexpected threat is hardly disclosing confidential information. It's similar to the difference between firing an employee because someone saw them doing something they shouldn't have been doing, and saying they're fired because Karen saw them smoking crack behind the dumpster out back. The (dare)devil is in the details.

I hope you take the time to watch the whole show because I'd love to hear your thoughts on more of it. But yeah, Foggy even yells at Matt later for "going on a speech about vigilantism" instead of getting Castle to share his story. Although what Foggy didn't know was Castle was determined to be found guilty so he could investigate his family's murder in prison.

Just adding some information to help: -> Matt later suggests that insanity plea is unlikely to succeed (0.12%) -> The DA pulled any strings she could to make Castle’s trial ASAP,, giving the Matt/Foggy no time to prep. I’d imagine that it probably wouldn’t happen this way though. -> The DA is desperate and trying to bury their case doing anything she can, bc of the nature of her failure involving Frank Castle.

@@gromm93 When acting as a costumed vigilante, at all, is illegal, doing so is considered unprofessional and can get you disbarred irrespective of whether such restrictions are really justifiable and regardless of any and all good you actually do. Just maintaining a secret ID typically involves dishonesty and/or misrepresentation. There are not many individuals in the history of humanity generally let alone among lawyers past and present who have never told any level of lie, ever. He did eventually win a case in the Supreme Court, though, that established the right of such vigilantes to testify anonymously, which could be seen as legitimizing vigilante activity more generally.

Wearing a suit to court? I was in traffic court one time. And then, in a case before mine, I saw a defendant brought out in an orange jumpsuit and chained handcuffs. While it makes the defendant look good to be wearing a suit, I don't think the defendant always has the option to get a suit to wear.

When there is no Jury to bias... like if it's just the Judge, the Lawyers and the Defendant... then they would probably keep the Defendant in the Orange Jumpsuit and handcuffs... but once they are before a Jury, it would be prejudicial to keep the defendant dressed in the Orange Prison Jumpsuit and most of the time they are not handcuffed unless there is a really compelling reason to keep them handcuffed, such as being violent (for example, maybe the defendant tried to attack the DA or someone in the courthouse or maybe they attempted to escape so they choose to put those handcuffs that are attached to the waist belt with the leg shackles attached as well)

if you watch the show you’d know that they actually talked to castle.. a lot.. including an interaction where foggy tells him specifically to plead guilty, frank agrees, and then yells not guilty in front of the judge, which is why they need him to be on board

It's just not as good as the 1st or 3rd seasons, but you still have to give it credit cause those are some really high bars lol, especially the third season. I thought everything involving the punisher was good, and the parts with elektra were alright. The only thing that wasn't up to par was the whole storyline with the hand

Not going to lie, as a diehard Daredevil fan I'm a little afraid of what the outcome for Matt's lawyering skills is going to be. Especially if only using the Castle case as an example because it's a massive clusterf*ck scenario. There's a scene in The Defenders which I love with Matt tearing a chemical company to bits, I've always wondered how realistic that was.

Same, this scene wasn't really a fair examination of Matt's abilities seeing as how by this time Castle has taken a deal from Fisk in Prison to sabotage his own case, plus the DA is corrupt and complicit in the murder of Castle's family (if I'm remembering that right). So whether or not Matt is a good lawyer shouldn't be decided by this one case.

The idea is he fights criminals and then puts them to just punishment as a lawyer too, expressing the law is necessary but imperfect so he'll do everything it can't without being immoral.

I think that illustrates one of the details of the Sokovia Accords that isn't explained in the movie. What constitutes a superpower? How much faster must I run in order to be considered a human with super speed? Where is the line that propels one to be considered to have super strength? Do any of the characters in Mystery Men count as having a super power? This would be a fun thing to bring up for sure.

Objection: I think this is intentionally kept vague. Marvel has been extremely coy about whether these Netflix show actually exist in the same continuity as the MCU feature films. There's a lot of evidence that Dare Devil, Jessica Jones & Luke Cage exist together in a similar but separate parallel universe. And while Matt Murdock has mostly stayed under the radar, Jessica Jonse and Luke cage would definitely be subject to the Accords, except nobody has mentioned them, ever. Also you should do a review of The Exorcism of Emily Rose - it's based on a real life trial after an attempted exorcism lead to a women's death.

Objection: In Foggy’s opening argument, he is stating Castle is a victim of PTSD as a former soldier. You say that opens them up to character assassination. But, Frank Castle has always been characterized as an exceptional Marine. Therefore, any testimony from his colleagues/superiors during his time in service should only be beneficial to his character.

The point is that the DEFENSE bringing in character evidence opens the door for the PROSECUTION to bring in character evidence - which _would_ be wildly detrimental. The defense can't just go around saying, "Our guy is so great!" and then not give the prosecution the opportunity to rebut that assertion. It was a huge point of contention in the Alex Murdaugh trial.

Yeah.. this wasn’t the best Daredevil courtroom scene to cover. John Healy or the chemical company case at the beginning of The Defenders would be a better show of Matt as Matt Murdock, season 2 was much more about him as Daredevil.

I agree, this was arguably Matt at his worst professionally. I mean he missed a large part of the trial and left his partner to completely improvise his statement because he was off dealing with Elektra and the hand.

This case was also failed because the kingpin basically owns the police and a police officer said for him to plead guilty to kill someone for Wilson Fisk. So no matter what he would have failed.

I used to work as a housekeeper at this insurance company with a bunch of tiny cubicles. There was this one cubicle with a shit ton of daredevil merch; posters, bobble heads, mouse bad, etc. Literally everything was daredevil. That guy was the biggest fan!

The lawyer asked that he could be excused while the members were in session to talk to a "client" as the court had ordered him to meet with the client prior to 5 PM that day. You would only plea "guilty" or "not guilty". The arguments and legal precedent of why the defendant would be "not guilty" is then argued within the case itself. This is part of why our actual lawyer here brings up the ability to withhold the defence's opening statement. By going after the insanity defense, you are *admitting* that the charges are valid and that your client did indeed commit the acts in question. You would never want to go into the trial itself basically providing the prosecution's case for them instead of forcing them to prove beyond a reasonable doubt first.

In an earlier episode at Frank’s hearing (when he was still strapped to his hospital bed nonetheless) he was initially going to plead guilty. But during the hearing, he switched up on his council and pleaded not guilty. They didn’t even have time to give a reason even if they wanted to

A few things, They had spoken to Frank before they talked about the PTSD defence. Although I don't know how this would affect making their decision before speaking to him again. The trial was pushed forward to happen with 1 week to prepare instead of 1 month. This would have been interesting to hear about. The Judge states they have looked at 400 jurors to find a viable jury. This would have been interesting to hear about.

I wish you had actually watched the show instead of just the trial itself, because a lot of the issues you point out and questions you asked have would all be resolved and answered. While all the things you said are clearly correct, they are kinda the point of the trial in the show. Matt showing up late and becoming unreliable because of his vigilante-ing is a major point of conflict between him and his team. This tension, and the loss of this case actually causes them to shut down their law firm, and nearly totally destroys their longterm friendship. Their longshot defense strategies are only because Frank is pretty much indefensible. The only reason they took the case in the first place is because irregularities, or rather flat out lies, in the witness reports of Karen Page, when she talked with the court appointed public defender. Leading them to believe some foul play/tampering had taken place to ensure a conviction. They also learned that the DA wanted to extradite Castle to Delaware, where he could be given the death penalty. Come to find out the DA was planning on using this case as a springboard for her own agenda, and she didn't care about actual justice. Them putting Castle on the stand, they knew was a terrible idea, but they concluded they didn't really have a choice after the medical examiner's testimony was thrown out. And that decision led directly to them losing the case in dramatic fashion. You pointed out that they hadn't even spoken with Frank before the trial. This is for 2 reasons. First, they took on the case 2 days before the trial, to attempt to help Frank because of the suspected tampering. And second, Frank refused to speak with Matt and Foggy, he would only speak to Karen, because he learned she broke into his home in her own personal, illegal investigation, a place where he hadn't even been since his family died. So they technically had communicated with Frank, just not directly, basically using Karen as a middle man.

The context doesn't matter. He gives a grade for legal realism. It's not on how invested you are with the characters and story and their reasons and circumstances. It's purely on the trial in isolation and how realistic it is in the opinion of an actual lawyer.

@@aoikemono6414 that is all well and good for critiquing things like the DAs and Foggy's opening statements. But in terms of a lot of other things that he went over, the context absolutely does matter. Why Matt is unreliable, and the reality of it breaking up their firm. Why they try long shot defense strategies. Why they are so unprepared in terms of client relationship. To say context and circumstances don't matter is just ridiculous. A lot of his main critiques were exactly the point of the trial in the show. They weren't meant to be great, solid, well designed defense strategies. And they certainly weren't, so they failed dramatically because of it. I am absolutely sure, apart from the dramatic and relatively useless opening statements, there have been trials affected by similarly crazy circumstances leading to bad strategies and long shots. Ultimately leading to their failure. To say the trial isn't realistic while totally ignoring context makes absolutely no sense.

@@_KingRaz Tl;dr: "Lawyer Reacts" videos are implicitly supposed to show how well-written a court scene is, but in this case much of what's criticised about the scene is deliberately written that way in service to the overarching plotline. Therefore, it shouldn't be criticised in the same way as scenes written this way because of pure sloppiness or writers not understanding how trials work.

You must know that this is an older timeline . I noticed that when I saw Matt using an antique a$$ phone . I mean, not that a phone with just screen would be good for blind people but you get the point . I think that In this marvel phase the laws and ways to go to trial were a little different. Usually marvel does their homework and makes the movies or in this case series as close to reality as possible just with, well … superhero’s and aliens .

I just looked it up, but as far as I can tell we don't see the trial. The film just jumps straight from Stanley being advised to tell the truth to Stanley being sentenced.

Been years but read the book multiple times and watched the movie I think twice. I remember it all as flashbacks throughout the story where you learn a little more each time. But I may be mixing the book and movie together or just misremembering. Anyways I don’t think there was a full courtroom scene in either

3:00 "Problem 1: the defendant understood the wrongfulness of his actions." -- you could make a *serious* argument that Frank Castle legitimately did not consider what he was doing to be wrong, particularly given the way he approaches the topic of justice vs. mercy and vigilantism while speaking with a chained-up Daredevil on the roof of an apartment building. His lines about "the stink of the city" and the fury behind his delivery make me think he honestly considered killing these criminals to be the right thing to do. Even under the Model Penal Code instead of the M'Naghten Rule, the second qualifier for the insanity plea (that the defendant lacked substantial capacity to know that his conduct was wrong), a strong case could still be made.

About 15 years ago I had a court case involving 1 DUI, and some traffic stuff (rolling stop, speeding). I was 22-23 and my parents still had to pay for my lawyer. The thing is, my lawyer refused to talk to me. Never returned my calls, would only talk to my parents. Then I got the book thrown at me and damn near got the max. (Good ol boy system is strong here, even stronger then). I know its too late now but did I have any recourse against my lawyer? or the case in general? Side note, I just got done paying a lawyer to expunge that crap (only stuff on my record) and it just so happens she was the district attorney who put me in this position in the first place. Really wish I had done something.

Objection! While it may seem the General is disclosing plenty of classified information, he has actually withheld any pertinent details that could compromise national security, such as the precise location of the mission (the Hindu Kush is a very big place), the date and time the mission took place, the target they were sent to observe (or if you've seen The Punisher season 1, you know know they were really sent to kill), and the unit Castle was serving with. Without such details, it would be impossible to distinguish this mission of hundreds if not thousands of others that could have occurred in the region in the past five years alone.

The marvel Netflix shows is a prime example of how important characters like Foggy are, and how much the actor crushed that role. Really liked Luke Cage & Punisher, but Daredevil felt more like a “complete story”, the main characters/extreme decision makers, can be their crazy selves or go harder with the “regular guy” next to them, and show how far they’ve gone over the edge & not just have “good guys & bad guys”.
