Registration of a New Political Party in India | एक नई राजनीतिक पार्टी कैसे बनाएँ?
Step-by-Step Procedure to register a New Political Party with the Election Commission of India-
1. Name of the Political Party must not contain any Religious or Caste based name.
2. List of Members = At least 100 members who are Indian Citizens holding Voter ID Cards.
3. Submit an application to the ECI within a period of 30 days following the date of its formation with the following documents
3.1. Constitution/ Bye-Laws, Rules & Regulations of the Party
3.2. 125 Notarized Affidavits -
a. Present/ General Secretary
b. All Office-Bearers - i. Criminal Records and ii. PANs, ITRs/ Assets & Liabilities.
c. 100 Members - They are not part of any other Political Party
d. No-Objection Certificate (NOC) from the Landlord of the Premises where the Registered Office has been declared alongwith Proof, e.g. House Tax Receipt or Sale Deed;
e. NOC from Local Body/ Municipal Corporation that there is no prohibition of setting-up the office in that premises.
3.3. INR 10,000/- Application Fee by Demand Draft payable at New Delhi favouring - ‘Under Secretary, Election Commission of India’.
3.4. Publish proposed Name of the party in 2 national daily newspapers and 2 local daily newspapers, on 2 days for submitting objections, if any, with regard to the proposed registration of the party before the Commission within 30 days from such publication.
3.5. Email Address and Mobile Number for regular tracking.
Specific Clauses:-
1. As per Section 29(5) read with 29(7) The Constitution must contain a Clause that-
The Proposed Political Party shall bear true faith and allegiance to the Constitution of India as by law established, and to the principles of Socialism, Secularism and democracy and would uphold the Sovereignty, unity, and integrity of India.
2. Internal Democracy in the Party
3. There should be any discrimination in the matter of membership.
4. The Party will not promote or instigate or Participate in Violence in any manner.
5. Any amendment to the Party Constitution must be approved by the General Body of the Party.
6. The Party must declare in its Constitution that is must contest an election conducted by ECI within 5 years of its registration.
Taxation of Political Parties
Income is Tax Exempt as per Section-13A of the Income Tax Act, 1961 but subject to following conditions-
1. Keeps and maintains such books of account and other documents;
2. Each voluntary contribution exceeding Rs. 20,000/- party keeps and maintains a record of such contribution and the name and address of the person who has made such contribution;
3. accounts of such political party by a CAG Empaneled Firm
4. No donation exceeding Rs. 2,000/- is received by Cash
5. Filing of ITR on time and filing of Annual Report with the Election Commission of India is mandatory for claiming this exemption.
