SCLS attorney and housing law unit head, Mark Fessler, talks about the rights and obligations of tenants and landlords under the South Carolina law. These rights often originate in the rental agreement. He discusses the rights of landlords and tenants in regards to:

If a landlord is not allowing entry to unit for 18 days after the first of the month to start your lease, can they legally charge your a full months rent? Can they also charge a move out fee when they have already charged you a security deposit? I have an unsigned lease that states these items and was not disclosed when signing the pre-lease agreement.

We let some homeless tenants move in eight nites before there lease started. They moved in and have not paid the deposit the deposit or first months rent. We are taking them to court and they are complaining about numerous things is the matter. Nothing was the matter when they first moved in.

Can a landlord go up on the rent due to Covid Claim??

The lease governs what landlord can charge for rent. If the lease is month to month, the landlord must give thirty days’ notice of the rent increase. If the lease is longer than one month, the landlord can increase the rent at the end of the agreed upon lease term. COVID has not changed these basic rules in South Carolina.
