The first thing that All truck drivers learn is to never ever put your Truck into Neutral on a mountain …. This is the same as stopping on railroad tracks or shifting while crossing railroad tracks …. I do blame the owners of the company more than him , because they knew he didn’t have enough experience and because they were able to convince him of lying on the Pree-Trip Inspection form … FMCSA requires that you inspect and approve the truck and you are not required to drive the truck until the repairs are done … Only a guy with no experience would drive with Bad brakes
@jamesbroomfield7799
@jamesbroomfield7799 2 жыл бұрын
You couldn't have said it better. They took advantage of this guy. Their negligence for profit put this guy in the cross. They probably knew he'd be responsible for anything after signing that inspection form. But as an employee trying to keep a job, he's gonna do anything his boss tells him to do. I'm shocked that his company is not ar fault. He's obviously a scapegoat for a big corporation. I truly believe race played a role and typical DAs being the pos they are. Because imo, they probably bet the farm that he was under the influence. So they arrested him thinking it was a lock. But once they found out he was sober, they didn't want to go back and say they made a mistake and this was just a terrible accident that wasn't his fault. Nope. They just keep it going and make everything fit their narrative. They basically punish him for not having the experience to react like a navy seal would. He panicked. Human nature makes ppl not believe its actually happening to them. It takes a while for you to accept the fact that this is bad and now you gotta go to plan B. He probably thought he could eventually get it under control once he got around the corner. But that's where inexperience comes into play again. It's just so painfully obvious that the company is the one at fault

It's not so much that he couldn't read English. It's has alot to do with training. It seems that he shifted out of gear as soon as he went downhill. Once you shift out of gear going downhill, you can't shift back in. So now that his Jake brake won't work, he used his actual brakes and depending on the weight of his load, it was too much. He could've been afraid to of taken the runaway ramp, or maybe he thought he still had a chance to put into gear, who knows.. I can tell you that being a driver myself, I would take my own life before I take someone else's.

the sentence is absurd... he didnt intentionally set out to kill those people his brakes failed... I blame his job for not providing a good enough truck or maintenance care of the truck and the lack of on the job training. Also, his inexperience in driving on the mountains added to his bad judgement... I think he had a human response he panicked and the flight fight or freeze response set in I think he froze... he didnt know what to do ... I have been on 1-70 I live in CO and some of the runaway ramps are clear as day and there are big yellow signs with flashes warning truckers and alerting of the ramps coming up... I know one of the ramps is hidden it indicates where to go but it veers off and it looks like its heading towards an unmarked area maybe he was scared because he couldn't see a clear stop and thought.. what if this takes me further down hill or what if I have to make a sudden stop and I end up going off cliff or something... he had bad judgement but he was only 23 at 23 I WOULDNT HAVE KNOWN WHAT TO DO IN THAT SITUATION SCARY SHIT!!!! WELL.. I PROB WOULD HAVE TAKEN THE RAMPS BUT I USUALLY ENTER FIGHT MODE WHEN IM IN AN ADRENALINE SITUATION.. HE IS HUMAN... WE ARE ALL HUMAN... HE HAD A HUMAN RESPONSE... I THINK A BETTER SENTENCE WOULD BE TO HAVE HIS LICENSE REVOKED TAKE CLASSES NEVER BE ABLE TO DRIVE A TRUCK AGAIN.. AT THIS POINT HE HAD DONE JAIL TIME... 3 YEARS WORTH I THINK... BUT I WOULD HAVE CONSIDERED THE VICTIM STATEMENTS ... THE JUDGE'S HANDS WERE TIED BECAUSE OF THE CRAP LEGAL STATURES... RAPISTS/MURDERERS GET LESS TIEM THAN HE DID...I hope he will find his freedom when he appeals bc he is 26 now imagine spending your whole life in prison like Chris watts for your brakes failing... I blame his job training, his job, and his bad judgement, but did he SET OUT TO KILL THOSE PEOPLE WAS IT PREMEDITATED?? NOT AT ALL... THIS COULD HAVE HAPPENED TO ANYONE:(... CO HAS A LOT OF COVERT RACISM... BUT IT SEEMS LIKE THE JUDGE HAD TO GO OFF THE LEGAL STATURES WHICH IS OBSURD NOW TRUCKERS ARE GOING TO PROTEST AND NOT COME HERE WHICH WILL WORSEN THE SHORTAGES WE ARE ALREADY HAVING HERE... Semi trucks don't have emergency brakes. You either have brakes or you don't and the only way you won't is if you heat them up to the point that they no longer work!
@shortthrow50
@shortthrow50 2 жыл бұрын
They actually do. The parking brakes are spring brakes and also emergency brakes. They apply automatically if the truck were to lose air pressure going the road. It’s part of your pretrip for cdl test to pump down your air with brake pedal to see if the knob pops out and applies the spring brakes. You are right about one thing, if they are already over heated, it won’t stop the truck

License certificates are for sale at the right school. We have allowed schools to open up that are privately run and some of them sell license certifications. It's just like when I see a driver fueling his truck and he is so fat it takes ten minutes for him to get out of the seat. His ankles black from diabetes and yet some dr. somewhere passed him for his health certificate. Everything is for sale.

This is the problem with our country. We are giving people licenses that cannot read or write English. As a truck driver YOU are in command of your ship. You need to know how to use alternatives and not hold your brakes going down a hill or mountain. Personally, i use my engine brake more than my regular brakes. There is also a BIG BIG BIG rule of thumb. NEVER EVER GO DOWN THE MOUNTAIN FASTER THAN THE SPEED AS YOU WENT UP THE MOUNTAIN. IF YOU GO UP THE MOUNTAIN AT 25MPH YOU NEED TO CONTINUE THE SAME EXACT SPEED GOING DOWN THE MOUNTAIN UNLESS POSTED DIFFERENTLY. The company cannot force you to do anything! the company can be blamed yes, however. If you feel uncomfortable on the route you are going. YOU HAVE THE CHOICE TO SAY NO! There are many laws that protect truck drivers from companies firing you. YOUR MAIN JOB IS TO BE SAFE! There is no excuse this guy can provide that makes the situation better. You chose the route, you chose to hold your brakes. Your brakes did not have any "Malfunction", You burned them up. Ive seen many drivers burn their brakes going down the smallest hill. He cannot read a sign and no we do not need bilingual road signs. STOP LETTING PEOPLE GET A LICENSE IN ANOTHER LANGUAGE OTHER THAN ENGLISH! Our government needs to be held accountable for this too. Absolutely ridiculous. He had many opportunities to try to stop. Many guardrails, many runaway ramps. NO EXCUSE FOR ALL PARTIES! Driver, Company and government.

@@yenny2037 He's purposely ran into stopped traffic. Purposely. He didn't wake up wanting to kill but by chosing to not avoid the collision he knowingly killed 4 innocent people. So in that sense he is most definitely a killer. Backing into someone is an accident this was not. He chose to drive into stopped traffic how could that possibly not cause death and destruction. I don't think you did watch the trial other wise you would have known this. This was not murder but it was HOMICIDE. I highly encourage you to learn definitions. Homicide and murder would be a good start. Surprisingly not a lot of people know the true definitions.

What!!!??? This is not negligence of the truck driver. It’s a mechanical malfunction!!! If anything, the manufacturer, the truck co., and/or maintenance company is responsible. The brakes failed! It could have happened to any driver. In TX, a rich teen got NO JAIL time for killing 4 people while having fun on a DWI, he received 6 mo. probation-it’s called the affluenza case. This hard working man gets 110 yrs. for something that wasn’t his fault??? Bloody system!

Oh hell no..... he definitely dont know English....yep ... doing 110 ... and ...its in rules to know, write, speak and communicate in English... his company should be shut down. Rule of law means all, the White boys, Black men and Mexicans are the same and should be held accountable. There definitely shouldn't be bilingual anything because the sign this duffer ignored were in English... if you training them bilingual, out here the signs are in English.... who make these rules and why they not enforced; unserious juvenile drivers like him take lives and that's the whole point with 110 years. Bye Duffer 🤣
