'Rust' Special Prosecutor Resigns Over Public Hearing in Alec Baldwin Trial

During the cross-examination of prosecutor Kari Morrissey, defense attorney Alex Spiro revealed that special prosecutor Erlinda Johnson resigned from the Alec Baldwin case on Friday. Prosecutor Morrissey testified that prosecutor Johnson resigned because she did not agree with today's hearing about dismissing Baldwin's case being public. The defense also talked about another prosecutor who left the case.

Famed actor and movie producer Alec Baldwin was indicted on one count of involuntary manslaughter in January for the death of 42-year-old cinematographer Halyna Hutchins. Hutchins died on Baldwin’s “Rust” movie set. Armorer Hannah Gutierrez-Reed was found guilty of involuntary manslaughter for Hutchins’ death. She was sentenced to 18 months in prison.

​@stephenmelton2532 That is definitely a possible scenario. And if that is the case, maybe that was why the other previous and potential personnel for the prosecution stepped away from the case. Some situations call for a fall guy. I have no idea who was guilty or innocent but all of this is unfortunate.

I’m aware of, but had to double check the meaning of “with” vs “without” prejudice, then went back and rewatched the last 20 minutes. Judge is clearly sending a message that this kind of prosecutorial misconduct will NOT be tolerated. A mistrial without prejudice would be like letting an embezzler off if they give the money back.

Very interesting outcome -- case dismissed because prosecutor and LE have been withholding a piece of evidence. This is what should happen in the Idaho4/Bryan Kohberger trial.... Prosecutor and LE have been withholding a great deal of material evidence favorable - even potentially exculpatory ---- to the defendant. And have been unable to produce ANY evidence during pre-trial to prove their claims against him. And yet... he continues to sit in jail. And look what happened to Karen Reed, and that Richard Allen guy also sits in jail despite the fact that the judge herself should have been removed from this case. I agree. Our "justice system is clearly not about true justice."

Setting the abysmal ethicality of this prosecutor aside, I find it absolutely fascinating that she called herself as a witness, and then was absolutely dismantled by Alec’s shark attorney which led to the case being subsequently dismissed by the court.

The arrogance of this prosecutor got her in this position. She thinks she owns the court room, the witnesses, and the evidence. Her taking the stand tanked her career. Watching this live, was the single most incredible, cringeworthy, and shocking thing I’ve witnessed all year. What a disgrace. Her omissions and sideway admissions are representative of her clear knowledge of the events that played out today. She single handedly, on her own, tanked her entire career, though, she probably will blame others for that too.

i agree, with the other case she says they didn't ask for the report because it went against their case.... except since they did not know it went against their case. they would have asked to see it, because the results may have helped their case but they would have no way of knowing that unless they received the report

Agreed. A silver lining is that it doesn’t take a legal scholar to understand that today, justice won by way of an honorable, courageous judge. No doubt, those who don’t understand the law and the ethical rules & professional standards imposed on prosecutors and the seriousness of the prosecutor’s breach, will conclude privilege won. Yet, the judge chose the long game. A big win for all Americans - against power wielded without integrity

Morrisey lied on the witness stand about why Erlinda quit by blaming it on the jude televising it. I just saw Erlinda interviewed by Cummo and she said she quit after finding out the ammo was not turned over by the prosecutor.

Johnson gave an interview where she denied she resigned because the hearing was public. She said she resigned because she advocated throughout the lunch break that the case be dismissed due to ethical reasons and Morrisey didn't do that.

Never assume a narcissist isn't aware. They're very aware. They know the rules and what's right or wrong. They just don't care. People assuming they're unaware is a defense mechanism in trying to reason the behavior of narcissists. Logically, they think if they were more aware, they would act differently. Awareness is not their deficiency. Being aware and simply not caring about the feelings, rights and value of others is their problem. You're nothing more than a table lamp to them, and if one day you won't switch on - i.e. you're not useful to them - into the trash you go. Did you ever give a second thought or lose sleep over throwing out a broken lamp? No. At most you're annoyed because now you have to find another to replace it.

Although unlikely, one could assume prosecutorial misconduct and/or a civil rights civil lawsuit against the prosecution. Being that this is a Brady violation, that could open the door for civil implications for the prosecutor.

This prosecutor has been shady from the beginning. In this case she was bested by much better attorneys and by angering the judge too many times with misconduct until the judge had no choice but to dismiss-the “with prejudice” surprised me.

She is trying so hard to say that the rounds do not matter and all the while she forgets that decision is not up to her. She doesn't get to decide what evidence matters, that is up to the court. Her prosecution was based on her dislike of Baldwin. But fortunately hating someone does not make that person guilty. If she has any brain cells left after her mental gymnastics in court she should resign.

The most bizarre part of this is that the ammo not put into evidence was totally irrelevant to the case. The entire trial over the 3 days didn't cover anything relevant to Alec Baldwin's charges. This trial was a real head scratcher.

It was relevant. It came from the same manufacturer as the live rounds found on set, and ultimately adds another layer of wrongdoing before Alec even gets a 'COLD gun' that isn't supposed to be loaded, and he goes into character in a pretend world, expecting what he's always had, a prop gun. Actors point guns at people all the time. And nobody freaks out when they're watching the movie. It's only now that people think the 'never point a gun at anyone' rule should apply to actors that they have watched point guns at people on set every day. It's ok as long as it's on screen tho ..... Right??

@@candya9971 Not really,no one knew who Hannah was until trial.Alec Baldwin is a A list celebrity that this prosecutor wanted on her record by any means possible.Justice was served when the person responsible for loading those guns is behind bars.Jensen Ackles came very close to being in Alec’s shoes because even he had a live round in his gun belt.Hannah was negligent and should never be able to be around guns ever again.

That’s not why Johnson resigned. Morrissey lied on the stand. Johnson resigned because she found out Morrissey hid the bullet evidence from the defense for the first time. She has actual integrity so she immediately resigned. She gave an interview explaining this. She told Morrissey we have to drop this case over their lunch break, Morrissey refused, so she resigned.

I read that he's dropped out of quite a few cases he was defending when he thought the case was a lost cause or he could tell they were going to lose. He supposedly does this so he maintains "not losing a case".

​@@jenninscho1980ALL attorneys do this. I had a lawyer pick me up on contingency after getting more evidence, he determined I had a 95% chance of losing in court. He gave me 3 options, find a new lawyer, drop the case, or he'd ask for a settlement. I told him to ask for a settlement and he got me one - knowing when to end a case or pivot is extremely strategic and imperative to a "win". I still won despite never going to court.

this prosecutor used a 30m sidebar objection, to prevent Baldwin's team from using photos of the movie script. [actor Baldwin cocks hammer]... this was tragic accident on a movie set. It did not occur because Baldwin was horsing around with firearms.
