I just tucked Jess’s information away for a rainy day. I will say that we had a catastrophic lightning strike in 2022 on Reboot, our catamaran. Geico was really fantastic to deal with every step of the way. It took about a year to get her completely restored, and in some areas better than new, but fighting with insurance was not part of it. For my part, I was super meticulous with keeping notes and spreadsheets on everything, including who I used to fix the boat, which made it easy for the insurance company (which they told me, as did the repair companies I worked with). I learned so much with this video and I’ll be sitting down with a big cup of strong coffee to go over the entire policy again now that I know what to look for 👌 and make sure I’ve done my part.

That was really helpful. Thanks!! I especially noticed the issue if intented use. It is just like a prenuptial agreement: describe your intent with the agreement specifically and in depth. If a lawyer or broker draws up a dokument on this basis, the intent will actually overrule the contract, if it obviously do not reflect the intended wishes. I learned that the hard way. For amateurs describing the intended use of a boat prior to an agreement is in many ways easier than understanding all aspects of an insurance contract.

From my experience the easiest way to sort good insurance vs bad is: if an insurer doesn’t ask many questions when u get insured they will ask lots when they need to pay out and most probably they will give u hard time to get paid On the other hand an insurer that will ask lots of questions and proofs of works/ maintenance or even ask certain works before insuring u From my experience those are the ones that will not give u any issue

That's my catamaran in one of your pictures..smashed up after cyclone Debbie in Australia ( 4.32. With the blown out motel behind her).. she wasn't insured...crushed up on the harbour wall with a trawler that fell on her when the tide went out tearing one hull off

OMG Peter!!! So sorry to hear that and I hope it did not bring back any bad memories for you. We had tied up our 42 foot cat in the mangroves at Seaforth so we were lucky, and the storm was not quite as severe down there. Complete loss of your boat without Insurance is as heartbreaking as the insurance companys not paying out. We hope you have bounced back and are still enjoying life and sailing the WhitSundays.

@barefootdoctorssailing8567 it was bad enough to lose the boat and then people stealing parts of it...but at least I was spared burying an insurance asessor who decides they don't want to pay up...insurance companies are despicable....I now have a small boat that comes home on a trailer !!! I still love sailing, always will, but boat ownership in a cyclone belt not so much.

From what I've seen and read, your situation is a lot like those who have bought brand new RVs. Warranties are worthless and insurance companies refusing to pay.

Hi DK, thanks for your comment. I am sure you are right - insurers in all fields will use similar tactics to avoid payouts and RVs will be similar to yachts. Warranties are the things the insured person is agreeing to comply with (where you sail/drive, maintenance, reporting etc) and failure in any one can void the insurance even if the event has nothing to do with the "casuality" or event.... Like the lightning strike not being paid cause the fire extinguishers were no serviced - no fire involved.

We lost our first boat in Hurricane Irma a week after taking ownership in the BVI (2017). Pegasus Group (underwritten by Lloyds of London) was great to work with and within 2 months, we had a check for the full coverage of the boat.

What an excellent video.Thank you. I think like all insurance many of us are fearful of investigating insurance due to it being a whole different world. Where can you find a knowledgeable broker with a 24/7/365 service? Can you choose an underwriter that works with the perfect broker for speed of payout? Is there a maritime lawyer firm that knows the broker and underwriter so they are all speaking the same language. Am I dreaming?

Hi David, I think you need to find a good broker first as they will get different companies to insure you depending on where you are going and potentially change insurers when you change oceans. The lawyer only get involved when you are being done over and at that point the broker just drops out the picture (it seems). As Jess said, ask around experienced sailors and yacht professionals in your area or region for a good broker first and see what their structure is for helping with claims. The other direction is to speak to the lawyers or even insurance adjusters as they have to deal directly with the insurance claims... Hope that helps. PS I do not believe there is any "ideal" broker with an insurance company attached - sorry!

John, you were not being harsh or strong, that lawyer really ticks me off. Of course the insurers are not our friends. Dealing with them likely has taken years off your life.

Thanks for your support Klaat, it is a matter of opinion and we will continue to understand that they are not our friends, not on our side and will always not pay out if they can find a loophole, even if it is not actually legal cause they know most folk will give up…. We also used the box technique to protect ourselves and not let the aggravation in….

Interesting video. We’ve got a new 52’ cat in build and will need insurance. We’ve sailed a couple of laps of the globe in prior boats, but never made a claim. Those insurers aren’t interested in this boat as it’s full carbon fibre. Any tips on brokers or insurers would be super appreciated. Really appreciate you sharing your experience.

hi Page and thanks for the question. We are not aware of who covers carbon boats as we have not had to do that so far... It might be useful to contact the builder to give you the names of other boat owners of the same brand to see how they got insurance or message those KZfaqrs with carbon boats - the Wynns, Happy Together, Vagabonde.....

The value you offer vs. the other KZfaqrs mentioned is that you’ve made a real claim! I’ve had well over 10 years of boat insurance but never needed it…. Best wishes for the new boat. High, how are you guys doing? I was very curious about how things turned out for you. I used to live in Fort Lauderdale. Now I'm in Eugene Oregon. I was there when your boat caught on fire. I remember it. So I was very curious upon your outcome. I'm glad things worked out for you two. And I want to tell you thank you for keeping us up and for this video about insurance. hi Giter, thanks for the comment. In most countries house insurance is regulated but they do also have escape clauses like storm versus flood - if water comes up you don;t get paid out but if it came in from above, you do get paid... Not nearly so uncertain though.

Regarding the Warranties! Would a full log (in paper and or digital) substantiated by sign-off (of a provider or bills) and photo evidence cover the owner's obligation to provide evidence for warranties? My main takeaway from your experience is that it PAYS to spend a couple of thousand on having a 3rd party marine lawyer go over your policies. Better 'waste' that money than losing out in dire times when you can't afford to.

Hi Patrick, as long as you have logged the maintenance or actions in your ships log, that would be fine. Obviously for things like fire extinguisher maintenance that will be an invoice that proves it’s been done. The usual trouble is that folk don’t realise what things were needed when they adjusters ask the questions, so they willingly give the answers that void the insurance payout.

Did your insurance company subrogate against the repair company Just Catamarans since they were at fault for starting the fire?

I don't really know how that went but if they had paid us out properly they could have surrogated all the costs to JC. I think that because they did don't comply with US insurance requirements, that may prevent them from surrogating their claim....

However ask your broker and big name insurers will be safer than XXXX Caribbean Company with no regulation and no guarantee to not go broke....

I have to say re the boat unattended on a mooring. Where do you draw the line on mooring related claims. If I were an insurance company just from what I've seen, I wouldn't even cover open water moorings. How old was the mooring? Is it serviced? Did he dive on it? Every sunken boat I think I've ever seen personally was a mooring that snapped or the boat was left unattended and it sank or someone hit it and it sank. One rule we had from day one was we all vote to take a mooring, either someone dives on it or someone stays on board awake. So many boats get damaged on mooring.

Yes I agree about always diving on a mooring, but if you’re cruising as a couple, it is completely impractical to never leave your boat, unattended at anchor or on Moorings at some stage in a world cruise. The key here is to tell your insurance company in advance that that is how you sailing so that they know. Clearly he didn’t read his policy and presumably did not inform the insurance company that sometimes the boat would be unattended. Everyone just needs to know these intricacies so they don’t lose their insurance claim.

@@barefootdoctorssailing8567 Absolutely it is a pain for a couple but insurance is risk vs profit calculation for a company. What is easier or practical for you likely doesn't matter to them. We found it very easy to get reasonably priced insurance from a large mainstream insurer, which we found odd at the time considering our young ages. Your video has given me more food for thought regarding how we answered questions and how that lead to multiple insurance offers. I suspect the third crew member and our propensity to spend most time at anchor played into the success as these are all questions you answer. I think it is a very interesting game that is played applying for live aboard insurance. I hear of some couples having a lot of problems getting it on newer large cats. Imagine from the insurers perspective you say that you will moor your boat and leave it to explore all day in a high risk environment like the Caribbean. Interesting topic

Hi Docs... for anyone dealing with UK insurance problems there is also an insurance Ombudsman service ... they have powers to investigate, arbitrate and direct settlements and fine offenders if required. Though im going to suggest that because your claim was international they might have been less than idealy helpfull .. 🤔?

Good point Clive about the Ombudsman. I think if we had to sue in the UK, it may have been helpful but our insurance was just not budging from their position and not giving us any reason and forcing us to go to court. This is a common route as they know many / most individuals do not want the high costs which are often more than the insurance payout is worth. In our case it would have been worth it as we were insured for $1.2M.... So we were in it all the way!

Thank you thank you thank you this is one of the your best and one of the most useful videos I have ever seen.this just might be the difference between getting paid out after an accident or not ! We will read the fine print over and over on our next boat I think we were lucky not to have a major claim.we had enough trouble with a $2000 claim !would you mind telling us how much your legal fees were?

Thank you for this video. Unfortunately, it appears that we have the same insurance policy from LMS and spectra. We do have different brokers though. We just renewed as well. What would you advise someone like myself who has the same policy? I will be going back and asking my broker about warranties and exclusions.

Yes, you have our sympathy! I will never use them again as they did not do the right thing at any point and what we made public was a very mild version of the terrible way they behaved. I would strongly suggest that you read your policy (do you have to weigh your fire extinguishers in Clause 11) and ask the broker if they are allowed to aggregate claims and offset H+M line with salvage costs and not pay us for our personal, dinghy and engine at all.... Given that you have already paid for the year, you in all likelihood would not get a refund but certainly for the next year, try and find another insurer.

Great video John, quite illuminating. Three items: I wonder how we can determine if our broker is going to be there if things go bad? Sure, everyone on FB will tell you "This guy is great" but how many claims do they actually assist with? Second, I often hear that this or that underwriter is a scam and will never pay out, how can we find the answer to this? Third, was your insurance on Ultradash placed in USA or UK or Australia?

See my answer to your comment above for the first 2 parts (we will collect and share data of everyone's claims) and our insurance was done through London because USA insurers would not cover Non-USA residents and the underwriter, Selecta is based in the Caribbean which is unregulated completely...

Seems like you had a very bad broker hook you up with a very bad insurance company. Also, I dont understand why Just Catamarans wasnt found completely negligent and liable. It was their workers, or workers under their authority, who blew up your catamaran with bad practices. You should not have been out of pocket at all.

Thanks Peter. Yes JC were liable and they never disputed that. However as we had to get a payout from our insurance first and then get the gap from JC, because our insurance were only wanting to pay our 1/3 of the $1.2M, we had to take them to court first and we were at that point and JC stepped in to pay in the gap.

Would you be willing to privately share which insurer and broker you used? I would like to know if I made a bad decision before it’s too late. This is great and timely info as we just went through the process of insuring a boat as its coming out of the factory. Understand if you’re not comfortable however.

Yes, it is already public knowledge because on the video I said my insurance policy from selecta, broker in US was Bluewater Insurance in Florida, and it went through London Marine who produced the Insurance document. Although those details are on this video and video 44 about the fire. If you go back to the video, I also showed the page of Insurance that has got the London Marine logo at the top and the selecta name in the underwriter section. So no secrets.

Thank you. I’ll go back and look closer. I have three different insurers at different levels, and none of them are what you used. Whew. And my broker is different too - I’ve been comfortable with my broker and have used them for years. This is just the first time I had to go offshore because the boat will be in Europe for a while.

That's great JLB! Insurance in the Med is easy and relatively cheap with plenty of options. It is the Caribbean and Pacific / Indian Oceans where it gets much more difficult.

Hi Andrew, the broker is MEANT to work for you (but gets a cut from the insurance sold) and the insurance agent works for the insurance company. Some are good and some are "less" good!

The lawyers charge an hourly rate for this find of service. I think it is the lawyers that sue for damages that get a percentage. Here we were just trying to get what we were owed!

That's why I don't like doing sure nothing because they're only scammers all of those insurance company should be sued off their ass and put them out of business it's only about money especially through DMV dot whatever you want to call it it's all about money which is bullshit money you can save for other things in life why ensure anything I damn sure don't

Thanks for the comment Clavin and yes, many folk take the route of no insurance - see comment from the chap who catamaran was the one in the Cyclone Debbie picture in this episode - he had a total loss and no insurance. That's really tough too!

This comment/inquiry is not marine insurance related. You're in the midst of a new build of a catamaran. I have never discerned the installation of a screen door between the salon and the cockpit of any catamaran. The advantages I need not catalog. Have you or other catamaran owners ever considered the possibility of installing a screen door?

They are both by manufacturers and owners who have. Windelo based in the S. France fits them as standard ..the region is known for its biting Marshland Mosquitos and more recently like many regions the spread of mosquito born diseases N and S of the tropics so Zika in Brasil and Dengi and West nile fever have been recorded as far as Paris in summer 😬 You also need them fitted to hatched opening ports and any air vents drawing air in. Scottish midges and No seeums in the Caribbean and central America and mexico can make anchoring close to shore a night mare and exploring River inlets and mangrove channels torture . So its a good idea to have full rear weather and net enclosures. Even on the IWS and great lakes you can get insect hatches that can coat a boat with insects once the lights go on .. but most of those dont bite. In the US if you look at the CDC sites they will show the areas where disease carriers have spread to. Mind you i was quite surprised to find Leprosy was endemic to Florida .... Trump might want to get his Doctors to look at those fingers.😂 🧙‍♂️😉😊 Dont get playing with Armadillo's either.

Hi, thanks for your comment and yes (of course) there is a saloon door in the Portofino 52! When sailing the Atlantic we had vertical driving rain from the stern making the saloon completely wet if those doors were not closed. Also essential for security form theft... Ours operates as a sliding door on the right side and window that opens to the ceiling behind the aft cockpit seats so the whole area opens up fully if we want. And yes ALL cursing cats have closable and lockable doors here but all photos are of the doors open as it make it look like more space....

@barefootdoctorssailing8567 I'm talking about a screen door in addition to the solid door with windows. I am well aware of the need for the solid door. I would assume, particularly at dock or anchor, insects can enter if the door is left open. A screen door would prevent insect ingress. If the ports have screens and a screen door were present, this would facilitate the flow of air.

Sorry I misunderstood the point. Screens on the saloon door are not standard but can be added as an aftermarket. Most useful if you are in areas of high insect populations...

@@firstlast1047 If you do fit mesh ...and its highly recommended... You want a particularly fine mesh as No see ums..as they are called in the Caribbean and biting Midges like in Scotland are a lot smaller than most 🦟 Mosquitoes but equally irritating. So not all meshes are equal ... Im not sure if Noseeum Mesh is an actual trade name or just a finer mesh category but ive seen it used in relation to inner tents vent panels .

Hey John and Eli, I contacted you guys when my yatch broke the anchor chain and beached, that was on 1 November 2021. I have been fighting the insurance company ever since. They keep changing the reason why they don’t want to pay out, it’s ridiculous. They also had a bitch that one of the videos was poor quality. How does that make any difference? What other product do you buy that tries to stop you using it. Like saying, here’s your brand-new car, but you can’t drive.

Not sure what experience you have had to make such a comment or exactly what you are referring to, but Eli had an accident and required surgery to repair her face and eye. No malpractice required thanks... Perhaps it would be best to keep focussed on the content of our videos and avoid making personal dispersions.

So we just have sympathy for anyone in that situation... It is also very sad that more and more folk around the world are living in a nightmare esp if it is only inside their own minds! Thanks Guenther, yes I saw that video (recommended by another subscriber) and the Lagoons do it slightly differently with no canoe under the boom and a really large roller and they use the winch power to raise and lower instead of the in boom electric winch that costs about $10,000 alone! Very interesting!!!
