ConCourt judgment on IEC appeal over Zuma's candidacy ruling

The apex court heard arguments earlier this month on the correct interpretation of Section 47(1)(E) of the Constitution - which governs who qualifies for membership of the National Assembly.

I think this must not be ignored that the justice system was violeted when former president Jacob Zuma was not taken in prison having followed the correct procedure of the law( which is going trial and appear in Court to exercise his rights but no the brutality and intimidation was applied again in so called Democracy)

Mpofu has consistently attempted to manipulate the courts to bend the application of the law regarding Zuma's appeals. He persistently abuses court processes, asserting that Zuma's eligibility to stand should be based on the sentence served rather than the sentence imposed. While some may feel aggrieved by this outcome, the majority will likely welcome the clear determination that Zuma is not eligible to stand for election.

No surprises, we all knew the outcome to this before hand considering the history of this matter. So no surprises, but on the bright side of things I'm glad that Zuma will not lose his presidential benefits as a former head of state. MK also a winner because Zuma is on the ballot paper.

He epitomizes populism, instilling hope in the marginalized while undermining the country's ability to attract the necessary inward investment for job creation and security. His former party failed to provide adequate educational support for decades, and now he claims to have a solution for social improvement. Despite being involved in an organization with the potential (but not the capability) to achieve this for 30 years, he failed to do so. The notion that this elderly man, entangled in a series of ongoing legal battles, can suddenly deliver an elusive solution is, unfortunately, laughable.

That was expected, but still the question of separation of powers,is important, it's not for the constitutional court and IEC to decide that,i suspect Zuma knew that and his legal team that he is not going to parliament only because the sentence is of emotions and they have to protect their image in the concourt.

We now have precedents and case laws justifying for an overreach of power from *TWO* chapter 9 institution and the judiciary. They've literally stripped the executive of it's powers and privileges, one such power is to pardon, to remitt or parole as prescribed. The judiciary has an unprecedented amount of power now, esp the ConCourt.

I think there's a fundamental point some of us are missing here, and that is, this has nothing to do with the MK party. No one is saying you shouldn't vote for the party, it was Zuma's eligibility to be a member of parliament that was being contested. It is your constitutional right to vote for whatever party you want to represent your interests in parly, given they are registered with the IEC of course.

If contempt of court is a crime, ' were then criminal procedures followed in incriminating him? What are the criminal procedures, were they followed? Constitutional court as the last resort why was it used as the first resort? Crimes have weights in that some are held at lower (magistrate courts) courts and some to high court. Zuma was sent to jail without court proceedings and representation

Should a person who is disqualified from standing for election remain on the Party list submitted in line with the laws that disqualified the person? Can fugitives from justice .e.g. the Guptas be on Parties' Candidate lists submitted to the IEC?
