Elie Mystal then dives right into the history of SCOTUS’ Chevron Doctrine, with the right championing in the 1980s as Reagan attempted to use his cabinet to cripple the relatively nascent administrative state, and the unanimous decision by the Court to delegate the reading of administrative law to the experts in the agencies, rather than allowing for themselves and lower court judges to dictate the meaning of all legislation. After briefly running through this decision’s relationship to the budding institution of the modern administrative state, and why - despite the conservative origin of the case - it is hugely important for the functioning of government and democracy as a whole, Mystal tackles the massive role the Chevron Doctrine has played since it was established in 1984, deciding some 17,000 cases, and the complete legal chaos that would be caused by overturning it. Elie and Emma also touch on the asymmetrical nature of this fight - with the difficulty of governance further inflamed by the ease of obstruction - and parse through the various ideological stances of the conservative Supreme Court justices that are likely to decide this case, before wrapping up with the future of the fight for the administrative state, why it might lie (unfortunately) in Congress.

We have that because we have a Constitution and the Terms of Justices and Fed Judges is set there as lifetime. So if you want you an have your representative propose an amendment to change that. Just remember what it takes to pass a Constitutional Amendment.

The notion Trump ONLY won because the Green Party exists as an alternative is not only absurd it's a little concerning. I suppose you'd only like One party? I agree mind you since I'm fine with eliminating the Republicans entirely (we don't have a real democracy at all anyway and never did). But the Dems need to go as well. They're useless. The REAL problem here is our current supreme court is operating precisely as originally intended. The Republicans merely did what the system allowed them to do. Don't settle for Biden. Yes, yes, "vote blue no matter who", but it really does matter who if we ever want change. Biden could've taken one of several different actions against an overreaching Supreme Court, including (at the very least) making a public call for impeachment of Thomas and Alito over accepting bribes. But he does jack shit. Not every presidential candidate would allow this to happen. Trump is worse, but Biden isn't great, either.

I knew democracy was in trouble, the first time I heard the phrase "free speech zone", around 25 years ago. (I mean, say what? I thought it was fundamental that free speech was everywhere!) And then a couple years later when Alito was confirmed to the court, I said, "Okay, it's over now. It'll take a few decades to play itself out, but this is the day future historians will look back on, as the end of the American experiment." Sucks to be right. 😞

Yes! I love being nerdy with the law but the way Elie breaks it down simply and concisely and in language anyone can understand is so great. He's also funny but has a proper sense of how much we should be worried which is appreciated. This clip reminded me I need to read this book!

In the best case scenario assuming EPA loses power, EPA can still provide detailed data driven policy recommendations to Congress to decide so we really need to end gerrymandering with universal at large districts with ranked choice voting and many other democracy modernizations.

Re Mystal’s description of Chevron: the doctrine is not about deferring to FAA as the best experts on how many bolts should be on a plane. It’s about deferring to FAA’s regulation re the number of bolts, as long as the regulation reasonably interprets the statute (and as long as Congress didn’t explicitly address the issue in the statute).

Does this mean an Agency will one day say 2 + 2 is not 4? I agree the Agencies should decide the nuts and bolts of regulating their given sectors. Congress should expand the opportunity for public input into rule making proposals in order to educate the people on the objective values of these proposals beforehand.

The important question to ask them is if they know why they should care. Example after example after example of the most important landmark cases in which it’s connected to chevron.. . As well as a connection to them specifically. Now if you can tell those examples in a story to prove the connections. Both arguments and what each other’s next four moves will be…. Then ask again if they care about the environment or anything.

I’m sitting here, as a mom of two kids looking into the future and I’m absolutely astounded. I know it’s silly because the SC is the “highest power” - a position assumed by the way as no governing body bestowed it upon them - but can the court be sued? I know Dobbs was supposedly about state rights so a pre-teen girl who was raped and forced to carry a pregnancy to term in a deep red state cannot sue the SC directly - she’d need to start at the state level. But Chevron? Why couldn’t it be argued that doing away with having experts make the tough decisions will directly harm citizenry at large? Who gave these politicians in black robes the power to legislate against us - to legislate against our kids? And no, even down the line after Chevron is overturned, because it looks like it will be overturned 6:3, and a random judge actually rules against a big polluter - there will be no remorse on the part of the fanatics. They will just “buy” the next judge and pump more money into their defense teams - or settle out of court without an overall decision/precedent to help us all. What is this - the Balkans? Is money (profits for the capitalists) the only thing that matters - REALLY? I’m changing the subject here a bit - but not entirely as these things seem to be connected: this is exactly what the Russians are using against us. The whole “decaying West” trope - which they generously help bringing about by funding extreme right wing groups AND U.S. politicians through the NRA for instance. Plus by manufacturing our reality for us by targeted online agitation and dis/misinformation campaigns. The internet gifted our ex KGB Putin a relatively inexpensive tool to get this whole global Right Turn going. Trump’s base has basically been created for him through these methods - of course fault lines had been there prior and the hate is all ours at this point, but the divisiveness we are living through is an artificial construct to favor certain goals. United we stand - but divided we fall, right? But I digress. We now have scientific studies linking obesity to chemicals in our environment - more specifically pesticides - a condition that is the basis of many of our modern diseases: pesticides cause hypothyroidism, inflammation, diabetes, food sensitivities, in vitro & through breast milk they are linked to autism, and then of course a myriad of cancers. The stats show significant increases in cancer cases, spectrum disorders, obesity is at unprecedented levels - and the SC wants to regulate less, not more? Where is the moral obligation to keep us alive? Is a luxury vacation that much more valuable?

There should be a general election for Supreme Court where the people get to vote for democracy especially since a life time job & it would be great to make term Supreme Court limits by years or early age

Republicans, corporations, the already way more than enough, and the Supreme Court et al dont want Accountability for anythng. Not to the Constitution, not to the people, not to the country, not to to future of the youth of today and tomorrow. The level of criminal selfishness is breathtaking, and worse. Making these accountable is our central task.

The Supreme Court's only duty is to affirm or deny the claims and factual findings before them and require all states to abide by their findings, of which this decision becomes the law of the land. 02/17/2024: Response by Political Analyst and Strait Shooter; Cliff Strait Telling you what Mainstreet Media, their commentators, and their pundits will not tell you. It is clear to most of us this court does not want to abide by the Constitution because they do not want to be responsible for removing Trump from the ballot. This is why few if any of their questions were related to the merits and facts presented in the case such as addressing the issue of; whether Trump committed insurrection. So, they are creating excuses to not perform their duty according to the Constitution. Anyone barred from being on the ballot by a Secretary of State, or board has the right to take their case to court. If the state court concurs that one is disqualified from the ballot, this person has the right to appeal their case. If they fail in the appeals process to the Supreme Court, then this ruling should be the law of the land and binding to all states. If one fails to appeal a Secretary of State's decision or a state board's decision to disqualify one from the ballot, this should be binding on all states. If a single state has adjudicated the issue of barring one from being placed on the ballot fully as the Colorado Supreme Court has, and the case is appealed to the Supreme Court, the Supreme Court's only duty, is to decide the case based on the merits and factual findings presented in the case of the lower court or state court. The Supreme Court's only duty is to affirm or deny based on the claims and factual findings before them based on the Constitution and require all states to abide by their findings. The current Supreme Court only seeks to make the case more complicated than it needs to be so they can make a political decision rather than one based on the merits and the factual findings presented in the case and based on the Constitution. Justice Katanji Brown Jackson missed the mark on the issue of whether the 14th Amendment, Section 3 applies to the president. Here she is showing her lack of historical Constitutional knowledge, and her lack of effort to get up to speed on the issue. Then when she realized she was dealing with a losing argument, she cut the attorney off. Here is the rest of the context she did not want us to hear: Here is a little historical context to settle the issue of the term officer, or why the titles of the President and the Vice President were not specifically named. In 1868 Congressman John A. Bingham of Ohio, was the primary author of the first section of the 14th Amendment. Sen. Jacob Howard of Michigan drafted section 3 of Amendment 14 on July 9, 1868. Maryland Democratic Sen. Reverdy Johnson questioned and hotly debated why the president and the vice president were not explicitly included in the draft. Maine's Senator Lot Morrill jumped in to clarify: "Let me call the Senator's attention to the words 'or hold any office, civil or military, under the United States,'" Morrill said, ending the discussion on that point. Their intent was clear. Especially when the very first sentence starts off with; "No person shall be a Senator, Representative in Congress, elector of President and Vice President, .... ." Since we have a very uneducated society as to the Constitution and American history and a very divided society, this court can pull the wool over the eyes of most. Even some of the so-called highly educated scholars, of which many sit on the Supreme Court are ignorant of the history of the Constitution and American history. Many of us have also witnessed some of these ill-informed people or people with ulterior motives being used as pundits on mass media. The insurrection clause is different from the age, place of birth, and the number of years in the US clauses in that for the place of birth and age you have a birth certificate or certificate of live birth. As to proof of residence in the US, we have our passport if they lived or traveled outside of the US. The proof of Trump being a part of an insurrection in today's world is different but not difficult. In Trump's case not so much, because we as a nation watched it unfold in real time on TV, from the Ellipse to the Capital. Then we had the impeachment process which was turned into a political decision rather than based on the Constitution, although not a trier of fact, but Congress failed the people. Had they done their job we would not be where we are today. Then we had the January 6th Committee investigation, again not a tier of fact, and their referral to a reluctant DOJ. Then Colorado had two court hearings on the matter of whether Trump should be barred from the ballot. These court cases serve as trier of fact and due process. Unfortunately, the Supreme Court which votes on political lines decided not to hear the appeal on the merits and the findings of the Colorado Supreme Court, but decided to try a figure a way out of removing Trump. So much for the Constitution. So we have plenty of proof that Trump was involved in an insurrection. Trump had the right to object to the secretary of State's opinion or the option of a state board, by taking his grievance to court which was well within his right and the court's right to hear the matter. Because he did not like the court's decision, he had the legal right to appeal it to the Supreme Court. Trump also had the option to request that Congress lift the restriction, which would have been the fastest way to resolve this, but he knows he does not have the votes to do that. Then Justice Clarence Thomas failed to recuse himself because of his wife's direct involvement in the insurrection. Just think about all the years the states have had the right to run federal elections until Justice Roberts decided the states should not have been charged with running federal elections that are fraught with corruption when it comes to voter suppression, gerrymandering, the Electoral College, and a corrupt US Postmaster who pulled mailboxes off the street to make mail-in ballots difficult to process and dismantled sorting machines to benefit the Republicans. All of this should have landed him in prison for disrupting the mail, but little has been said about this corrupt act. Justice Roberts forgets his place, this right can only be given by Congress, not the Supreme Court. Personally, I have lost all confidence and faith in the Department of Justice and the judicial system. Trump has shown us most of these agencies' vulnerabilities

I Nancy MacLean‘s book “democracy in chains“, she describes the hard radical rights political agenda for, what is for all intents and purposes, a coming oligarchy, in which, the courts of mass more and more power to legislate from the bench (especially Scotus) as more and more dysfunction is created in the Congress by the far right caucus of the republican party, a.k.a., the Maga fascists. The court will then be used to limit powers of the presidency when it’s a Democrat or a humanitarian liberal, and expand the power of the president when it’s a right wing conservative pro business anti-humanitarian Republican president. This plan has been underway for 40 or 50 years since before Reagan when it was first contrived by a very wealthy fascist oligarchs in this country who have been seizing power through corporatocracy for decades in a slow stealth march toward autocratic oligarchy. That template fits all areas of socio-economic strain in the country’s politics now.
