She also clearly laid out how the internet has changed the way distribution works, so the scale they used when they made the guidelines is no longer balanced. The last time I watched this video I laughed at how much she was flailing and couldn't answer his questions but now I see that he's just being muleheaded and playing politics, while she's being very professional.

Her opinion on this case isn’t the biggest factor to determine the outcomes of the case but rather the policy that is used in those cases are given by the authority of congress and not her own interests. It’s not just her ultra light sentencing that’s disturbing but even the maximum sentences seem soft. Trading in child porn and 15-18 months is a maximum sentence? That turns into probably less than a year. I understand that they might not have taken the pictures and videos themselves but they sure as hell create and promote the market for it. I seriously thought these types of crimes had much harsher penalties.

You do not get the whole video and just skipped to say what average uneducated Republican would say or ignorant should I say. If you seen the video and understand the due process you would see that the judges have restrictions on their ruling based not only on the what the government presented in the case but what also the policies for each case were which in the cases were on images and the set rulings on the amount of the images is outdated from the time of the mail. Having excessive jail time is prohibited by the constitution and understanding that we are in the age of technology the images that were used let’s say on the phone are in the hundreds would according to the outdated policy set by congress on the decades that passed mean jail for over 50 years which would not make sense.

Totally inaccurate and abuse of power by giving misleading information and forming questions based off nothing that holds legal value to her ACTUAL capabilities as a judge nor did he act in a manner that the confirmation process is supposed to be handled, by actually allowing her to answer the question or at least complete a sentence. Her role in the government’s 3 branches is at the bottom of the totem pole while his role is at the top. So he wanted her to apply maximum sentencing based off the societal norms of how vial and disgusting sexual acts against children are deemed and for the sole basis of deterrent of others considering crimes in the same capacity. Which is legally against the legislative code of conduct of how Judges are to conduct themselves when deciding sentences of the convicted. While he conveniently neglected to factually articulate that while she served as Vice Chairman of the Sentencing Commission a report was made criticizing the federal guidelines as outdated which basically means they are placing the burden of responsibilities of better sentencing guidelines to current times on the legislative branch to give Judges a better outline to fairly and diligently sentence punishment to fit the crime committed. So due to there being no legal grounds to deem her as an activist or held accountable for ANYTHING to discredit her qualifications as becoming SCOTUS, any ramblings and brought up issues that either are based off emotions, feelings, opinions, etc… without FACTS in comparison to her legal duties as a judge or qualifications is ,and will forever be, deemed as “it’s because she’s a black woman” in my book as a definition to such activity displayed!!

What’s scary to the maximum percent is how y’all clearly lack the knowledge of how our very own government operates and it drastically shows by these comments!!!🤭🤦🏾♀️ She stated REPEATEDLY throughout this highly disrespectful confirmation process that she based her sentence rulings from the provided argued facts, case law, and guidelines that is ALREADY set forth by the “legislative Branch” of our Government (who ironically Hawley is a member of) in relation to severity of the crime, in comparison to the numerical chart based off numbers of and/or the action done (possession, distribution, etc…) in order to fairly, impartially, and diligently impose the appropriate sentencing as punishment to the crime convicted! That’s ALL she can legally do in this process. So the naysaying members of the congress and you all as well are basically discrediting her capabilities to up hold the constitution while serving as SCOTUS because she didn’t decide rulings while using her emotions, personal beliefs, and disgust in crimes of that nature and give the maximum sentence to use as a deterrent of a trend of this crime to others. When ultimately (as she stated many times over) she expressed that the current guidelines she is forced to operate with in is outdated considered that “mail” was the basis mode of distribution type used to make the numerical chart while considering length of time done. now 3 times the amount of child pornography is easily accessible in a matter of secs due to advances in technology which is causing complications for other judges as well when trying to apply the length of time engaged and number of (in possession and/or distributed) In order to know when maximum punishment should be applied. Example for the layman, it’s hard to surrender a maximum sentence to an 18 year old who possessed 100s of child porn images in 30 secs one time when it doesn’t coincide with the length of the time that is outlined in the guidelines within the legislative to fairly or legally give an appropriate max sentence. So basically old Blame gamer here needs to fix the guidelines within his own legislative branch to be up to date with the current technology and then he can actually get the results he is expecting on harsher punishments being rendered!!

Interesting that Drumpf appointed judges have made exactly the same judgments and handed out the same convictions. If Hawley, in fact, if all the Republicans, are so uptight about the sentences, then change the law!!! Isn't that what lawmakers are supposed to do. Oh no. Beyond any of the other questions Judge Jackson DID NOT ANSWER, only one really mattered to me: "DO YOU REGRET HOW YOU SENTENCE HAWKINS?" That's a straightforward question and SHE DID NOT ANSWER IT. Her refusing to answer this question is huge evidence of a serious character flaw. The inability to admit when one is wrong is the height of arrogance and such arrogance does not belong on the Supreme Court of the United States. This is something that should terrify every American about this judge. The inability to admit when one is wrong is the height of arrogance. And before you write me off as some Trump Republicans white supremacist, let me head you off at the pass. I am a black civil rights lawyer, clergyman & academic and I am not democrat or republican. Right is right and wrong is wrong and as a person who knows child abuse first hand, I find her sentencing regarding child pornography morally reprehensible. Given the rampant problem of child molestation in the black community, fidelity to race should take a back seat to our societal fidelity to children. Given the moral repugnance of her light treatment of potential pedophiles, no American should want her on the Supreme Court UNLESS you're just in love with the identity politics symbolism of "First Blacks" and under some hypnotic spell from #blackgirlmagic. I'm not. I do not have the need to see "someone who looks like me" in the halls of power, especially when that person lacks the moral fortitude to protect our society's most vulnerable group: children. Telling me I have to ignore all of this because she is a black woman and member of my race is a bridge too far for me. Nevertheless, I could have forgiven all and gotten past all of what I typed above IF Judge Jackson simply admitted she was wrong. Again, this is a character flaw and such a character flaw does not belong in the pinnacle halls of judicial power. We all have fallen short and there is nothing wrong with saying so, especially on a stage this big. That would have been the height of humility, but she chose the road of arrogance. For me, that is unacceptable. For the aforementioned reasons, I respectfully dissent. In my estimation, Judge Jackson is not fit to serve on the highest court in the land.

Instead of attempting to delegitimize, browbeat others and trading barbs in cyberspace with people you don't know, how about forming a coherent argument as to why you disagree? I won't join you in the space of barb-trading, personal attacks and personal delegitimization, but I am all for COMPETENT DISAGREEMENT. Reasonable minds can disagree. As far as my "long statement," that remark demonstrates how little you know about law as the practice of law is all about "long statements" in the forms of court filings, legislation, executive orders, judicial canons, legal treatises, agency regulations and judicial opinions, for which Judge Jackson has cogently written thousands of pages over her career to which lawyers practicing before her and the Senate Judiciary Committee and its staff had to spend countless hours READING. Competent lawyers and judges spend far more time reading than in court. Thus, for you to complain about my "long statement" here says more about you than me. If you don't like to read, stay away from my posts and all things involving law as the law does not speak in soundbites like social media and it is not a profession for PEOPLE WHO DON'T LIKE TO READ- even those things they vehemently disagree with, despise, find laughable or otherwise find deplorable. @@jax408 I never said that they should not be punished which you and your friends have a good consistency of doing but rather I stated that there are chains in the system which make it harder to declare your own judgement in a case as you take other cases or policies within the jurisdiction of Congress and the other parties involved, so you need to better understand my words before you become all defensive and talk about you are studying the law. And even if you are studying the law doesn’t make you understand the situation of the cases that were discussed or the factors that were tied to the case. We have chains in our systems for a reason, that’s why they say that our legal system is a fragmented system of individuals and ideas but since you study law you should already understand what the Judge here was stating.

I understand the point she is making but I have to agree with you that since the internet has exploded the sentencing needs to be tracking with the times as you described. The impact of exploitation is exponentially higher for the victims as the permanece, reach, availability of and ability to replicate such images and videos have all increased. This is very serious and the guidelines need to be updated to reflect how much more damaging this really is in our current time 🙏 God bless you as you stand for righteousness and honor our King as you serve the nation as you do!
