Have you ever thought why Shariah Law chops the hands of starving people stealing food?
Yes?
Then realise that what you are thinking about is NOT Shariah Law. Majority of people, Muslims included think of Shariah Law as some form of barbaric system that amputates people left and right. They think that Shariah Law neither provides any rights, nor does it have a court system, and a person can be amputated or executed simply because of an accusation.
However this is far from the truth!

There is a difference between a rich person consuming the wealth of the orphans and a poor person stealing to survive.

No there’s not. Poor person can choose to have honor and ask for food or grow it or scavenge for it if hungry as opposed to stealing food. Rich person can also choose to have honor and earn the money they spend as opposed to stealing it from orphans or the public. To steal is to steal. Not feeding a starving person should also be a crime. As should not working or parenting for the stay at home parent.

It shows that its not often and that in order to get the greenlight to amputate a thief if there are any ambiguities than it is strongly discouraged. It's also a very good prevention of crime, simply don't commit theft 😂

Yeah, with this rule about stealing/robbery, no one would even want to *_think_* about stealing, that's why in, I believe the city of Medina, shopkeepers don't lock up their stores when they go to pray, they just put sheets over their products like jewelry and such because they know no one would even dare trying to steal something valuable.

The problem with this kind of law is not that they can't be "explained", it's that they can be interpreted with horrible result. Also... You compare... Saudi Arabia? Are you talking about cherry picking?

Not exactly.The law tells you what NOT to eat as it is bad for you (like alcohol, blood, scavengers, animals that were sick or dying before death etc etc). We all know these things are bad, in one way or another right? It does not exactly tell you who to like also XD It tells you more like how to treat people you do like (with kindness, forgiveness and so on regardless if its your parent, spouse, friend or what not. And literally you have to be a saint for some of these things to be honest XD) and also how to deal/solve various business things as well as what to do in the case of a marriage proposal, divorce (basically a prenup hahah so that no side is left damaged) etc etc. I mean there is just sooo much for me to tell you in a comment on youtube :) Don't know why i replied but yeah XD Have a nice day :))

Just look at hedonistic wave in the 70's and 80's. People just want to have fun, thus productivity slumped and crime rose. This idea of doing what ever you want is very dangerous to the society.

I would actually like to think that stealing for survival (food related items), and from large corporations that could afford the loss would not be comparable to stealing from small enterprises, or from the poor, or from individuals (that would be akin to robbery). There are thieves with a conscience and those without. This is debatable.

"Rizk" or sustenance and wealth in islam is predetermined for every human being. Every person would recieve diffrent levels of "rizk" in this world. Stealing from another person's "rizk" regardless how you try to justify it is ultimately haram. Rich can't steal from the poor neither can the poor steal from the rich.

When you say large corporation u should also think that the amount of people stealing from a large organization will be more and there will be less people stealing from a small corporation. The damage will just be scaled up when u take into consideration that large corps also has to pay more employees and by the time profits triple I they have to pay huge loans and the profits are divided between many shareholders. Large corporations also don't get any sympathy from the public unlike small businesses. So stealing from large corporations is just as bad if not worse than stealing from small businesses.

@@MF-ex5xe as per Wikipedia; 10 Dirhams = 7 Mithqal. 1 Mithqal is 3.64 grams. times that by 7 gives about 25 grams. google 25 grams of silver worth in dollar and is gives about $20.

Alright so The amputation part is basically a scare tactic, that actually worked in the past. The people who got the amputation punishment *MUST CHECK OUT A VERY LONG LIST OF SPECIFIC CRITERIAS* specifically so that it's statistically very unlikely for a guy to be amputated Am I getting something wrong here? Most of the crimes in Saudi Arabia, are committed by non citizens. The population was about 40% foreigners. Foreigners do not share the customs and practices of Saudis. Foreigners deal drugs and bootleg liquor. Foreigners get into traffic accidents, by not following the proper driving procedures. But still crime in Saudi Arabia is relatively low when compared to some developed nations.

Muslims actually refer to ISIS as "Khawarij", a group of people who were prophesied by Prophet Muhammad ﷺ. Did your father know that? The thing is: Shariah law was an advanced law system in the time of its creation, but more than thousand years later it shouldn‘t be your jurisdiction of choice anymore.

you can adapt that. if you dont find exactly same crime in sunnah and Quran then lawmakers/prosecutors are free to use their intellect. so yeah only small number of high-profile crimes (death penalty for intended manslaughter, hand chopping for very big theft (like bank robbery etc)) wouldnt be changed but things related to everyday life can be changed and adapted using revelation and intellect and local sources. you can find many examples of such ruling even in the beginning of muslim rule. many courts had to come up with rulings based on mixing of local law of governed people and quranic teaching of general law to find solutions for problems.

Actually, your laws are still a new born. They are still learning how to deal with stuff. That is why you often get delayed in justice. People spent whole life for justice and don't get.

The problem with these punishments is that God/Allah can only truly know if someone is guilty or innocent . As humans we give ourselves guidelines (law) but there are many issues with it. There will always be corruption, greed, lust, ect. However, what is the reason that God/Allah commands us to do certain things but ALLOWS us to choose whether or not to follow him.Some of these previously mentioned things are another barrier in true judgment as well, along with the simple fact that we are not perfect and that goes for all of our systems as well. Long story short we as humans are given free will on earth no matter what your religion and using ‘scare’ tactics to control any population is not morally correct. We have to remember that there are outliers and that we are not all knowing and therefore do not have Devine judgement meaning it is not in our right to punish other people in irreversible ways.

@@justefi1284 no the punishment is not irreversible. People can learn from rehab or some people like murderers for example need to be away from society as a whole. While it is possible to prove if someone is guilty the punishment is irreversible even if the accused learns their lesson they will never be able to move past their mistake. And often times people have a lapse in judgment that does not represent who they are as a person. While you should be held responsible for your crimes that doesn’t mean that the punishment should be something so impactful to ones life

People may cross off all of the guidelines to have their hand cut however humans are not able to feel other’s motives or emotions so only God/Allah knows if what they did was truly who they are or a mistake caused by free will. I’m sure you’re familiar with the phrase “Only God can judge us”.

Unfortunately, people who managed to create an Islamic State have been Al-Qaida, ISIS or Iran, which belong in sects of Islam that doesn't represent the loved successful golden-age Islamic countries in the past. They were countries of Sunni sect and were not extremists. However as german author Herman Bauer says, "Extremism is a modern attitude. That's why blaming ISIS of a medieval mindset does not make any sense and it is completely false. Because the types of extremism in Islamic organisations like ISIS is only a reflection of the modern mindset on the muslims side. While in the medieval times muslims were much more tolerant and open to multiculturalism."

Cutting a hand off? In 2024?? And when we look at how Umar Bin Khattab (which was a sahaba, right?), he treated the Christians in formerly known Ash-Sham as second class citizens. Muhammad said don’t initiate a Salam to the Dhimmis, and push them to the narrowest street. And just a question, would it be allowed to criticise your religion and your prophet in a shariah ruled nation?

The one that caused the wrongly accused to suffer will get their good deeds taken away from them and put onto the oppressed. It would continue until the oppressor becomes bankrupt of good deeds. If there are still people waiting to receive justice, Allah will put the sins of the oppressed onto the scales of the oppressor.

When we bring forth problematic hadiths, Muslims are quick to dismiss them all as words of men, and tell us to ONLY depend on the Quran. Muslims will claim that Sharia is Divine Law, hence above any human laws. However, if you read the Quran and take out all the verses that deal with rules and regulations, you'd be down to a tiny fraction of the text. Now, compare that with the Sharia manuals, they are massive! Take any topic like how to pray or marriage/divorce, on which you'll find a handful verses in the Quran, but dozens of pages in manuals like Reliance of the Traveller (118 pages on prayer and 70 pages on marriage and divorce actually - that's already half the Quran's length!). Now, what do these manuals quote as sources for these rules? They will of course quote the Quran but they VERY heavily depend on quotations of sahih hadiths of Muhammad, Aisha, Abu Bakr, Umar, etc, whom are viewed as examples on what to do and how to behave. I think what people are failing to understand is that the hand chopping is the *maximum punishment. The 60+ conditions are built in mercy mechanisms. It’s there to contextualize a person’s circumstances for stealing (e.g. they’re starving). There is a long road of benefit of doubt/forgiveness before you get to fulfilling every condition. If you somehow manage to fulfill every condition, you probably “deserve” the maximum penalty. We already do this with certain crimes by creating distinctions, e.g. murder. We don’t bucket every single murder into one category. There’s 1st degree, 2nd degree, manslaughter, etc. You have to fulfill specific conditions to fall into 1st and get that penalty. Same thing here

If someone escapes hadd punishment, what would happen to them? If someone commit a sin requiring hadd punishment and they live in America for example would they have to go to wherever the judge heard of the crimes for their punishment, Can an imam of a community carry out the punishment. If there is only one of the 60 conditions found would they be punished, or does ALL 60 (or how ever many conditions there actually are) HAVE to be fulfilled If all 60 conditions are not met would the ta’zir be death penalty? If someone had to get their hand chopped off, do they actually have to feel it?

this video is a very good explanation about hudood. the west only preceived sharia as a punishment but as a matter of fact sharia consists of three values. i do hope alot of people share this valuable information, to the westerners and to all muslims. sometimes people are too ignorant and read the context as it is without properly understanding the meaning behind it. it's easy to hate, but it's hard to understand when your heart is full of hatred towards islam. the media is blowing things out of proportion and only showing one side of the story, cnn, al jazeera, bbc, fox those are a few media outlets that promotes islamophobia. in my personal opinion, we as a muslim should teach them and explain to them not just about the hudood and the sharia, but the way islam is supposed to be. may Allah save us all from hellfire and let us pray that everyone is given guidance.

@@apartahotelsmadrid375 i'm not from the west nor am i an arab. it clearly stated that if all 60 requirements are met then it's a clear decision. also again, i emphasize it is only to strike fear in the minds of criminal so they won't commit heinous crimes and the public as well so they would think twice before doing any petty theft or crimes. another thing, what you referring to is hudood. there is no such thing as sharia law, sharia consists of 3 component aqidah, fiqh and akhlak. what you referring to is the hudood. if you don't like it, it's your choice. this video is just an explanation.

@@savedchristian4754 Allah is all forgiving, not humans :). Human's are in no position to judge one's sins unless they're apparent but it is God given responsibility to uphold justice in society. Sure if you steal something, God will forgive you and spare you the hellfire, but whilst still being alive, you're still getting amputated by humans. Otherwise other people will keep stealing and it'll be a straight up injustice to the victims of robbery. Hope this clears things up, maybe next time use your brains.

The issue here is who decides? You can have a list of 1000 checkboxes that would all need to be checked before a hand is amputated, but what good is 1000 checkboxes if the people holding the power and the authority wish them to be checked? Also, theocracy is what you want. There can be NO alternative but Islam in many of these countries. Some of these countries have a right to do this, but there are many where the people do want some degree of separation between church and state. When I find videos online of Islamic countries amputating hands and feet, I have zero trust or faith that they checked these 60 boxes and you would have a very hard time proving this.

Sharia law is against humans rights. Torture is abolished but sharia offers a chance for it. Whether the thief deserves it or not courts are not always the right interpretation of the truth. Besides corruption and other aspects could sentence someone to get their hands cut off. In mosts western countries, law and prison has a rehabilitation purpose. The person should learn the ways to be a good citizen and go back to society. This is why sharia has no place in western countries.

Under Sharia the punishment for theft is cutting off of a hand. Why did the person steal? Most people steal food when they are poor and hungry. I'm not defending this religion nor this horrible punishment Still fear of punishment is essential in societies all punishments are basically a measurement for those who wanna see the world burn and don't follow a moral system that has" common basis with everyone's systems around them" to achieve social harmony and wellbeing for those Monsters, something scary like jail for example will be an essential punishment for our and their safety.

Yes which is why Islam firstly teaches it's followers to not commit crimes. If after education they still do not abide by laws then it is only fair that due measures are taken against them. Get over it. There is no ideal place where no one commits crime. Fear being instilled is sometimes necessary

Im sorry but i have to disagree....instilling fear on community doesnt make them obey to rule but it makes them trapped in authorative government. It doesnt discipline their mindset or morality. Even this capital punishment can be used by ruler to inflict harsher agenda on their subjects, preventing anyone to critize them If anything i agree for less brutal such social labor work or asset forfeiture Sharia law also using holy god word as its base and only chosen clerics have mandate to representate its law. Means that they can deliberately apply it for their regime, not for people. And again because its gods word, and no one can dare criticize it or change make it irrelevant for modern secular multiethnic muticulture society

However, if you read the Quran and take out all the verses that deal with rules and regulations, you'd be down to a tiny fraction of the text. Now, compare that with the Sharia manuals, they are massive! Take any topic like how to pray or marriage/divorce, on which you'll find a handful verses in the Quran, but dozens of pages in manuals like Reliance of the Traveller (118 pages on prayer and 70 pages on marriage and divorce actually - that's already half the Quran's length!). Now, what do these manuals quote as sources for these rules? They will of course quote the Quran but they VERY heavily depend on quotations of sahih hadiths of Muhammad, Aisha, Abu Bakr, Umar, etc, whom are viewed as examples on what to do and how to behave. Were these people "divine"?!

*_Who would want to live in a society where the level of mutual trust has diminished to the point where extreme punishments are threatened?_* This is the kind of law that from an evolutionary perspective would be expected from any region of the world where resource scarcity i.e. desert regions incentivizes desperation and subsequent aberrant behaviour. We humans can do so much better than anything that has gone before by leveraging science for human concern... We can only truly begin to call our societies *_"civilized"_* when we no longer need to use the threat of punishment as a deterrent to aberrant behaviour.

There is no justified act in cutting hands no matter what this person did before, evene if this person every person who I loved before, there is no less pain when this killer died or stealing something. Cutting hands belongs to sharia the same as like death sentences. Both are wrong. There are no exceptations to accept no matter how you try to explain it. Let them put them in jails and thats it.

1# stoning is not in the Quran it’s in Hadith and not all hadiths are accurate. Second stoning is in the Bible and Torah. Chopping hands off is also in the Bible.

Weather they are difficult to implement or easy is not the topic, if they are too difficult to implement then, obviously different judicial system should be implented, weather 60 condition are to be met or 4 conditions, just state what Sharia is if this is the topic. Why wouldn't you act upon it?! Heterosexual people act upon their urges, and so do homosexual. Homosexuality is found in over 1500 species of animals on Earth, some much more than human. It is normal for small fractions of population, always has been, but some religions have issue with it. Do you see heterosexual couples having sex? @@ziyaulansari2759 are you that simplistic? Stealing is wrong, yes.. but their are a lot of different (subconscious) things that influence the behavior of people. Medieval punishments does not make people stop bad behavior (probably they will continue their behavior, because without the hand, it is harder to get a job, so they continue stealing). Just wondering why Allah punish people this way? Why not try to HELP en FORGIVE the person? And no I am not a burglar, but have studied criminology 😉

Under a caliphate it is mandatory. It is considered divine and the final interpretation of the Quran and hadiths, the scholarly consensus - the Ijima - and Muhammad said that whoever dissents from the Ijima, departs to hell. Seems materialistic to me, material goods should not matter more than human body. Why not just make them work and pay back what is stolen with compensation? So if you steal $10,000 from me, you have to pay me back $100,000. If you cut off someones hand, they are unable to work and pay back the person who they stole from. Also, crime is not ballooning in modern world. Homicides are at much lower level than they were 100 years ago, and 100 years ago they were at much lower level than 200 years ago.
