Welcome to our new segment - USAPANG MANA with me, your host, Atty. Raymond Batu
Dahil sa dami po ng katanong regarding usapang mana, minabuti ko gumawa ng isang segment para dito.
Pag uusapan natin sa segment ng USAPANG MANA ang mga bagay na may kinalaman sa SUCCESSION both testate and intestate succession. Pag sinabi po na testate, may last will at kung intestate, walang last will. Ang law natin ay civil law on succession .
Dito natin malalaman sino sino ang mga heirs, o heredero o mga tagapagmana at malalaman natin paano ang hatian nila. Pag uusapan natin ang mga legal technicalities at samot saring problema sa hatian ng mana, last will, at marami pang iba. So stay tuned dahil ang segment na ito ay maraming ibat ibang video lectures.
Sisimulan natin ang pinaka basic. Sa usapang mana, unang malaman natin na ang namatay ang tawag nito DECEDENT at ang naiwan nian property ang tawag nito ESTATE. So ang estate of decedent ay ang ari-arian ng namatay.
Ang mga heirs depende, meron tayong descending line na heirs [pababa], may ascending [pataas] at collateral blood relatives at compulsory heirs.

Atty now ko lang nkita vlog mo. Kht pa 2hrs ang vlog mo hndi po boring.. npakaganda at linaw po ng paliwanag mo. Savi ko sa anak ko ifollow po kayo kasi 3rd year college pol sci po sya, mas madali kpag meron ganito npapanood lalo at npaka clear.. hndi nkakaantok. Meron ako iba pinanood after ko mpanood video mo po bale 4 kayo, 2 lang po kayo ang tinapos ko ang video at ikaw ang pinafollow ko. Meron pa ako iba pinanood video po po, yung sa ROW, saka yung pag pagawa ng titulo, at pag acquire ng land government sa private property for public use.. npaka ganda po ng ganitong vlog.. kht hndi ka nag aaral ng abogasya may alam sa batas kht hndi nkpag college very useful po vlog nyo..God bless po atty.

Thankful ho ako na makita itong channel nyo. Ask ko ho ano options kung ang illegitimate child ng late brother ko, based overseas, ay di cooperating dahil na rin sa utos ng mother nya dahil ang gusto nito ay bilhin nya ang lote which hindi ako pabor. Pag transfer ng title ang plano, di ang ibenta ang pundar ng magulang ko. Salamat po sa maging tugon.

sa dami kong napanood tungkol sa legals issue dito ko natagpuan napakalinaw mag explain may example pa kaya matutunan mo talaga. tamang tama kailangan ko topic na adverse claim at napanood ko na this vlog kasi meron mamanahin father ko na hindi sya pinartihan ng mga pangalawang anak ng nanay nya. at yung personal namin mag asawa kasalukuyan nagpagawa kami sa lawyer ng extrajudicial settlement with partition. then yung share ng parents inlaw ko e waive nila at idonate saming mag asawa. tamang tama topic na ito may idea na kami at napanood ko rin yung adverse claim ang linaw. thank you atty napakalinaw nyong mapaliwanag.

Atty. Good day po..ung scenario po namin sa family ng mother side ko is 1. decedent na po ang Lolo at Lola namin... 2. Ung mga anak nila which is our parents were all dead 3. Ang natira ay kaming mag pipinsan.. Question po is paano namin hahatiin equally ang estate ng lolo namin? A. Through succession of each of our parents po ba? Or B. direct sa aming mag pipinsan? On our side din po kasi ng mother ko ay illegitimate child po which is my step sister at parang binubully po siya ng iba naming pinsan.. Sana po ma tugunan niu.. Hi Atty. Meron po sana akong tanong. When the Decedent died, he have multiple estates. These estates were then divided among his heirs (spouse and children) through extrajudicial settlements. One of the estate(an 8 ha. lot of land) were divided to his Spouse and 2 children. The rest if the estates went to his other children. My question is, when the spouse die, who will be the heirs of her part of the estate?

Hello Atty. One of our great grandfather has no heirs and our family is the only heir but the thing is we don't have a death cert nor birth cert, The municiplity is asking us for proof of relationship but we have nothing to show.. any advise?how we can get his death cert or birth certificate?
