Today we're going to be discussing nasty financial surprises for divorcing women. It's a riveting topic, you guys really exciting stuff. And I have two amazing ladies with me today. I'm joined by Laurie it can she is better known as the options lady, and she is a certified divorce financial analyst.
I see that a lot in couples, there tends to be an assignment of duties in terms of financial. So it's really common that one spouse is better at filing taxes, better handling the bills and utilities better about planning for retirement. And the other is more perhaps in the caretaking role. And it's very common that folks will match up and not equally share the burden of all the financial management. But this proves really dangerous in a divorce situation. The person who is intentionally staying a little bit less involved has to re up and get re educated very quickly.
When you're going through a divorce and Anna knows this, the last thing you want is a financial surprise. And so we found that over half are not quite half the women had experienced financial surprises. What was even more interesting is that of the women currently going through a divorce. Almost 60% of them were currently experiencing some sort of financial surprise. So what I thought I would share is as a CDFA. As a certified divorce financial analyst I meet with men and women as they are going through divorce often I work for just one party, sometimes I've worked with a couple, and the women who I meet with and this is going to be relevant to California.
The first surprise is that women are absolutely shocked at how much marital debt they have. That means I know women knew they had a mortgage had no idea they had a second mortgage on the home or a home equity line of credit. They didn't even know the level of student debt for themselves, their husbands or even their children, if their children were going to college. totally unaware if the husband had taken out a loan from the 401 K or credit card credit cards. Yeah, and so when you're getting a divorce, you have to disclose all your assets and debts. And people are constantly surprised about how much debt they have. Because, you know, we see people in very expensive homes, they're driving nice cars, they have nice clothes, they go to nice activities, restaurants, the restaurants are full. So that's the first not being aware of debt.
The second really nasty surprise is we found that only less than 10% of women were able to continue to be stay at home parents after divorce.

Kids are not "plastic" or resilient when it comes to their parents splitting up! It was the worst experience of my life, especially leaving my childhood home and the support I had from my neighbors and school! SMH!

These lawyers are good, but not very sensitive to feelings of children & spouses who love with their whole heart in a marriage! They're intelligent but a little heartless!!!

I don't agree that sexual infidelity has less impact than financial abuse. Say you are the faithful spouse and you end up with child support for a illegitimate pregnancy or even STDs. Both types of abuse suck.

Kids are not reslitiant as a junior in highschool when you are forced to sell their home and start a new highschool. Grades may go from A to D's, and they are always mad at you , start staying out and arguing all the time. Lies lawyers tell you. Unles your children are in the 4th grade below, your kids will react to the changes for awhile.

Thank you for the financial discussion about divorce. More good reasons to be very certain about choosing and vetting the right person to be my spouse. Good to discuss an exiting strategy for leaving the relationship before a serious relationship starts. Love the comment comparing condoms to prenups.

I don’t agree either than sexual infidelity has less impact than financial abuse as a state before here, money comes and go but the damage in your health, physically and emotionally….. is terrible! You are right they should treated as a criminals if they still money from the other spouse, not because is cover and done to a person is not stealing…..we need better laws and better justice!

Are you actually kidding that women going through a divorce do not expect that they will need to work once they ditch their husbands? Are people so stupid these days that they have forgotten why marriage is such a great idea!?!?!? I would have liked to believe that anyone choosing a divorce would have thoroughly investigated the implications of that and it is saddening to hear that 60% are surprised by these very basic financial issues in a marriage. And all this when women are heavily favoured in the US family courts. Maybe that's the problem, women are so entitled now they think they will walk away even better off than before.

As one who did not expect a divorce, I did not expect all of my retirement, savings, and other funds drained. I'm 70, what do you suggest that I do for a living? I worked and contributed all of my life. Surprise, surprise.

These women make it look like the woman has a rough go in divorce. The laws and the judge will all favor her. As an example, I tried to remove my divorcing wife from our car insurance. They told me I am responsible for her bills until the judge signs the decree. I was not allowed to drop her from the policy. The judge allowed her to take whatever she wanted fom the savings accounts, if I took anything, it was deducted by my home equity. The judge says she needs it for milk for her babies. The judge gave me 100% of our credit card debt. She was cleared of all of it. The judge said I would have paid it all anyway. Such a deal the female gets. All men should know the truth about how unfair a deal men get in a divorce. 80% of divorces are filed by women. They get a better deal by the judge everytime. Men are finally saying NO to this marriage crap. She cheats but then gets alimony..... what a deal.

Also, if your spouse is a narcissistic lawyer …..the end is bleak, litigation is complicated and forensic costs add to the costly divorce. What do you think of contempt of court in divorces? What is my chance of prevailing with this contempt? What can you say about a spouse concealing assets? How to find hidden assets? Please comment. Thanks

It is difficult to hide assets. The tax return often includes clues. Also, if your spouse is a lawyer and works for a law firm or a company, records can be requested by subpoena. If he is self-employed, you will need to get the personal tax return and his business tax return. The business return will need to be examined to see if personal expenses are being run through the business.

Thank you. He controls 49% of his law firm. Wage garnishment orders were ignored. Contempt was filed against him and the firm could be next. We finally received some docs but incomplete. My forensic accountant still needs more to figure out the firm’s cash flow etc etc.

I don't know what state you live in but in California when you get divorced each spouse must disclose all assets and debts. If you believe the other spouse is not being truthful, you can ask your attorney to engage in formal discovery.
