Phuq nintendo ! I have all the gameboy, nes, snes send n64 romz, and when I'm done downloading all the gamecube and wii u romz, i will focus on getting ALL the 8/10 and above switch roms ! The gaming industry has 0 scruples, 0 moral, 0 respect for gamers, and are manipulating and stealing hundreds of billions from gamers, via $20+ 'micro' transactions, season passes, lazy-ass dlcs. shameless 'buy the $110 version to play 24 hours earlier' versions, etc etc. Gamers should also have 0 respect, and should be downloading and playing ALL the roms that exist today!

The whole point is to sell re-releases for every new generation of hardware. I've bought Super Mario 64 about half a dozen times at this point. They're copying the Disney Classics strategy verbatim.

​@@TwoTreesStudioI didn't even have a problem repaying for an old game, so long as the price was right for what I was getting. What I've got a problem with is losing that content. I bought a handful of games for my Wii U, Ducktales Remastered among them, and I loved that game as much as I loved the original on NES as a young teen. But with there being no easy way to manage games, and stores closing, you end up losing your games. Which of course works well for them, since they just get to charge for the same content again.

@@TwoTreesStudio I do not disagree at all. It should be illegal as it essentially boils down to theft. But that's what those EULAs do: they basically make it so that one agrees to God knows what in all of those pages of legal speak.

Emulation will never go away. Nintendo would have to go back in time. The genie is out of the bottle. Even if Emulators were outlawed, Nintendo would be breaking the law as well. Many companies use Emulators for ports. NSO is built around an emulator.

They cannot, reverse engineering for the purpose of homebrew is allowed under assumption that such homebrew did not exist or isn't permitted by the mechanism and checks in place. If a homebrew software, that was running on the hardware earlier is now reduced to no functionality, measures to circumvent such check/mechanism is allowed. Neither can dicksendo outlaw emulators (their snes mini is running an emulator itself) nor can it prevent a bwitch mod that allows homebrews to run on the system. There may be additional accommodation for outdated and discontinued consoles that suffer from this.

DRM almost always gets cracked. It ends up only hurting the people actually paying for the game, and gives the people who pirate the game a better experience.

lmao. Let me tell this. It's not impossible. It just take at bit more time than before, but games are still getting cracked, also gaming companies are so damn greedy they are unwilling to pay for the service of Denuvo beyond the 1st few weeks of release. The reality is. Paying Denuvo is just wasting money that hurts the buyers more than the pirate themselves since they gonna more often than not a better running games because Denuvo DRM is just a damn plague to PC's @@LordSandwichII

Even rhythm games tend to use Denuvo these days, and while I am no good at rhythm games myself, their discord is full with videos of otherwise Perfect scores that were lost to denuvo's constant lags. Screw Denuvo, if Nintendo pulls through with this threat, I might just start to pirate their games as a means to spite them.

Denuvo better start praying when Starfield drop. People already has confirmation that denuvo cracker already set their aim on it. So if they really did put a denuvo in it, the one who crack Dying Light 2 ( previously proudly claim by Denuvo that is uncrackable ) gonna make Todd roast Denuvo to well done.

As a Nintendo fan, I very very much support piracy of older Nintendo games, as it gets tougher and tougher to as well as more expensive. I am not happy with the way they are going.

I support emulation and piracy too. There should be no reason i cant load up my switch and purchase a copy if say pokemon crystal or pokemon soul silver... they disabled the 3ds eshop too which is mind blowing. These older games cost upwards of 300$ sometimes.

Same. The switch is an odd case because it's still a "current" gen console. I can understand Nintendo not wanting to divide their fan base like they did with the new 3ds, but at the same time the switches age clearly shows they need new hardware. I laugh when I play Xenoblade Chronicles because I can hear and feel the fans on my switch going into high gear.

Everyone: Make your legacy content available for purchase on eShop. Nintendo: No. Everyone: Okay. Then we'll emulate it. Nintendo: That's illegal. Everyone: But if you let us buy them on eShop, we won't emulate. We only do this because you don't make them available for purchase. Nintendo: I missed the part where that's my problem.

The only thing Nintendo actually wants here is control. To do that, they want to stamp out every single alternative pipeline but their own means and the third-party online resales which they indirectly benefit from by causing the prices of their games to appreciate. Going by their love of artificial scarcity, even making their games scarce and not buyable is all part of the plan, since they see scarcity as a tool to raise demand. Nintendo wants everything to play into their hands more than it wants its own games to be strictly available or to reap profits from them. When they control the prices of their back catalogue, they can better offer it for purchase again and again, and essentially take advantage of the fact that they’re the only option people can turn to other than even more expensive online resellers. It’s no wonder they hate emulation for granting people a convenient, simple alternative that works for everyone, improves game performance and bypasses all their manipulative marketing schemes.

Yeah, I'm not convinced at all. I think they're assuming that every single torrent download of Game X is a lost sale when doing the math, which I think is probably far from the truth because I think they're vastly underestimating the amount of people who simply wouldn't have played the game at all if they couldn't pirate it - there's probably nearly every gamer in the entire third world, gamers in places where "everyone does it" and the authorities DGAF, e.g. the balkans, people who pirate the game to try before they buy (but maybe that's less common with better refund policies these days?) who might've even bought the game since, there's straight up thieves and whoever else I'm forgetting. Subtract all of those from the number of times Game X has been torrented and the number might approach the actual number of potential lost sales. I suspect the real numbers aren't nearly what the DRM industry would have you believe, but I think it would be difficult to know for sure either way.

(Buying from another individual is legal for some reason, but if you don't pay money suddenly it is illegal despite the company getting none.) Old releases get pirated more. Given how far off we get data for "pirating" it is possible the numbers aren't even 10% of what they claim.

I know hard-core collectors who have thousands of games from the past 30 years. They prefer to play on emulators. It makes sense to preserve your original copies. Discs get scratched. Batteries die and ruin games. Cartridge pins get scuffed.

Unfortunately this really is how game companies and the law see it. If we look at the terms of service of any software, we’ll see that what we downloaded/bought isn’t the game itself but a limited license to use the game that can be rescinded by the publisher. From their POV, we don’t own the actual game. This is how big game companies feel they can exert so much pressure over our access to their games. Perhaps comparing piracy to trespassing is a more apt comparison than the often-used but heavily flawed “theft” comparison. Video games are intellectual property, and we’re all tenants on that property hoping not to get evicted. Nintendo in particular is one of the most publicly abusive IP landlords in the video game industry.

We’ll stop emulating when Nintendo makes it easy to legally purchase their older games without a subscription and without worrying about them being stuck on the previous iteration of the e-Shop (see: everyone’s Wii U/Wii/3DS digital purchases.) Let us buy and keep our games, we’ll talk, Nintendo won’t do that, ergo, the battle continues.

I don't disagree with the option to purchase their older games. But in a world where we are constantly told that we don't own the game, and only own a license to use it, buying it outright doesn't fix the problem either. As for the subscription service, for $80 a year for the best tier to share with 8 people, that's a pathetically low price that even in a best case scenario gets you eight $10 games for purchase. Or it gets you and seven others access to hundreds of games that you might not ever try otherwise, or simply might not bother to buy again. At the end of the day, options for the customer is the best bet.

I would be a lot more sympathetic to Nintendo if they just kept the virtual console on switch. When I first saw that on my Wii in 2007-8, I loved it. At that point I was confused as to why companies didn’t embrace selling their old roms to wanting customers. Emulators were super common in my school, and It seemed like the obvious answer to “piracy” and Nintendo was (at the time) ahead of the pack (what happened). I will pay extra for convenience and was all for it. And it was eeeaasssyy. No upres, no remaster, just the standard game that people worked on decades ago that people are still willing to pay for. I loaded up the family Wii with sooooo many roms from that shop, for $5 a pop, super reasonable, and we had a lot of fun! Shout out to the tmnt games with a bunch of people :). Why they won’t support that nowadays is beyond me.

@@alicevioleta3184 I hear you and you’re not wrong in masse. I just wish there was an option for both. Like, everything on Disney plus can be purchased separately, even if you may have to wait. But that’s for new content, we are talking 20+ year old content. I get the discounted 1yr switch online for like 20$ a year, that’s like $2 a month, but spent way more than that on roms for Wii per month. Maybe for most people, it gets more out of them, but I’m like…literally asking Nintendo if they would want to have more of my money for 20+ year old shit that doesn’t need any work, and they, a publicly traded company are just like…nah fam don’t sweat it.

Hacking and modding my switch to dump ToTK and play it on my PC was a really rewarding experience for me. I get 60 fps along with other graphical enhancements, the difference is massive, and it's entirely LEGAL. Never done anything like it before, and I suggest others try it as well.

I intend to at some point, but I want to upgrade to a newer switch before I attempt. 1. In case I somehow screw something up in the simple process and brick my switch ( I have a gen 1 switch). 2. So I can still enjoy their online service ( emulators), and E-shop without fear of being banned.

Funnily enough, you might be incorrect about that not being illegal. The elements that make emulation legal are only in works with intellectual property that are not pursuant to patents. It's a lot of background information, but the gist of it is that the case law that makes emulation legal only applies when patents aren't being violated, so at the very least for the case of Tears of the Kingdom, where Nintendo filed for many different patents, that game might be illegal to emulate. Although case law for this matter is a mess to parse through if I'm being honest.

@@overused6632 I'll give you an example of a game from my childhood that might help you understand: There was a video game series Disney tried to make called Spectrobes early on in the DS' life cycle. Got a couple sequels but didn't really take off. Game is roughly 20-ish years old at this point now. Only ways to play it are buy a physical copy off some weirdo who looks like they might price gouge you/sell your organs on the black market or sail the seven seas. That game is no longer commercially available anywhere outside of a random backwoods Gamestop 50 miles away from the nearest residential area unless Nintendo ports it to the Switch at some point (which I doubt). You might be wondering if there would even be an "audience" who'd play a game like Spectrobes but that's part of the point. Nintendo probably won't port it over to the Switch at any point because there probably wouldn't be a big enough audience. That's where emulation steps in. Emulation prioritizes that game still being able to be played long after the cartridges for the games fail, even if there is only a few people who'd ever play it. Why? Because it's important that the game still "exist" as a part of "history" rather than fade away. As for the stealing bit, I'll leave it at this very simple viewpoint: I can't buy Spectrobes from any official sources (Disney, Nintendo, etc. except for maybe some random Gamestop out in Bumf^ck Nowhere). Nintendo, Disney, and so on aren't making money off the game anyways and none of them would ever bother to remake or port the game over. It is the definition of "abandoned." Unless you're a weirdo who stands on "principle" to the Nth degree where you'd literally get a IRL game over instead of "stealing" abandoned stuff, stuff that's been abandoned is a bit less questionable in my mind to sail the seven seas over.

Nintendo has always hated not having full control over how you play. They once went after blockbuster for game rentals in order to force you to buy the game. They once tried to stop the 2nd hand market to foece you to pay full price. Now theyre going afyer emulation. This happens a lot with them.

Man, once you mentioned Denuvo, my teeth stitched because that instantly reminded me of Sonic Mania situation. When Sonic Mania came out, it's executable was over 100 Mb. Later, because of the controversies, they removed that useless DRM and... Guess how much Mania's exe weights now? Just below 4 Mb. Not only that, the game was performing worse on weaker devices, especially on the intro and ending animations, but after the "Denuvo Remuvo" even the ending cutscenes ran like they should have.

The other thing to take into consideration, the vast majority of emulation are done for games that are no longer being sold in major retailers anyway. So legitimately, WHO CARES. The fact that these major corporations have this much time on their hands to attack people, which the vast majority of people that like emulators are those that are just wanting to play Mario Kart 64, OoT, MM, maybe up to like GameCube games like Twilight Princess, y'know the titles you basically can't get anywhere else now because they're over 15 years old, is genuinely shocking and there's no other motivation but greed. If a company's focus is ever put on attacking their community, rather than bringing out new titles that people can buy and enjoy, then the company has lost all sense of their values and their company purpose. It's no longer developing games, it's just hoarding intellectual property.

It's a tough argument to make in some cases, because as you stated "hoarding intellectual properties". Might mean at some point they could plan to use said property for a re-release or their online service. What really gets me is why Nintendo of late has been doing "limited" releases of their older titles and making it harder to get. I truly did want to buy the 3D all stars collection just to play some Mario games I have never played before, but I held off too long and now the only way I can obtain a copy is to pay Jim Jimbob $100+. I was lucky I bought the Fire Emblem game right away. Then there was the DBZ game they only gave out for pre-ordering FighterZ lol. Even though they could easily list these games back as digital on their E-shop they have not.

I bought TOTK and have almost exclusively played it on my Steam Deck. Even applied some mods to it. I can only hope one day Denuvo gets ripped wide open or otherwise just fails outright. They're truly awful.

I'm glad you touched on Denuvo causing issues in games. SMT 3: Nocturne HD Remaster for PC comes to mind, virtually unplayable due to Denuvo causing crashes and freezing. I hope that Sega/Atlus fix, patch or remove it as i loved SMTV and it would probably solve 90% of the crashing issue. Also thank you for your technical tutorials.

It's interesting to see an anti-piracy company using AI art. I'm frustrated though about the "monetization" of the internet though. We've heavily pushed back against monitoring of the internet designed to catch pirates and put them on the same group as terrorists and child predators. We've been against paywalls on site, but it's disgusting that we have different standards on smaller creators like Onlyfans creators in twitter advocating willingly turning on DRM for their videos to "you're not allowed to share without giving credit to the owner... not just a short CTTO, but you actually have to name them". What's next? Every share should have monetary compensation to the creator? We just created the very thing we're trying to stop from larger companies.

It's not weird for nintendo to use AI art, they don't care about morals or what is right or just, all they care is about their bottom line. Most likely the reason they don't want you to emulate even old games, is because they may want to sell you a "remastered" (upscaled via emulation) version of the old game for 30 bucks for the switch or whatever console they make money at any time.

the better ideas are a) bring back virtual console because nso has no gaems and you don't even own them b) make a better sale than 15% off once in a while c) add games to nso like xbox game pass d) have regional pricing because (while russian eshop did close due to current events) i am not sure russians (and other countries where the average wage isn't quite high, i use that example because i live near russia, sorry) can afford to buy virtual entertainment for 6000 roubles (roughly equivalent to 60 dollars) because they don't quite make that much money (except in places like moscow i guess)

What's going to be real interesting is when Denuvo gets totally done in, by AI of all things. See, from what we understand of cracking Denuvo is cracking it itself is not hard, how it works has been understood for some time. The issue is cracking it is extremely fucking tedious, and every new version makes it more tedious. We know for a fact that Denuvo follows specific patterns, they just have a lot of dead ends which makes the process time consuming. It becomes mind numbing, even Empress who is one of maybe two people/groups who still reliably crack Denuvo games has made comments about it. But, say, a machine learning algorithm made specifically to comb through Denuvo protection? Tedium isn't going to be a problem for that. It's probably just on the horizon at this point, and probably an inevitable tool that scene groups or rogue crackers will end up using. The irony of something funded by these big ass corporations being used to circumvent their protections is great.

I haven't seen others mention it, so I'll say it. Where do these companies get the idea that their sales increased because of DRM. There is literally no way to verify that. Like, do they think people who were gonna pirate the game are suddenly gonna say: "Aw shucks, guess I'll have to buy it this time". Seems highly improbable to me. That "successful piracy increases their top line revenue by 50%" has no basis and pisses me off.

A lot of tests about "Denuvo vs cracked games" need to be redone with the Steam overlay turned off. The cracked version doesn't have it, obviously, but most people forget or just don't think about disabling it and when the CPU is the part responsible for the FPS drops, disabling Steam overlay can provide a great improvement in performance.

I remember when Skyward Sword released, Wii emulation was really starting its upswing and a lot of people just decided to play it through Dolphin -- even legally, just by popping the game disc in their computer. Nintendo's own press screenshots showed the game running natively at 720p, which the Wii itself obviously couldn't do.

Nintendo has never had an issue with emulation as a whole, and as a technique-it’s just independent emulation of their games and consoles that hasn’t been sanctioned by them that they dislike. For them it’s not about the act of emulating, but the alleged act of infringement that removes the absolute control they would otherwise have over their own games and systems. I don’t agree with their stance on emulation, and I don’t believe that emulation is illegal. I myself have emulated old Nintendo games, and I really do want them to make their back catalogue more accessible. But I do think that they’re not inconsistent in what they believe, just that their logic is of course relentlessly greedy and corporate.

In the case of Resident Evil Village the poor performance was due to Capcom's own DRM they implemented. I'm also not convinced more switch piracy occurs from hacked switches than from PC emulation although there are no stats to prove one way or another.

why would you be nervous man?? TONS of ppl got hacked 3ds's. Nintendo can suck it for removing their store. Just dont upgrade ur 3ds and never go online

I turn on my modded 3DS to use Pokebank for transfer, suddenly it's not working. I wonder if it's because, I redownload Pokemon Go, and I allowed access to my photos/videos, some of the photos and screenshots are 3ds related stuff. 😅.

especially when nintendo releases ports or remake of games that are over 10 years old at full price (wii u, wii, ds, n64, snes, etc), and their subscription paywalls for retro games

I don’t think it was emulation that was made illegal in Japan, but offering console modding and save editing services? It’s possible for Nintendo to still have had a hand in the creation of the law though.

I wouldn’t be surprised if they really did lobby or otherwise push for the creation of the law, given how strongly they feel about protecting their own IP and trade secrets. Neither would I be shocked to discover that they weren’t alone in this respect. In the USA, Nintendo and the larger organisation it’s part of, the Entertainment Software Association (which counts many large digital entertainment companies among its members), have also done a lot of lobbying for stronger IP protection and anti-piracy laws.

Yep I totally agree. This is more affecting the customer. Some people there are getting a Lidget on the switch and they call some performance issues or either of may not, but it just sucks in general.
