The plaintiff says he put down a deposit on an apartment, but less than 24 hours later, he had to back out. He claims the defendant won’t return his deposit, and he’s suing him for the money, plus pain and suffering. The defendant says he made it very clear that the deposit isn’t refundable, so he won’t budge.

It appears the dates were added after he signed, but he didn't say this until after the verdict.

I think the Plaintiff was trying to say that was an application... the application has to be approved first for a lease to even be presented! I could’ve swore at the end judge stated “even if there’s no lease etc”. Applications may have fees but usually don’t require a “good faith” deposit... (he said he gave that of his Own volition NOT because it was required or noted in the paper he signed). I feel like that document was saying the APP fee is nonrefundable. And prolly didn’t mention ANYTHING about a deposit requirement. Application approval prolly was the 03/01 or THAT was his preferred move in date/availability (you know how you can check the box for immediate move in) the Real Move in Date was def 04/01.

The defendant came across as dodgy to me the moment he walked in and was pushing the judge to make a decision right away because he didn't want to answer to many questions incase he slipped up. I believe the plaintiff really did think he was signing a credit check, his bad for not reading it before signing.

I disagree it's a cause where is not just verbal agreements where you can simply argue your point. It's a contract, one look at the contract and she could make a verdict she didn't even really need the defendant in the room.

The defendant was irritated because he had to even come to court a case like this should not be able to be filed he signed a contract and then wanted to back out of it that's not a lawsuit he should be fine for taking up the court time with this ridiculous lawsuit

Unfortunately the plantiff signed the leasing agreement which locks him into a certain date and times of occupancy. Easy case but I feel for his disability.

For me it is an open and shut case. There is literally a signed document that he agreed to the terms. I don't know why people are saying the defendant is shady. What did he do wrong? That is the whole point of a deposit. To reserve the apartment for you and they then take it off the market and miss out on other potential tenants. Alternatively you give no deposit but then don't be surprised if you lose it to another renter. What would be the point of the deposit if you get it back when you change your mind? The defendant could be kind and give it back if there was a valid reason for changing your mind but there is no real reason that they should. A valid reason would not include the fact that you found somewhere that you like more.

What it sounds like Mr Sanchez signed a blank paper and Tony filled in the blanks. There is a reason the owner didn't have his manager there. He probably knew of this fault.

Normally I agree that the plaintiff is wrong, but it was Feb 27th.... there wasn't anyone else in line trying to rent that place. They weren't going to get it rented .... it hadn't rented all of February. He did not cause the defendant to lose any other potential rent.

So for ppl who don’t understand- on a rental application it does ask for a projected move in date. Clearly this APPLICATION (cuz what lease is one page) said March 1. That doesn’t change the fact that the lease may have been dated for APRIL 1st, cuz I can want to move in next year but if that’s now when the lease starts then so be it.Too, the plaintiff said the lease started April 1st becuase the apt was not ready, not because of fault of his own, so when the landlord himself said he had someone move in APRIL 1st that should have been a red flag that lead to additional questions regarding condition of the home on March 1st because if we want to stick to that date of the 1st I’m assuming the home was not move in ready.

Unfortunately, the plaintiff cannot read or the defendant played him into signing a contract. Either way, you must read the contract before signing. The defendant was quite cocky tho.

It wasn't a few days--unless it was leap year- it was ONLY one day. There is no way that he'd be able to move in one day. They added the date later. And the landlord rented the unit in April...no money lost. For their DECEIT he should have got his money back.

The judge getting on his case for being “arrogant” pisses me off because he’s right why bring a witness when there’s a literal document he signed showing he agreed to the terms and she’s making a big deal on it 😂 idk if she was just tryna make a fool of him or what but the defendant literally had this case won 100%

Uh, no. Just... no. Probably the single dumbest statement I've seen on a People's Court video. When are you and people like you going to realize that when you sign a contract, you're fully bound by it? NOBODY ever has the right to feel buyer's remorse and put the seller in a bad situation by reneging on the deal. Your statement clearly shows that you take no one into consideration but yourself. Very selfish to expect a grace period of ANY KIND when you just signed a flipping contract.

@@XX2Media There are lots of contracts you sign that allow you to change your mind within a certain time frame. Example when you buy plane tickets you tech are in a contract with the company but usually as long as the travel isn’t within a week you can void the ticket/contract within 24 hours if you purchase on the weekend you can cancel by Monday 12am.

4:27 Arrogant, WTF!!! There's nothing arrogant about not bringing his employee to this BS case where the Plaintiff signed a contract. It's an open and closed case, all the paperwork is in order. This is one of many reasons why I don't like this Judge!

The reason why the judge said it was arrogant of him was because he shouldn’t have been so confident that the judge wouldn’t need his employee’s testimony. You should bring every piece of evidence with you to court even if you think it won’t be needed, that includes witnesses. You don’t get to pick and choose what evidence to bring.

Also him arguing that Tony told him it would be March and not April that's completely his fault even if Tony did say March don't blame somebody because you didn't thoroughly read a document that you signed if I went to sign a document and I noticed that there was a completely different month than what we verbally agreed on I would tell the person you need to change that or I'm not signing it and if they didn't change it they wouldn't get my signature nor would they get my deposit that simple.

they scammed him. this is a well known thing they do. it's a one page APPLICATION (sometimes they tell the tenant it's for a credit check) & the prospective tenant puts down a "good faith deposit" (remember now, a good faith deposit is not a deposit, it's an amt of money that shows he or she is serious about the apt or property) then if the tenant wants out of it they kept every dime he or she puts down. they did this because they were pissed he pulled out of the place. so they kept it all. they knew exactly what they were doing. even if he chose to move in chances are something would have happened to prevent him from moving in & they would have kept the cash

Sounds like the defendant is a scam artist. The plaintiff signed a paper with no date and the defendant added one that suited him. The judge should have thrown it out since everything the defendant says is hear say. Plaintiff didn’t deal with him therefore he shouldn’t be there.

Surely there are circumstances where deposits can be returned! What if an engaged couple put down then one of them dies, and survivor can't afford rent alone?? There's got to be a way to accommodate emergencies.

Once you sign your name, it's your responsibility, can't back out. That's just like buying a vehicle, once you sign that agreement stating you'll pay x amount of $$ a month, you can't change your mind later.

As a landlord I can tell you that there are universal tenant laws. This man did not sign a lease, it doesn’t matter what that application stated, it doesn’t make it legal. Here’s the deal, the effective date would have been March 1st, he backed out on the 28th of February, I’m also certain he signed a blank document which you should never do. I believe him when he said April 1. In this state if you did something like that you’d be prosecuted. Millian was dead wrong, both she and that crook stole from that man, and I’m sure he has a cognitive issue, it’s clear. I’m beginning to think this woman is a sociopath.

But don't people with disabilities ALSO have an obligation to ensure that properties they are moving into meet their needs and are ADA compliant? I am assuming he saw what he was moving into with his own eyes, but signed the contract anyway.

No, you do not understand. They have to see the rental to see it is safe to move in. ADA has nothing to do with rental property. That is SECTION 8, the State people.

@@trekgirl65 Both renters and landlords have to make sure the rental is ADA approved. And depending on the state there maybe additional laws that trump federal laws if they are tougher, like in California.

People these days absolutely blow my mind do they not know what a contract is when you sign a lease it's a legally binding contract, and the whole point of giving a deposit is to hold something for you, while they're holding that something for you they're turning other people away so if you change your mind that's money that they lost out on! that's the ENTIRE point of a deposit so if that happenes they're not out that money so why somebody would turn around and sue for the deposit back is beyond me, I don't care if you changed your mind 30 seconds after you signed a lease you signed it!!! think about something long and hard before you put your signature on anyting🤦‍♀️🤦‍♀️🤦‍♀️

Oh, so you want tenants to be able to screw the landlord and leave them with no time to prepare and market the apartment? GTFOH with that nonsense. That's why it's a damn contract; you sign it, you're on the hook for it. Don't EVER let your problems become someone else's problems just because you decided to change your mind. It's called "TAKING RESPONSIBILITY". Learn from it.

The judge is being pretty bitchy when she calls the defendant arrogant because he didn't bring the super. The defendant probably knows the law if you're in that business. He had a signed document that clearly stated that the deposit was not refundable. What else doe she need? He's not arrogant, he knew that was all he needed. People try to break leases and ask for deposits back all the time. You put down a deposit to hold something, whether it's an apartment, a car, anything. This prevents him from selling it to someone else. If you decide to renege on the deal, he keeps the money. His holding it for you prevented him from selling it to someone else. Don't sign anything unless you're absolutely sure that you want it.
