The plaintiff says the defendant is her deceased brother’s fiancée, and she refuses to return her brother’s belongings to the family, so the plaintiff is suing for unreturned property. The defendant insists the plaintiff’s brother told her he wanted her to have everything of his before he passed away from COVID-19. The defendant is countersuing for property the plaintiff stole from her brother’s car.

A birth certificate, SSN card, other important personal documents should not be inside a car. Keep those items inside your place of residence or somewhere safe.

People need to get a will and life insurance as soon as they have children, regardless of their financial standing. They also need to name the beneficiaries and executors of their estates.

I 100% agree. My parents have updated their will and the trust for me and my brothers every 5 years since they were married (even without kids). If something were to happen to either of them, they know that their assets would be secure and given to the correct people without dispute. Many people think it's an extra task with extra costs but at the end of the day while living your everyday life its better to know you have your life situated than to have siblings and/or spouses sue each other.

I worked for State Farm a few years ago, you'd be surprised how many of our clients who could afford life insurance simply didn't want it. I've had people say no to a $10 a month policy, only to then call a month later letting us know they're at the dealership buying a brand new car.

Yes and possibly a Trust because a Will can be contested in court but a Trust is iron clad.

My mother passed away from Covid, unexpectedly, and I sometimes wonder if I wasn’t considerate of other people’s feelings when planning her services or where I’d place her ashes. But that was my momma and I am an only child, and felt like it was always just me and her. I’m so very sorry for their loss 💛.

Sorry for ur loss, Mom is a hard one, lost mine in 2005 when I was 23 and honestly I’m still not over it!! Make sure to take care of urself, I’m sure ur mom would wanna see that!! As I can promise u they walk with us each and everyday!! Again sorry for ur loss Queen! ❤

This is where marriage is not “just a piece of paper”. When you shack up you build this whole life together and end up with no rights in the end. In this case they were engaged but almost doesn’t count and it’s just so unfortunate what happened. 😢

Sometimes I think judge MM is not in touch with reality and how “average” people live. People can’t and won’t just throw a significant other or family member out because they don’t agree with their actions. That’s just not realistic. Easier said then done judge.

You missed the point she was making. The sister was blaming the girlfriend for his death. The judge was pushing back on that. And she's right. If you are concerned that someone you're living with is going to make you sick, it's up to you to get them out of your home or you leave. It's YOUR life and YOUR responsibility to keep yourself safe. If you choose to be in that home together, its your choice and you can't blame the other person for your choice. The girlfriend can't be blamed for his death when he could have gotten COVID anywhere. It sounds like this family is disregarding her. How are you going to come into MY home and start taking stuff. None of it belongs to you. They need to go to probate court like the judge said.

I think what she was attempting to do was stop allowing the plantiff to state that her brother blamed his girlfriend for him getting sick. It’s just a vile thing to do. And she still has a point, everyone is responsible for their own actions. He could have slept in a different room. Also what I don’t like is why did he continue to live with her when he would go run and tell his sister their problems. He doesn’t trust her and should have split up with her and gone with family during the pandemic. It’s no one’s fault they got COVID. It happened, it sucks and I don’t like that the plaintiff just kept trying to jab that in the defendants face and Judge MM did right by making her stop.

I cannot urge people enough to get a will and life insurance. I could not imagine my kids not able to get things like my jewelry and some clothing items. Not because of the money but my grandmother passed and my aunt let us all come and pick something of hers that we wanted...that was over 10 years ago and anytime I have something important to do or have to speak in front of people I wear my grandmothers pin on my shoulder to give me strength. Its sentimental and it may not matter to anyone else but I get it. So sad

I disagree with Judge about the Covid transmission. She said if a person that lives with you won't stop going out then kick them out... if u kick that person out, they can sue u on Judges show and win for illegal eviction... it takes time to kick someone out and can vary depending on the state you are in.

Ahhh so she was happy ripping jewellery off her passed sibling and breaking down the door to remove furniture and has looked at probate court but hasn't pursued it because she could potentially be out of pocket? Disappointing situation all around.

Exactly! This is why it's not smart to live with a lover without the benefit of marriage. In the end, if they do go to probate court, the girlfriend will get nothing except what she can prove is her personal property. She has no survivorship rights.

I'm surprised the defendant had any legal right to do anything with his property after he passed!? They were not married and he had no will. It would automatically go to his kids first, then the path of next of kin and so on. She had no legal right to make any final decisions with his belongings! This family should have gone to probate court and not keep arguing back and forward with the defendant. (I posted this before the judge said the same thing😅. I'm learning from people's court🤣.)

This used to happen to gay couples all of the time before there was legal gay marriage. Unmarried? You had zero legal claim to any of your partner's property, no matter how long the two of you had been together, no matter how long you'd shared the property in question. In many cases, you couldn't even say goodbye to your spouse dying in the hospital, especially if his immediate family opposed it.

There was a an elderly couple (female) that had been together their entire lives. One of them died and everything was in her name. She had no contact with her family. Some relative (I believe a nephew) came out of the woodwork wanting everything. They forced the lady out of her house she had lived in her entire adult life. She asks for her partners collection of birds and they would only let her have one because they thought the collection could be worth money. It was one of the saddest things I have ever seen.

I'm constantly amazed that some Christians put so much emphasis on monogamy and family, yet when gays try to form monogamous partnerships and raise families, they're suddenly opposed.

@@stephaniels5421 Fortunately, gay marriage is the law of the land now. And Biden just signed the "Respect for Marriage" law. It helps maintain the validity of gay marriage even if the Supreme Court overturns its previous ruling that same sex marriage is constitutionally protected.

Maybe she meant no other jewelry at the home because he had his jewelry on. The sister was saying the son wanted the jewelry but if sis had all his belongings he had with him when he died then she has all his jewelry. I feel it tho, because I made sure I got specific ring of my mom’s when she died because of the sentimental ties to it.

The defendant's room is AWESOME!! Take a minute to appreciate the aesthetic happening there. There's even a WKRP in Cincinatti paster. If that doesn't mean anything to you, you can't be helped. Also, her hair is perfect. She looks rough because she is older, hence the age of everyone around her. she actually looks great for how old she is and HELLO she has a broken heart and is being hit up for her lost man's possessions. People have been pretty mean and judgmental about her in the comments, but the man loved her for a reason (she's awesome).

That's how I caught it by my ex husband. I was safe as possible but he wasn't and didn't care. I blamed him for me getting covid. After a while he finally admitted that he wasn't being safe while going out.

What an ugly case: The defendant looked like she had just woke up . The sister spent a lot of time on the def. poor character. Girlfriend just give the sons his ties and hats, or at least something each. There is nothing worth such nastiness from either side.

Tony didn't have a will so no one has a right to his stuff. It's a free for all. My mother passed without a will two months ago and I was told that her estate would have to be worth $170,000 for a probate lawyer to even touch it. But neither of these ladies have a right to his stuff because he didn't have a will. The sad thing is when people start to argue over the deceased belongings, or think they have a right to control it. Smdh 🙄 people.

JM had no business going off on the plaintiff because her deceased brother blamed the defendant for giving him Covid. None. The plaintiff wasn't making that claim. She was quoting her brother. JM shows her biases too often. She also repeats herself too much: "How do you end up with the car? I need to know how you end up with the car. Did you keep the car that night?" She doesn't give the litigant a chance to answer the question.

But it's not a small claims court. It's binding arbitration, so she can decide on property. Binding arbitration type of tv shows "courts" do it all the time, even judge Milian.

What a shame the brother never wrote a will. You can even hand-write it and have a couple of nurses sign as witnesses. Also, no lawyer would tell the sister that she'd be personally responsible for her brother's debts. I'm sure she just misunderstood what they were saying. It doesn't sound like it would be worth going to probate court though, as the entire estate would be eaten up by creditors. If these two were decent people, plaintiff would give back the fishing gear and defendant would give back anything that had sentimental value to the family. No way are creditors going to track that stuff down; they will go after bank accounts, property, vehicles registered in the deceased's name, etc. -- stuff they can verify was owned by the deceased. Not furniture. I really hope these two can work things out in a fair way like civilized adults.
