Laws in the Philippines that I find strange as an American Attorney. Every Country has laws that are different, including my home Country where we have some bizarre laws still on the books. BTW the main opponent of reforming the divorce law in the Philippines, is the The Integrated Bar of the Philippines (IBP), official organization of all Philippine lawyers, which bounds to lose lot of high income generating annulment(currently) cases.

It's an average cost to an annulment case is 200k pesos. Kung mahirap ka iwanan mo pero kasal pa din. Kaya uso ngayon sa mga masa ay live-in. Besides being lawyer is the only profession that makes money out of threats, intimidation and human misery. Kaya daming nag lawyer, padalhan mo demand letter pera na sa kanila yan.

There’s more non-smoking real estate for all to enjoy. It’s no longer about smoking that bothers you, but your hypochondriac reaction at seeing others smoke that is a mental disease. Smoking fires, bbqs, and car exhaust likely doesn’t bother you. Others smoking does.

the alcohol selling also is a law here in barbados , the caribbean , its against the law to sell or consume alcohol midnight leading up to election day to midnight on the election day

I was surprised as well when I heard those laws. I was actually there when the law on smoking took effect. Many foreigners in my neighborhood were fined or jailed for smoking publicly within days of the law passing, they chose to ignore the law or didn't know I guess.. Now, the helmet law....that's news to me! and agree that's quite unusual!

There is a conumdrum about traffic laws especially in the provinces for traffic enforcers. Yes there are statutes which everyone is aware of by enforcing them becomes a problem. For most cops it is a simple way to make money on the poor who ride motorcycles or try and make a living in tricycles. Just giving some money for the cops to buy "merienda" mostly does the trick. How can traffic enforcers punish the poor who have little or no money to pay the fines anyway. Most people in the provinces rely on transportation to earn their living but are always stopped for minor traffic violations. Whereas, those who drive big "pick ups" and can easily afford the fines are rarely stopped. I may be wrong but these are my observations living in Gensan. I take issue with the crazy drivers in pick ups who drive at ridiculous speeds and overtake/undertake without regard to human safety, some are also drunk (also my experience). I feel sorry for those tricycle drivers who need to use national highways or even within city limits who have to contend with these crazy drivers and seem to think they own the road. Yes I drive a pick up for my families safety, but being a foreigner I respect the traffic laws and have held a clean driving licence for over 45 years. Anyone else want to comment - feel free!!

About the helmet, you cannot use full face helmet but you can still use the smaller ones (without covering the face). This is because of the "riding in tandem" crimes that was very common about 10 or so years before (and still happens today sometimes).

In Thailand alcool sale is prohibited starting 24 hours before election day. I read that many country in Central and South America have similar laws.

Some cities also dont allow liquer sales near schools...so if you open a bar make sure its more than 200 meters away from a school or a church.

from my understanding, it is actually 25 for parental consent but if they are at least 21 they can still marry without the parent's consent.

Strangest thing in the Phils is lack of enforcing strictly monthly alimony. If the man will provide sufficiently for the legal wife and their children, he would not have enough funds to have a mistress. Thus, many single mothers are looking for American partners to support them. If only the legislators are not a bunch of MCP’s, our legal wives and their children will be protected.

I was told that due to the previous president giving up smoking, and coming from Davao, that the smoking laws there are the strictest! He obviously hadctrouble refusing temptation!

Do keep in mind though, that a foreigner who has been married in the Philippines to a Filipino / Filipina, can have that marriage dissolved (aka divorce) in their home country, and if it is dissolved in the home country, the Philippine government will recognize that divorce and will allow the Filipino / Filipina to remarry in the Philippines.

Its unnulment not divorce. Any couple married here in the philippine cannot do divorce. But if you married in a foreign country you can a divorce there and the philippines will recognize you divorce papers.

You ever drove in the Philippines, traffic laws are never enforced. On multiple occasions I've seen checkpoints for drivers license verifications, alls they do is hang back a few hundred yards and wait the authorities out. This includes motorcycles, big trucks hauling sugar cane, and other big trucks All unlicensed drivers.

I'm anticipating getting married here in Davao. One of the requirements is the husband and wife to be need to take a class in what it means to be a married couple. Sort of like Home-EC for marriages.

CFO is different. It is for Filipinos who are leaving the Philippines for good. Like if they will migrate. When my nephew immigrated to the USA this pandemic, there was no class (face to face). He just registered online. Am not sure if this is still the case.

I would assume that is for marriage virgins getting married in a Catholic church. It makes no sense to make people who were previously married to repeat it.

@jeffery Strong…I got married to my wife in ligao in January and yes you have to do a marriage counselling course as part of the requirements, unfortunately for me it was all in Tagalog 😅.you will get a certificate afterwards tho

You might not believe it but there are places in the US where the bars and liquor stores are closed on election day. What laws exist for home brewers and distillers?

You are correct ..only the Philippines and the Vatican have absolutely no divorce law...even though the Philippines do actually have a bill trying to legalize divorce.......they've only been debating it for 4 years now .

It will never go through. Divorce is a benefit to the poor and the rich just spend a few grand getting and acceptable divorce in Guam

Yes the no smoking in public places is a no brainer. It's banned on beaches and even standing in the sea. lol. i would think if they had more tax duty on tobaco it might be a different story. Being a non smoker it doesn't affect me but i can have sympathy for those that do..Those people that makes those laws obviously dont see public transport such as buses and jeepneys hosing out clouds of exhaust fumes.

They have no traffic laws in the Philippines lol. No they do but they are so relaxed it just makes more problems. The biggest issue is bikes lane splitting. IT just make driving out right dangerous. I was there for a week and rented a car. What a waste and disaster. You can rent a driver with their own car for a week much cheaper then you can rent a car. for.

Can you tell me how long does it take a Filipina to get that and CFO sticker I think you were talking about. I married to Filipina over a year ago and I'm going through a dating site and it is taken us a long time. They just keep telling me to wait wait wait and I'm getting tired of waiting I just wonder if that could be a faster way. It is already been over 5 months Sensei have had all of our paperwork. I just need to get her over here to the uso I can marry her here so she can click my social security after I pass. I have already married her in the Philippines

Taking marijuana or any illegal drugs, you don't wanna try them here. Ph jails are ridiculous, you wont die from boredom but from the humidity and overpopulation inside the jail.

Hi Dr Laway Interesting vlog, a few comments... Yes the divorce problem is serious. I don't subscribe to the excuse that the Vatican City is the only other country that doesn't allow divorce. It is not really a country just a small city. There are only about 30 females living there with a total population of about 550. Hardly a comparison with the Philippines, though I guess that the women living there love it. Also it seems that every year divorce bills are submitted to the Philippine government, usually passed by the house of representatives, then it seems that the senate don't even bother to read them, then if they do get through the senate, the president says no anyway. Draw your own conclusions, but I have long been of the opinion that the church runs this country by suggesting (or in some cases telling) their congregation who to vote for. I have a lot of sympathy for Filipinas who have married early due to family pressure usually due to early pregnancy because of immaturity. Some marriages work out but a lot don't. The Philippine culture seems to support men and not women, just look at the penalties for infidelity. I googled it a few years ago and it seemed very biased in favour of men. Sorry to bore you and your viewers with what is my main problem with the Philippines. In general I love the country and the people (most of them). But some of their laws seem pretty questionable. 2:52 Hi Filipino lawyer here. I'll explain the alcohol ban on elections. It's easy to identify loyalists of any particular candidate in the elections, usually by area. One way to win is to prevent the voters of that area from going out to vote against your opponent. And you can easily do that by... Buying them alcohol on election day 🙂 You'd be surprised how many would take you up on that offer

You know that actually makes a ton of sense into how that law came into being. As cheap as Tanduay is someone could for not a ton of money decommission a lot of votes. About 70 or 80 years ago the US made it illegal to buy alcohol for a third party if part of a political campaign on election day in many states. Thank you so much for the insight!

Marriage is a contract. I thought that to be legal all contracts need a break clause.

Yes there's a break clause and it's called annulment in the PH. But you have to prove that your partner is psychologically incapacitated which is why it's hard to get annulment. There can be other reasons for annulment but the burden is always heavy in order to nullify the marriage. Which is why marriage is no joke i PH.

Surely a contract between two people must be complied with by both people. When proven that one of the parties does not comply with the terms of the contract, then the contract is broken. Hence divorce

Hence that is why marriage is a serious thing in PH. It can be good and bad at the same time. Family code of Ph defines family as the basic unit of the society. Hence family is important. Many Filipinos still believe that if you break the family you break the society. So divorce law in Ph is almost impossible to pass as a law. There is legal separation in Ph. You can get that in cases where your partner abandons you but you still cannot get married if you are just legally separated.

And the law in Ph is still extremely patriarchal because if a guy catches his wife in bed with another man and he kills both of them, there is no jail time. The punishment is he cannot live within a few kilometers of the wife's relative. That is to protect the husband from reprisal. So foreigners should be aware of this law. Yes having a common law wife or live-in partner is common here in Ph, even former Pres Duterte have one which he brought to the Malacanang palace. But be very careful when dealing with married women.

Traffic laws depend on money, In my Area there are laws but 0 are enforced, 90 % of bikes, Not Registered, Rider, No License, No Insurance. what’s funny is if they hit you it’s your fault, 😂😂😂😂😂, Yes They die every day from driving foolish, No helmets, Under the influence, I try to promote Helmets with the locals and my friends and Nit drinking and riding. Yup no divorce law in the Philippines. Only legal separation and annulment are the options. The ongoing consensus here is getting an annulment is more expensive and difficult. As for the no helmet covered areas my grand fathers hometown Sta. Cruz Laguna had it for sometime it was to do with law and order situation. There are other issues similar to this like no back rides on motorcycles (they called it riding in tandem which is obviously grammatically incorrect but the term stuck) unless you are a family member of the driver of the motorcycle it wasn't permitted don't really know if thats still in place in one of the NCR cities. The liquor ban during elections was in place since I can remember but in the Philippines Election Day is an observed Holiday unlike in other countries where if it falls on a regular day working day the day proceeds as planned. So the liquor ban prevents people from getting drunk on those days or thats the line of thought. The last comment is the age of 21. I have a friend who took and passed the licensure exam for engineers at 19 but since he was not yet 21 the legal age he was asked to claim his board certificates and ID cards when he turned 21. Instead the licensure board gave him a certificate that he passed the board exam and could work in the industry along with his claim stub. Weird isn't it.

Some areas here the age of consent for marriage is 24. Not that i didnt have consent but my lawyer gave me a ton of info on marriage laws i may find different here than the US lol.

Smoking? America cracked down hard over ten years ago. There's more freedom to smoke here. Are you in Davao? They tend to be strict on certain things down there. Most of the rest of the provinces smoke wherever you want outdoors and at drinking spots smoke at your table. Just don't smoke if you're in air conditioning or an outdoor eating area.

in my journey as a traveler, from NYC, Detroit, Chicago, Memphis, and L.A. when I first moved to Salt Lake City, Utah, Mormon country, I was struck by lighting finding out we cannot buy liquor on Sunday, nowhere in the state of Utah... regardless of the elections, or whatever other reason, if it's Sunday, no liquor for the people... that is very odd for a regular person living in the states or I guess anywhere else in the world... I understand the religious reasons and connotations, but what has to do with the state enforcing such laws, is beyond my power to comprehend, with me in my naivete thinking the state and religion are separated... but, hey, I guess I'm too much of a perfectionist...

There is a divorce issued by a Catholic church court. Most people do not know about it, but a side who was seriously abused by his partner can seek divorce. It is a closed court and no lawyer is allowed in. The complainant has to present alone his side and there will be hearing and investigation. Try to verify it, and make us new video about it.

The no divorce law is not because of Catholicism though it is often blamed. The straight up fact is the economic caste system. Affluent people (mostly from oligarchical families) get divorced all the time. There are celebs who have done it several times. Most often the fly to Guam which only requires a 7 day residency period to file for divorce and costs between $1500 and $2000. They go home and usually settled within 90 days. While the Philippines doesn’t initially take official notice of the marriage if said divorcée goes ahead and remarried outside of the Philippines PSA and all other agencies will acknowledge the new marriage. Why I say this is purely economic is most Filipinos can’t get a tourist visa to the US because they are too poor, not to mention a few thousand they would spend getting the divorce. Divorce remains illegal and likely always will, at least for the majority Christian population, because it keeps many poor women who have had bad marriages from getting into relationships with richer foreigners lest the risk adultery and prison.

Incorrect the upper class can afford to have ANY marriage annulled. Divorce laws on the books are 100% because of Catholics doctrine playing out in politics.

Well Davao City is very different from the rest of the Philippines they have local laws that is consistently implemented in any days and all occasions. This is also a place where law and order is superior to protect all individuals.

@Jim it's great Jim I used to come andnfort there since 2010 until 2019 and there are much fun without fear like they too have night bars with women. They are so so strict with drugs and violations of laws especially their local one.

@Jim that's nice well Davao city is the most peaceful city in the Philippines and one of the most peaceful in Asia. Had they not strictly and consistently enforce the law surely it is one of the most dangerous city since 3 decades ago until the Duterti's came into power that slowly becomes peaceful. Since in the 70's Toril in the Davao city is the laboratory of all ideologies from communism and Muslim terrorism. There is no single day then that there was no death thru violent acts mostly an average of 2-3 deaths a day. Now peace-loving people appreciates those moves of the local government because only those criminals and with intent to do crimes are trembling to live in that place.

@Jim hahaha sorry my friend I am not from Davao I'm from the Visayas but used to be assigned there in Mindanao including Davao and I was just impressed the way the local government managed their city being clean, organized traffic, very honest taxi drivers and very peaceful.

Hi - just wanted to repeat that some - perhaps more people than me? :-) - find the ever changing sound level annoying. I think that this video's subject is very interesting, but I had to stop listening after about half of it. Due to the "automatic gain" that you use on your sound system. I have the same microphones - Røde Wireless GO II - and it is quite easy to adjust the system NOT to raise the gain dramatically whenever you pause or breathe. So when you put all your effort into making these videos it's a good idea to use the last few seconds or minutes to get the sound right - I believe :-) Keep up the (otherwise) good work 🙂

My wife had to go to one of those CFO classes before coming to the US to marry me. Now after 15 years as a U.S. citizen she says that most of the stuff they told her about the US isn’t even true lol. And god help anyone that tries to take advantage of her 😂😂

I guess I will never be going to Mindanao.(sp?) I absolutely REFUSE to ride a motorcycle without my helmet. I wont even ride it across the parking lot without it. Nor will I take my girl on the bike, without her wearing a helmet as well.

It is just that one city he mentioned. Literally everywhere else in the Philippines it is mandatory to wear a helmet. And that includes passengers.

@@brucesmith9206 which is as it should be. I use to race motorcycles, and I use to work in the American power sports retail industry. I have seen COUNTLESS riders whose lives were saved, by their helmets.

However, I still see daily in my barangay (Province), a family of 4 and a goat on a motorbike. The goat is the only one with a helmet on.

How about the traffic law that says if a big vehicle and a smaller vehicle collide FOR ANY REASON then the big vehicle is automatically at fault.. I have seen with my eyes a motorcycle crash into the rear wheels at the side of a bus and rider killed.. It was on the right side so the rider did not give right of way.. (Also on city CCTV.. Rider speeding did not even slow down at intersection) The driver was arrested for culpable homicide,, cuffed and taken to jail.. A friend of mine had a cycle crash head on when my friend was at a red light,, No injuries BUT cop told him he was responsible and come to station and have meeting with the chief and rider to work out compensation.. My friends lawyer joined them and he was asked to pay out.. Then his insurance got involved and still ongoing in a court..

Western culture is very different from Filipino culture that's why Philippine laws are very much different from most of the western countries. Philippine laws are incomparable to western laws and it's not strange to Filipinos.
