The People's Court

2 жыл бұрын

The plaintiff worked for the defendant’s company as an exotic dancer. She says she invested in the defendant’s new sex toy business, but she hasn’t received any of her investment back, so she’s suing for her money. The defendant argues the plaintiff knew the return on investment would take more than a year, so she doesn’t owe the plaintiff anything.

The entire point and definition of an investment is that there is RISK - that you may not get the money you put in back (assuming the party you invested in/with fulfilled their obligations). Idk why the plaintiff seems so sure she’s going to get her money back. Like what did you think you were giving 2k to the defendant for (admittedly an investment).
@andrejamal5438
@andrejamal5438 2 жыл бұрын
Unless a person guarantees the money back
@RumbleRish
@RumbleRish 2 жыл бұрын
@@andrejamal5438 if the borrower guarantees the money will be paid back, then it is not an investment. That turns it into a loan, which is governed by fairly strict laws (like caps on interest you can charge). If the borrower guarantees the money back (ie. a loan), the lender has no risk and therefore isn’t entitled to massive profits. An investor can make massive profits BECAUSE of the risk that’s present.
@andrejamal5438
@andrejamal5438 2 жыл бұрын
@@RumbleRish on contrary, a person can request an investment and fully guarantee the money will be paid back. That’s the catch phrase. Which in one of JM cases he explained very detail.
@RumbleRish
@RumbleRish 2 жыл бұрын
@@andrejamal5438 Yes a lender can lend money to a borrower in return for an interest or stake in the business, where the borrower guarantees the money back (a loan). However, we’re talking about the *legal* definition of an “investment” which requires that there be risk to the lender/investor (which, if guaranteed back, there is none of). This is why you can make insane profit on an “investment.” If a lender is *lending* money to the borrower in exchange for, let’s say, 5% of borrower’s company and borrower guarantees the money back, it’s a loan (and an investment in the business sense) and because it’s a loan, financing laws such as maximum interest rates, etc appply. Thus, the lender would be capped at making a certain profit that an investor who is not guaranteed money back is not.

She is too trusting; not fair or very nice to say she’s not smart. Some people can be easily taken advantage of because they just are down on their luck and are looking for a break.
