The child support people froze the man bank account to give the greedy baby mother the money. He was upset. Explained to the child support people that the money was for his children who mother had past away. The child support people did let the baby mother know that it was paid in full. That's not really reasonable due to every child/family having different needs. You can't do a generic income and then blanket it across the board. What about those after school activities that cost money that not every child has. What about specific medical conditions that require out of pocket expenses. What about books, supplies, etc for you child outside of the norm, ie, I child that in AP classes. This is why they have a baseline and adjust it accordingly. If you are not the one there on a day to day bases taking care of the needs, then you should be the one to help lighten the load financially speaking. Now I will say, I don't agree with child support that is just high for no reason. Such as the NCP making 100,000 and the CP making 30,000 so they give the CP child support based of the NCP's 70,000 income (offsetting it). I honestly believe it should be based on the needs of the child. But again, if your not the one there on a day to day bases with the child then you should be paying a little more so that the child can do the extra things that they would be able to do if they were in your custody. Makes no sense how an asset's worth can be added to the income. In this case the 40k cattle was added to his income of 50k. Walter H Thank you for tuning in and commenting. Deemed income sets a reasonable amount of child support based on a person’s assets, even if they are not income producing. Based on his testimony, the cattle were worth $40,000. That’s deemed income (the $40k) and someone can be ordered to pay child support off of that amount.

@@JudgeVondaB Thanks for responding. I understand that. I never questioned if it could or could not be done. The law is the law wether we agree or not. I questioned the logic. By law you can take the mother back when you have a change in circumstance! She at this point would have to reduce support because he got rid of the income producing cows! The mother git one year at 1200 a month and now will probably get less than half after she reruns those numbers!

IM gonna have to bust ya on this one. Only monetary inheritance can be included in calculating support payments , and only in certain states. Land and chattle can only be calculated if sold. So whoever this case was based on was unlawful and the father has grounds to appeal.

That's sad a man should have to sell his land. whos to say he may give the child the land but if he has to sell the land to make it now the kid and the man have nothing. I am not a lawyer but it should be based on the reacurring income that's crazy and if the man is teaching his son about the land he might just give it to him. i do like the judege she is good and i understand the law is the law but laws need to change and yes mom did need to get money for child but based off both their income nobody asked her in come.

I agree. Thats family asset. And his parents passed away. Like girl how would you like it if your mom gave you a home that’s sentimental and someone forced you to sell it? Cant you sue for emotional distraught?
@Casper-Ghost2 жыл бұрын
@@bbwaifuwu Yeah and the big thing for me is that those assets can be used to better his living situation as well as his child's if he doesn't sell them. Not to mention that she's setting the regular child support amount based on forcing him to sell all the cattle for a one time injection of funds instead of a steady income ruining the money making potential of the asset while putting him on the hook to keep it up without that asset; its asinine. It also means he can't pass on a fully functional farm to his son for graduation like he'd planned basically allowing the mother to liquidate the asset out from under her son for her own benefit.
