Presidents in the last 200 years weren't career criminals like Trump is. So if the Supreme Court lacks experience determining official acts, let the lower courts decide. The lower courts prosecute common criminals like Trump multiple times a day. They know what an unofficial criminal act is. They know breaking a law that every American follows daily isn't done to perform an "official act" A man does not rob a bank because he thinks it is "An official act" to feed his family.
