Why is it horrible (if you ignore that it benefits Trump)? The French president has very similar immunity for official acts. There is nothing strange about the president of a state not being personally liable for official acts.

The President is not personally liable for unlawful actions, but you can still contest the lawfulness of the President's actions in court.

It's essentially this: If the constitution says the president can do X, it's legal. That's it. No other branch can declare X illegal (separation of powers). Nor can they ask why he did X. X is his power and his power alone. If it's clearly a constitutional power he has total immunity. If you're unsure it's only presumptive immunity Presumptive immunity works like your presumed Innocence. It can be challenged but the onus lies on the state to prove their case. (That it's not covered by constitutional powers). It has to be like this or you don't have a president. If congress can inhibit or criminalize presidential powers then congress is the defacto president and you vote in a figurehead. This would put the president under congress which would be a violation of the separation of powers.

@@brandonstone2754 Scotus decided about immunity for illegal acts, not about legalily of acts. If the President uses his pardon power strictly for personal gain (like Bill Clinton on his last day in office) then that is clearly illegal (even if the legality of the pardons themselves, i.e. their legal effects, probably cannot be challenged -- yet a different question), but Scotus decided now that he can't be prosecuted for it because the president has total immunity when using such core constitutional powers.

@@brandonstone2754 There are general statutes that criminalize corruption which will cover this. When Obama became president, the governor of Illinois sold his senate seat. The Constitution does not say this is illegal but it does not need to because there are general statutes. Blagojevic was convicted. But if the US president did something similar, he can't be prosecuted because of immunity.

Constitutional amendment requires ratification by 3/4 of states. Not practical while 13 or more states are Trumpist-run. Better to enlarge SCOTUS, revisit Trump v. Anderson, find Trump and other oath-violating insurrectionists are disqualified, revisit Trump v. United States, find president is not immune to post-term prosecution for core official acts or outer-perimeter official acts, and prosecute Trump.

Trump has already been found to be an insurrectionist as an established fact by the Colorado supreme court. Congress only needs to declare the fact and cite the 14th amendment; hopefully this will meet the Supreme Courts requirement, but somehow I doubt it.

That is the job of the US House. They are a MAGA majority--it will never happen. Then the US Senate has to hold the trial to vote on if they are removed from office. Do not forget that the US Senate was divided 50/50, but Sinema is now an Independent and Manchin will never vote with the Democratic Caucus over this! Senator Menendez has not been expelled during his trial, but the republikkkans may attempt to do so in order to prevent a SCOTUS impeachment.

Even the British Monarchy is a constitutional monarchy, not an absolute monarchy, which is to say that while the Sovereign is Head of State, the ability to make and pass legislation resides with an elected Parliament. I would wish that there were some provision by which the world at large could weigh in to vote, when a country such as yours risks falling victim to a despot. Yes, SCOTUS has overturned their decisions throughout history. Remember they upheld slavery as being Constitutional. They reversed abortion rights. It can be done but it usually takes many years for a complete shift in the makeup of the court.

Further, the president swore an oath of office to protect and defend the constitution from enemies foreign and domestic. Even one of the justice's dissenting opinions specifically says that the president would be immune when assassinating a political opponent.
