My ex-wife has zero proof and in fact was the abusive one and all it took for a temp PFA was her going to the cops and saying "He hit me". Thankfully my lawyer was able to win my case in the end but that wouldn't have stopped the cops from taking my guns (which oddly enough I didn't have any then). Just because a small change to the law, which most agree makes sense, doesn't mean this will destroy the 2nd. If people are in fear for their lives, go to court, under penalty of law, and admit someone is potentially going to hurt them, a judge AGREES. Seems like a sensible approach.

The issue is, they people who should be banned from owning a firearm don't care about the laws and will get one anyways. It's only the people who abided by the laws (good gun owners) that care about the law in the first place. I'm mixed on this. While I agree with your statement to a degree, my issue is who decides how "out of control" a person needs to be before they lose their 2A rights? If I scream as someone in a parking lot is that too far? How about if I am drunk and say something like "I'll knock your teeth out" is that too much? What if I don't do anything at all but a person who doesn't like me says I did and it's their word vs mine? Is that enough? And once we set the rules for that, what stops them from wanting to restrict other rights? Do we start saying "Not any person who can not control their temper should have freedom of speech because of the things they say"? Lets say a person posts on a self harm group mean things. Should be remove their ability to post online. Or if someone goes to a group meeting and does it. Again do we remove their ability to speak? Blanket statements are dangerous because it opens the door to review every right. And lets not forget the 2nd amendment doesn't give us the right to bare arms, it restrict the government from taking them away. This was put in place to keep the government in check and now we freely give the government the ability to do the complete opposite of the who amendment. I'm not some 2A junky but I have had an ex-wife try to get a PFA against me and I never did anything to her. In fact she was the abusive one. It scares me that all because of a lie I could have one of my rights removed.
