The plaintiff rented an apartment to the defendant. She says the defendant moved out in the middle of the night without telling her and therefore broke the lease. The plaintiff says he stopped paying rent and even left a rifle under the bed. She’s suing for two months of rent. The defendant argues the plaintiff did not have any respect for his privacy and doesn’t owe her anything. He’s countersuing for a refund on rent.

Some peoples sense of hygiene is just sub par, other than the state of his room with the food and plates and empty bbq sauce bottles, a cat box is one of the most disgusting collections of poop and pee inside a persons home. It can be reasonably maintained without smell but requires constant attention and maintenance. Some people just do not care to attend and you can smell it and it’s absolutely putrid. If you can smell it then you know it’s probably in other undesignated places. And you know it’s all over the cats paws and they probably let the cats crawl all over the counters and food areas. *You can’t eat at everybody’s house…* 😑

When that piece of information came up, it rang a bell in my head and I thought I'd already seen this episode, but the rest of the case did not bear that out. In particular, in the other case I vaguely remember the litter box under the bed being called a malicious move to force the tenant to leave. Maybe this one was also. Any tenant who would unilaterally declare the other tenant's room a cat bathroom would likely not be a long-term co-tenant .

@@BobBlumenfeld Yes, I agree. The other big red flag was that someone had to keep opening his bedroom door all the time. Too bad the sister was not there to give testimony. Anyway, I think the judge got a clear picture that constructive eviction had taken place.

One year in student housing I was moving into my new apartment, and there was a cat in my room. The entire apartment reeked of cat piss, but I figured there was probably nothing I could do about it, so I turned around to leave the apartment to go grab another box from my car, and I saw a second cat in the living room. At that point I decided that I was going to not move in and ask to live in a different apartment, because one cat is one thing, but two cats is something else entirely. As I was walking out of the apartment, one of my other new roommates came in and informed me that there was actually THREE CATS. Long story short, the girl with the three cats was forced to move out a week later, but there wasn't a single day that week that I didn't come home to at least one cat in my bedroom, which door had been previously shut. It was infuriating. That same roommate who was forced to leave, also tried to steal my entire box of pots and pans, but that's another story.

that's awful. I had to stay at a family member's house which absolutely STUNK of cat piss, but it was so strong it made me nauseous. It was so bad I left the next day even though I was supposed to be there for a week. Couldn't take it, it was just that bad. .

Owner obviously fell for the typical look a cat gives when they want you to do something. Not having access to a room is often unacceptable to a feline so I'm guessing the owner gave in to their request to enter and opened the door.

The essence of what the two parties had intended to agree upon is the "agreement" in the eyes of the law. In this case, it is very easy to see what the parties intended to agree upon with respect to the date on the written contract that was wrong. In other cases, a mistake on the document could be more of a problem in establishing what was agreed upon.

absolutely disgusting. cat litter boxes and untrained cats are so fowl. i absolutely love a clean cuddly cat but the smell and dander and filth is horrifying. her sister mustve noticed the tenant wasn't staying there, but should've been informed that the sister was taking money from him. should've put the box in the bathroom. if i had cats i would put all my paycheck into one of those robot catboxes.

It does get messy when alterations occur and the defects in the original lease document make things even worse. However, agreements do change and are not always in writing. An agreement cannot be invalidated unless it is found to be illegal or it is determined that the parties were never actually in agreement. The judge has to interpret each aspect of the agreement and according to the laws determine what was actually agreed upon and how the parties each performed their obligations in the agreement.

At least in California, any change in a written lease needs to be in writing (an addendum) and both parties have to sign and date it.

@@googleyt2622 A lease is not a simple agreement it is a contract. As I understand it that is standard contract law 101. A written contract cannot be modified orally. It can only be modified in writing and in the same format as the original and would require the signatures of each party. If a written contract could be modified orally then written contracts would have no meaning as any party could allege an oral modification.

@@Kat-bu3bn Most rental and property management companies will include specific language in their leases that prohibit oral modifications, so that ends up being pretty standard in all states. Without a provision in the lease preventing oral modification, oral modifications are legal and enforceable. This is true in California as well. This lease contains no such clause. However, even if this lease had an oral modification exclusion clause, the actions taken by landlord and tenant in this case would have created a waiver of any such clause. Their verbal negotiations and subsequent reliance on the newly agreed upon terms of the oral modification clearly demonstrate that they have mutually agreed to waive that clause.

Odd ruling. A couple of months ago JM wouldn't let the plaintiff out of his lease obligation even though he needed to relocate after being shot in the face on the property (anyone else remember that case?). But this dude gets to avoid paying because of a litter box. Maybe I have the facts wrong from the previous case. Correct me if I'm wrong.

The plaintiff in that case, if I remember correctly, was suing for medical expenses. He was blaming his injuries, at least in part, on the landlord for a faulty lock which enabled the assailants to get into his apartment and shoot him.

ha ha , so she and her sister thought he would have to sue the sister in order to win this case . if she had been watching any tv court shows long enough then she would have known that if a tenant or landlord has a friend or relative or any person that they let in the house then they are responsible for any damages that the person may do and its not him who has to sue her sister , it would be she that would have to sue her sister .

The date mistake on the lease is not something most judges would ignore or brush off so quickly. Only in this TV court would any judge decide well I know she meant that date instead of the one she put in the contract. yeah, good luck arguing that in a real courtroom. I've seen traffic tickets thrown out because the officer put the wrong date on the ticket.

People are blind to their pets' smells. I have dogs and I'm sure they smell but the difference is that I don't keep a box of their pee and poop in the house. I think it's gross and everytime I walk into a house with cat litter I find it intolerable to breathe, even the best kept litter boxes. I adore cats though, I just don't think I could handle that.

And I think it’s disgusting you keep an animal that slobbers all over everything, makes hot spots on the carpet, leaves chewed bones all over the floor, drags its balls across the carpet and wakes up the entire house at 3 a.m. because it needs to pee in your house. Guess we’re even.

DON'T get a tattoo of someone - like their face is the tattoo. ONLY because I've seen countless of them and only two of them looked decent lol. It's a really difficult tattoo to do and many artists simply can't do it but will try anyway 😜 no shade to them because I'm littered with tattoos.

Her sister lacks any basic manners. I cannot stand some cat people they are so clueless. I hate cats and most of the people who own them. There has never been a cat in my house and there never will.

I could handle someone like the judge as a friend but I sure as hell couldn't live with a yeller. It would be too uncomfortable having to pretend I wasn't constantly thinking ' shut the hell up ' all the time.

How is the landlord responsible for what another tenant did? It doesn't matter if it's her sister. That's ridiculous. That's between him and the other tenant. And this is supposed to be a judge? Hilarious.
