The bottom line here is the FA upheld Tonali's ban, if he was only banned from Italian football and Europe that would be one thing but the FA upheld his gambling ban in English competition so charging him again for the same offences committed before the ban is unfair.

Looking at the FA only - if they are to be considered separate incidents from the Italian penalties - then Toney was given 8 months for over 200 offences then by that math Tonali should get 2 months for his 50 beaches. Then the FA shouldn't wait for the Italian ban to be over before applying their own sanction so Tonali's additional ban from the FA should start immediately and run concurrently with the Italian ban.

You must be a Newcastle supporter because your reasoning is absolutely nuts. The betting infractions are looked at as a package rather than individual cases. He has priors, which should go against him. He also had 8 months of his 18 months Italian suspension commuted, so you'd have to think he would at least have to serve those 8 additional months. Serving different suspensions concurrently is never going to happen because it would make no sense to punish someone that way.

@@gustaaf1892 You dont have to be a Newcastle supporter to be nuts which you proved the point, how is extending the ban and derailing his career going to help with his addiction problem? and if the sanctions overlaps with the same incident during the same period outside of each other's jurisdiction, why cant the ban run concurrently? if cause I trouble in Anfield and in Old Trafford during a period I will be barred from both stadium for a period concurrently.
@gustaaf1892
@gustaaf1892 Ай бұрын
@@jun3078 The FA isn't responsible for dealing with his addiction problem. He can bet on whatever he wants to satisfy his addiction, providing it isn't on football if he wants to continue to play football. People who break football rules get punished when caught, so there is nothing new to see here. When someone murders someone and is sentenced and then kills someone else in jail, you would argue that he serves both sentences concurrently. Different crimes deserve different sentences. Multiple crimes will always be more heavily punished than a single crime. You're just arguing with a Newcastle bias and without any objectivity.

Firstly, as far as we're aware, for all these newly charged offences happened while he was in the UK, he has NOT bet on any games since he was caught and charged in October... meaning any punishment other than a fine should run concurrently with the ban that's already running. Secondly, as we once had with brewing companies and alcoholic beverages, the game is saturated with big money sponsorship deals, on shirts, billboards, and the endless advertisements during every single match in the UK. He deserved to be punished, as did Toney, but we don't even seem to be acknowledging the hipocrasy in all of this. If gambling is so abhorrent, then why aren't we pushing tooth and nail to eradicate it and the companies involved from the sport in general?

@@johnusher83 He was sentenced a bit later in October and he and his lawyers had been negotiating to reduce the sentence down as much as they could by making concessions and agreeing to certain undertakings. That is how they managed to commute 8 out of the 18 months suspension. These type of investigations, hearings and negotiations take time. It doesn't really matter because the Italian charges didn't include any of the betting infractions that took place in England, so that then becomes a separate charge under the jurisdiction of the FA/EPL and therefore should be dealt with in its own right. The 8 months commuted from the Italian suspension will probably impact on the length of the English suspension.

I don’t see them extending the ban seeing as he has about 5-6 months left from the previous 10 month ban. Its called an addiction common sense and rules go out the window and humans are flawed. Making the argument that you would bet on the sport your in cos of rules when addicted is just silly

@@Subsnake5500it's prioritising the short-term over the long term. We need to stop saying every time someone does that it's addiction. There needs to be consequences for poor choices. Merson is a perfect example. He is not a completely innocent man outside of his gambling and drug addiction. If you listen to him tell anecdotes about his life he clearly does what he can get away with in other aspects of his life as well. The primary motivation behind punishing people who do wrong is to protect other people from the consequences of their actions. It is not and never has been to encourage them to reform. We need to treat rather than punish argument' falls down. If you have a problem with addiction and you do not seek help yourself then clearly there's a character flaw present. Society needs some form of protection from Floyd characters. If they're capable of reforming then great but we cannot operate under the assumption that they are already motivated to reform.

Whilst I think breaking rules requires punishment, it's important to consider the effect of a playing ban. I'd argue that an extension of the current ban would damage Newcastle disproportionately compared to Tonali. I think the FA would be better served by forcing Tonali to do community work, both in and out of football, to raise awareness of gambling and the dangers involved. This takes up Tonali's personal time (which may still affect his performance for Newcastle) but saves Newcastle from having 50 million pounds worth of player on their balance sheet that can't contribute. My understanding is that he's already required to have done such work as part of his current punishment, so it seems a more reasonable avenue to pursue. That being said, if the intention is to improve how clubs monitor their players relating to gambling or behaviour more widely, then extending the ban would potentially be the better punishment as an incentive for Newcastle and other clubs to ensure their players don't fall foul of the same issues.

How does it make sense that the 2nd time he commits the offence he gets a suspended smaller sentence? If its a suspended sentence it should be double what the original sentence was. Still the sentence shouldn't be suspended. Had this happened while he was suspended or before he got suspended?

These 'new offences' are in continuation from his original offences the only difference is he moved country. Its not as if he got charged and then decided to gamble again after that. He has already missed the whole season so what good would it be to extend it beyond this even further? It would be different if he had started gambling again after being charged

Sentences often run concurrently in criminal law. The FA have to go through due process as these 50 offences occurred under their jurisdiction. Any punish should run concurrently. Tonali did notify the FA of these offences.

Unfortunately it's new offences, that he cooperated should add leniency but does require an additional consequence. If someone was found to have additional speeding offences after having their license suspended, there would be additional consequences for actions not yet punished. He may be suffering but he has done this to himself. There are many people suffering the consequences of other people's actions that don't get the support Tonali is getting.

More than a flat tyre, pretty much a right off. Milan should be punished for this as well. They knew about it and got him out for big money. However, it would be hard to prove unless he says they knew. He will have served a long enough ban they need to let him continue his career once it has finished.

When Sandro came to Newcastle his addition would not of stopped so he was still gambling when he was at Newcastle,but then when he got found out in Italy he then came out and admitted to the fa that he had gambled while he was at our club and told the fa what he had gambled on,so I would like to think that he has done his time and any ban from the fa should run concurrent along side his ban fromi Italy,but they could have further6 months suspended because if he is found once to be gambling on anything that 6 months would come into play

It makes little logical sense for it to be “extended” (as in a further ban tagged on the end of his existing one) it should only really be extended by a new concurrent ban slightly overlapping his current ban Tonali went to the English FA when the Italy proceedings were starting and disclosed this information, the FA have only just reached their verdict It would make very little sense for the FA not to hand out immediate punishment and instead delay it and tag it on the end of a ban that was from another organisation and an investigation the FA were not part of. There’s not justifiable motivation to reach a verdict and then wait 5 months to give out the punishment, the punishment if there is one should run alongside the one from the Italian investigation, the only real way and “extended” ban makes sense is if he has 5 months left on the existing ban and the FA want to hand him an immediate 6 or 7 month ban for the 50 breaches here, in which case it would be an additional month or two

AC Milan would been rueing selling him to a club like Newcastle. This is the current state of high end Italian clubs. Selling top players to Premier League outlets. In retrospective Milan must be so relived. They bagged £52,000,000 for the sale & don’t have to deal with an ultra toxic issue.

As someone who has a brother who has a gambling addiction for these to say that the guy knew the rules and should have not bet is ridiculous. Addiction is an illness and needs to be accepted as that in sport like in any other walk of life, I guarantee the player will be hurting and will be humiliated for himself and family. Sadly in the future he will have set backs just like alcoholism and drug addiction, the man needs help not punishment after punishment, that doesn’t work.

I don’t feel that I know all the facts yet. On one hand Newcastle said he fully cooperated with the Italian investigation so must have disclosed betting in the Premiership. This wasn’t a new period of abuse after previous punishment was initiated so why would the FA get involved now instead of earlier? If he didn’t admit the Premiership bets then he could be punished again but it’s taken a ridiculous amount of time to get here.

The problem with this, it’s not all that black and white (pun not intended), you can have a game riddled with gambling that’s on almost every advert, on shirts, in stadiums, in build up adverts on the telly etc etc and then punish anyone from within who has an addiction? The issue is that the two are undeniably related. How much longer can you go on punishing individuals when the soul of football itself is infected with betting to its very core? And I’m not saying Tonali didnt/doesn’t deserve a punishment, but at some point there has to be a cut off. The lads an addict, he needs and is getting the necessary support. Isn’t a year long ban not enough?
