Tanner is the best ,not a villain, imagine harvey establishing the premise of the case because there were people murdered and a wrong person .Infact the conversation actually didn't happen and stephen designed it in the affidavit in a which states way Scottie should be aware

This was a pretty lame scene altogether. Dude would know not to openly admit guilt to anyone other than his actual lawyers. And their conversation shouldn’t be recorded in the 1st place. And even if it was being recorded, it should be inadmissible in court anyways. A jailhouse admission to Donna of all ppl just comes off as a lazy way to write themselves out of a corner. Some episodes of Suits are great. Others can at times be pretty bad.
