Australia is that the critical junction as a nation. As a follow on from the ground breaking Uluru Statement from the Heart, Australia will need to decide, by referendum, how it chooses to recognise it's Indigenous community. Thomas Mayor is a Kaurareg Aboriginal and Kalkalgal, Erubamle Torres Strait Islander man. He is a union official with the MUA and is an advocate in the campaign for a constitutionally enshrined Voice - the key proposal in the Uluru Statement from the Heart. He is the Chairperson of the Northern Territory Indigenous Labor Network, advises the Diversity Council of Australia and the From the Heart campaign, and is an executive member of the Northern Territory Trades and Labour Council. Thomas is the author of four books, and has articles and essays published in The Guardian, Griffith Review and Sydney Morning Herald. This talk was given at a TEDx event using the TED conference format but independently organized by a local community. Learn more at www.ted.com/tedx

The Uluru Statement does not detail the structure of the Voice and how it will do its job… The details including the functions, powers and processes of the Voice, will be worked out between government and First Nations and put into legislation. What will be the function and power of TUSH? Not even the advocates and designers of the statement know. It has no discernible limits. How can the government accept a constitutionally enshrined proposal without knowing what it will actually involve? TUSH advocates must provide a clear analysis of the functions, powers and processes of the Voice before putting it into something as permanent as the Constitution. Professor Megan Davis from UNSW argues in a webinar on the TUSH website that it will force the government to listen to the constitutionally enshrined body, because in the past advisory bodies could be ignored. Legally, it is unclear what exactly being ‘forced’ and ‘listened to’ will mean. Could the government reject proposed legislation offered by the Voice to Parliament, or will it act as a fourth body of the state?

Hey, so parliament will still be able to choose whether the advice from the voice is acted on. If you have a look at the constitution it is a very basic document, it’s basically an outline for our system which is then filled in by legislation. It would be impossible to have the entirety of the functionality and structure of the voice within the constitution.

Thomas Mayo is not an Australian Aboriginal. His real name is Thomas Mayor and his heritage is European, Filipino and Dayak (Borneo).

Thomas Mayo's father is Celestino Mayor, a Torres Strait Islander of Philippine and Dayak ancestry and his mother, Liz Mayor, brings Polish, Jewish and English ancestry to the family. How does Thomas Mayo get to represent Indigenous Australians? Is Thomas Mayo really indigenous?

Gaps can be created by racism but also by many other factors, such as people's free choices, culture, and entitlements. Trying to use the mistreatment of the indigenous people more than 100 years ago and poor policies to explain the gaps between them and the rest of the country is over simplified.

Is this talk flagged as falling outside the poltical guidelines? I have read them and do not think that this talk falls foul of the following: "not the place for partisan politics, nor for extremist or inflammatory positions. Speakers must not attack or advocate for parties, party platforms, and political leaders in their talk. They must not advocate for violence or oppression. Advise speakers to focus on discussing concrete problems and solutions. Special care should also be taken with politically divisive subjects (eg. abortion, gun control) so as to avoid polarizing “us vs. them” language. Instead, speakers should focus on consensus-building and nuanced discussion. Consideration should also be given to any content that may carry negative connotations for other parts of our global audience." People need to understand that just because this proposal has a link to the parliament and the process of a referendum in Australia that does not make it inherently political. No more than anything is political - human rights in particular. If ted's flag is on this basis it ought to be reconsidered

50% of current Australians have both their parents born overseas. They have nothing to do with the wrongs more than 100 years ago. It would be best if you did not mistreat the current generations to fix the wrongs in distant history.

Every year aboriginal history gets older and older. This guy needs counselling. He is a big reason the referendum failed. I have no respect for him or his statements. As for Uluru statement, any bunch of people can get together and produce a manifesto doesn't mean we should all bow down to it.
