Community activist Luke Holland takes on an officer from West Midlands Police after over five officers are sent to McDonald's in Birmingham's Cherry Street to remove an allegedly "homeless" man who was reportedly sleeping in the restaurant.
Mr Holland, who is standing for public office in the local council elections for the Moseley & Kings Heath ward, challenged the officer, only to be labelled "immature", uneducated and "petty".

UPDATE: West Midlands Police have responded to claims that a “homeless” man was arrested from a McDonald’s restaurant in Birmingham city centre. During an incident just over a week ago, a local teenager confronted an officer from West Midlands Police after over five officers were sent to a McDonald’s restaurant in Birmingham’s Cherry Street to remove an allegedly homeless man who was reportedly sleeping in the restaurant. WM Police have confirmed the man was NOT homeless and was arrested for possession of illegal drugs and a breach of the peace. (09.03.15).

Im sorry for being rude. But. It isn't the police forces job to home the homeless and neither is it McDonalds. The police station isnt a hostel for the homeless, it is for criminals. McDonalds is a business, and if you walk into any restaurant and there is a homeless man with his dirty feet out on the side, I guarantee that you would not eat there and at the end of the day McDonalds is a restaurant and a business. Also, the police wear gloves because without being rude he probbably doesnt shower and if they're in contact with him im sure they would rather wear gloves because I know I would. But I agree with the Government being corrupt which it clearly is. But the Police get alot of stick for things that are generally out of their control. You can't complain about the police because when you get mugged, when you get burgled, who are you going to call?

***** Well it's a waste of time calling the police for such as you mentioned because they won't do anything about it. The police protect the corporations now not the people. As it shows in this video they help the business/corporation and not the people they swore an oath to help.

***** if you read the opening comment you would know that the man is question had an address, therefore is not homeless. Also, the officer in question struck me as a bit of a meathead. The teenager that vented frustration at the officer was correct in his statements but is wasting his breath talking to a P.C, who as i mentioned earlier struck me as bit of a meathead and has no authority or power to change policy.

I have no love for the police, but what you said was ridiculous, he was being very reasonable when confronted by a snotty kid who thinks he knows best, coming out with twaddle. Any business can’t let homeless drunks sleep, with his stinky socks out of his shoes, for f*cks sake, in their eating area just because it’s cold outside, it puts off customers, pubs wont let drunk customers sleep it off in the bar, part of it is health and safety and insurance ( I hate today’s health and safety nonsense,but unfortunately businesses have to abide by it). As for finding him somewhere to sleep, there isn’t anywhere, they can’t conjure somewhere out of a hat! Jesus!!!

The police were doing their jobs... Might not be the right thing to do (arresting a homeless guy for trying to find a place to sleep), and that needs to change, but the cop is between a rock and a hard place. I get the feeling he doesn't like it anymore than the kid does. If the homeless guy is drunk then the BEST thing that could happen to him is that the police take him to a cell for his own safety until he sobers up. Friend of mine recalls how when he was taken to a cell overnight he was offered hot drinks and a snack in the morning. Honestly i feel there is more to this than meets they eye, but I also respect the kid for standing his ground.

Ca Br I believe that people who think they have the whole picture then berating those who - in the long run - are trying to help is no better. The kid think he knows everything, odds are he (the homeless guy) would only hurt himself in the long run if he is drunk on the street with nowhere to go. Simple. At least in a cell they can wait for him to sober up and make sure no harm comes to him on the streets. Oh yea, totally a police state for having a little common sense. Fucking hell all you people are the same, if this was some random guy and not a cop you would take a different tune. Do people like you have ANY common sense? Whoami691 So can I take it you completely withdraw your absurd reaction in your previous post and have changed it to the policeman was defensive not threatening? In which case I'd tend to disagree considering he threatened the cameraman for "getting in his face" despite the officer being the one approaching him, was intimidating them by unnecessarily asking for ID and press passes and he was clearly posturing throughout and elected to start the encounter (can you really call it being defensive if he starts it?). I could see how you could interpret it that way though (not that I feel it's an appropriate way for officers to behave either).

Happened to me and my hubby. One yr homeless. Horrible experience. Thankfully we found a decent place and jobs. It can happen to anyone. Most of us a job loss or emergency away from this.

I normally agree with these video vigilantes. On this occasion I felt the policeman handled the little, spotty faced delinquent quite well. Who sounded like a rebel without a cause. An irritation, like a boil on your arse. And what exactly is a community activist? Or was he a journalist. Who the hell are journalists to criticise anyone. They're more interested in the Kardashians than any real issues. Maybe they should go and investigate the bankers - but that would be too much effort for journalists. it's much easier to create a story out of nothing. As for the homeless guy. That's why I eat my McDonalds in the car. First reason is I'm embarrassed to be seen eating the garbage they're made from, and secondly I don't want to share a restaurant with some smelly homeless guy with his shoes off.

They're usually good at begging for more, which they usually get. I take it you're happy to eat at McDonalds next to some guy that hasn't washed for over a week, and snoring into your McDonalds. I'm not. And I don't have a lot of money. I'm poor like 95% of the country. If I were rich, I wouldn't be eating in McDonalds. That's just mass produced, unhealthy muck that the masses are happy to swallow. I'm ashamed to say I occasionally have the odd breakfast from them. Firstly, no one knows what the person who called 999 said, secondly, you cannot just sit in McDonalds without buying anything, he could've sat in a hospital thirdly, I personally like British police (American police think they're playing call of duty too often), they keep people safe and I'm not being funny, would you want life to be like the purge constantly? Lastly, me personally would not like to sit next to someone who may smell and could ultimately put me off my meal.

McDonalds is not a public place, that being said, it is private property. The police are well within their boundaries to remove him from the premises. It's counter productive to have some child spitting speculative assumptions at the police officer whilst doing his job. The police officer has probably been on the job longer than the kids been alive and has most likely seen more homeless related crime than the kid ever will.

BALDY BRIAN 1. They are well within their boundaries to remove an intoxicated man who is unhygienic, loitering and easily aggravated, as pointed out in the video. 2. He may have the right to freedom of speech but what he is accusing the officer of has no purpose and is merely wasting time and resources in an attempt to half-assedly demonise the officer, and he is not an 'equal' member of society as he is not responsible for his own decisions, his parents still make. He is not of emotional maturity. 3. The Police officer has more experience dealing with the homeless than the kid can hope to. The Police officer knows the good, the bad and the ugly where-as the kid probably has little knowledge, and what he does know is probably sensitised bullshit portraying the homeless as misunderstood cuddly teddy bears, which would explain his lax views. In conclusion, children have no place in discussion involving extremely political matters. I'd go even as far to say people without tertiary education have no place in political matters because their emotions get too involved with their rational thinking.

So a drunk homeless man was (allegedly) disturbing the peace in a public place. The staff called the police to remove him, because they didn't want him there anymore, which they can do if someone won't get out when they tell them too. So what was this kids issue? Jesus, some cops are bad, but this guy was just doing what was asked of him. And this kid was interrogating the officer like he had just beat the shit out of the guy for nothing. Why does everyone think they are heroes these days?

Open a restaurant. Some homeless guy scare your clients because he is trying to sleep in your restaurant. Ask him to leave. He don't leave. Call the police. People on the internet defend homeless guy. In their opinion police should not tell the homeless guy to go to other place. Owners of the restaurant should let the homeless guy sleep.

When I was homeless I was treated just like this poor woman. She MUST be treated like a human being and not an animal. It angers me to no end. I have scars from the police. When I got off of the streets and started working to help the poor and homeless of Atlantic city because I swore that I would never forget that I was in that situation, I was very vocal about it like the brave person that shot this video and that makes me an enemy in the eyes of the police. I am still battling this to this day but I will never give up. Homeless people are NOT PROBLEM, they are people that HAVE A PROBLEM.

Sorry but he shouldn't be sleeping in the McDonald's. Its a place to eat not to rest and sleep for the night.The police should of took him into the station for the night to sleep, then find him a place for him to go the next day. They was right too take him out of the McDonald's but should of handle the situation better. Saying to the homeless person he be banned from city center was out of line.

Officer is 100%. I'm about to be homeless. My landlord is ill and needs his house back. I have a little girl who stays with me a lot but because it's not official and her mum gets the chid benefits I'm classed as a single man, so I am at the bottom of the housing food chain. I also house my niece while she's at uni who has no one else to support her. After the break up from little ones mummy I was homeless for 18 months. But, if a police presence is required, they need to perform their role. It is a government issue. Exacerbating the situation will not help. Take your passion to the people who can change things and be blessed. Good luck in your assistance and ventures. 👍🏻🙏🏻

Policemen in America's job is to uphold laws and protect peoples rights, not sure if their job is to also provide homes for people in the uk or not but I kind of doubt it. McDonald's is owned by someone, its not a public area, its a private business. If the owners don't want a drunken homeless guy sleeping at their restaurant, they have every right to have police remove him. If he breaks a law while they're attempting to remove him, the police have every right to arrest him for breaking that law, however justified or rational breaking that law may be, or if you'd break the law in the same situation. The arrest just puts him in jail for the night with a roof over his head, medical attention and a free meal, so who the hell cares? They acted accordingly, they can't ignore a trespassing report, and they sure as hell cant ignore someone breaking a law right in front of them.

Last i checked Mcdonalds doesn't operate a homeless shelter, If he is put in jail , he gets 2 hots and a cot , The cop is doing this man a favor by finding him a quiet place to sleep for the night, since he obviously refused to leave the restaurant if it escalated to the cops being called, At what point is it enough, when the entire restaurant is filled with passed out homeless people and there is nowhere to sit , Would you still think it's okay then

Original statement on this incident from West Midlands Police: “At around 9.20pm on Thursday 26 February officers on routine patrol stopped a man on Corporation Street who they believed to be drunk and was who shouting at passers-by. The 40-year-old was asked to leave the area. Around 15 minutes later the same man was spotted in a fast food restaurant on Cherry Street. Additional officers were then called and the man arrested to prevent a breach of the peace. Unemployed Viliam Timko , of James Turner Street in Winson Green, Birmingham was later charged with possessing a controlled drug and appeared before the city’s magistrates’ on Saturday 28 February. Mr Timko pleaded guilty and was fined £75 and had to pay a victim surcharge of £20 and court costs of £145. “We welcome members of the public filming our officers executing their duties but it should always be borne in mind that, as in this case, the footage only captures a tiny snapshot of the incident they are dealing with as a whole on the basis of multiple sources of information. “Birmingham Police have a long standing commitment to protecting homeless people and work with organisations such as the Big Issue, Midlands Heart, St Basils and SIFA Fireside on a daily basis. “ This statement was provided, and published following this incident, in March 2015.
