This lady and everyone who makes claims under false pretences should incur the full wrath of the law. Minimum she should have to pay full costs to Lidl and the costs for wasting court time not to mention the total amount received in her disability payments. Shameful attitude , abusing the laws introduced to help people in actual need. What employer would even consider giving her a job.

I'm admitted as a solicitor in Ireland and England. I practice in England. Fraudulent claimants were getting locked up over here until the jails ran out of room. Costs sanctions in English law are harsh but if you have no money to meet the costs, then there isn't much of a remedy in England.

@@tinknal6449 in both jurisdictions it is likely this was a "no win, no fee" or "no foal, no fee" so the solicitors would be able to sue for their fees depending upon the terms of any agreement. However, I've had clients do this to me in England and rarely are dishonest claimants worth suing.

@@tinknal6449 in both jurisdictions the solicitors would have a cause of action against a fraudulent claimant. Because I don't practice in Ireland I can't say how an Irish judge would react to a fraudulent claimant but judges in England and Wales have zero sympathy for dodgy claimants. But the real problem is enforcing a judgment against a dishonest client who may well not have a pot to piss in. I've had this happen to me, luckily very rarely, but it is a risk of my trade

I was an insurance fraud investigator for 3 years in the early 90s here in Canada. A woman in her late 20s claimed to have a bad back injury, but from a minor car crash. She hired a lawyer to go after ICBC (our only car insurance Corporation). They hired me on a Friday afternoon and by Monday she lost her entire claim. I got hours long videos of her, dancing the Friday and Saturday nights away from 9pm until 2am at one specific nightclub. The Sunday afternoon, she was helping 2 friends move and she was lifting multiple boxes and small appliances. I got a 5000 dollar bonus for that weekend. One of the most satisfying weekends I ever had. She stabbed me with a thousand knives with her eyes only, at her court case. 😂

There's a 5% cap monthly for reclaiming court fees or fines for UK benefits (Universal Credit). Not sure where this case was tried, but I would assume it's different there. It pays to be a scruff. You go out, work hard and get fucked, is it any wonder people do shit like this when the system helps you do it.

As a genuine sufferer from a back injury at work (nurse) it’s folk like this that make me sick. I had to stop driving, end of my nursing career, and continue to suffer from awful back pain, several falls, it ruined my life. I chose not to go down the legal path because I thought it would hamper my recovery and was just in too much pain and depressed. Employers should have the common sense to make the work environment as safe as possible BUT accidents happen, that’s why they’re called accidents not on purposes.

Eighteen years as a Private Investigator and I had one gentleman turn up in Court in an Electric Wheelchair, whose spirited athleticism in preparing himself, his wheelchair and his vehicle were vastly different to the impression he gave the Judge. My Video Evidence made no Claims, simply showed his Miraculous Recovery outside of the Court Precincts.

Years back in Australia the Insurance companies and Judiciary came togeather to see what could be done to quell the increasing insurance claims. What they implemented was all claimants must submit an affidavit that if when the case was concluded was "questioned" they would be liable for a custodial as well as financial penalty. It reduced the number of claims substantially within a 2-year period. What people fail to grasp is that these people are a contributing factor in the massive increase in ALL insurance policies in recent years and we all ultimately end up paying as the insurance companies simply pass these on to us…

I remember about 10 or so years ago I had a car accident. I ran into the back of a car while travelling at a pretty slow speed so I admit liability there. It was going through the insurance and about three weeks later she called me (for whatever reason I don't know) and said she had been to her doctor twice. He basically told her she was absolutely fine and had no injuries both times. I still have no idea why she decided to call me and tell me this. Anyway, I called my insurance company to relay what she had told me. I was stunned when they told me they had already paid out on it and given her several thousand. I protested that her own doctor had said she was fine. They replied that it's quicker and less trouble to just pay those claims and get them off their books! 🤬

Such claims mean that genuine claims are treated with suspicion. Most of us injured want to get fit again as soon as possible and just want to get compensation for what we have lost but insurers are very tardy in doing so. I have multiple injuries. Ar least one is life changing but I am working with physio to try and get back to fitness and I dont hide that from the other parties insurer's doctors. I didnt want to be hit by a car, have multiple fractures and strokes but now I am not working, missing out on advancement, lack of pay, looking at redundancy, limited use of a limb, on stroke meds and with no transport until her insurers pay out. Id love to be able to go to a gym class😂 These fraudulent clqims cast a shadow on the rest of us who just want a bit of justice.

There are two "disgraces" here. The first is the obvious disgrace of this woman falsely claiming damages but arguably the biggest disgrace is the absence of justice and the resulting deterrent to similar criminals. No wonder this country is taken for a sucker!

Running and kettlebell swings could conceivably be part of a rehab routine, but burpees are complex movements involving realigning the core while you're moving, so it's not very plausible that they would be recommended to someone recovering from a back injury.

absolutely....huge money for gp reports and for solicitors as well. that's the problem. the other problem is that most cases get settled out of court....because of the expense for small companies to hire barristers etc. Lidl could obviously afford it and the end result was great. but it's very easy to get average of 15/2O grand on the steps of the courthouse. it's sickening really.

I expect we'll see another claim from her in the future. Do we keep a record of that? If her next claim is fraudulent also, does she get any punishment?

Good video as always, To me if you want to make a personal Injury claim you would need the Xray from the hospital going into the solicitor showing the injury to have it right, a few years ago a bus driver in Galway was trying to get the full time social welfare for blood pressure issues, He was examined by a Doctor in Dublin to qualify for the fulltime social welfare and the Doctor that examined him in Dublin did discover and was satisfied that he had Blood pressure problems and put him on fulltime social welfare, The bus driver Drank a bottle and a half of Powers Whiskey the day before the examination .

@@Tck3403 Look at all the commenters here and on other videos. How many of them disclose their true name and address? Everytime I make a video I publish my real name and address. It is easy to be brave hiding behind a fake name and undisclosed address. But when you put yourself on the line with every video you make you have to make sensible decisions and consider others, including my family and business. That is the country we are living in now. Look at Simon Harris's private home and the protection he has. I don't have any.

I have known of several people with work related back injuries and their injury affect is not always constant, medical treatment can relieve some of the symptoms temporally but this often leads to long periods (days or weeks) of disablement due to overexertion aggravating the underlying injury. This is a hidden injury that is poorly compensated and the victims are faced with loads of public paid people that that promise the earth and deliver nothing. Lots of Money for everyone and poor pickings for the victim.

substantial number and they account for a massive variable in the determining of insurance algorithms that set prices of policies, so the more bogus claims the higher the inevitability of higher insurance and assurance policies.

The elephant in the room here is, Lidl challenged this spurious claim and she retracted but every day insurance companies just roll over and fork out and then pass the cost on to their customers with exorbitant premiums.

They aren't. My claim is ongoing as the other party is facing prosecution. They won't settle anything until that is done and the injuries board. Basically I am the injured party, have a bill for 11k from the HSE as it is an RTA, a written off motorbike that hasn't been settled and I'm still paying for, my meds, my travel to Dublin for outpatients, on illness benefit as on the sick and a list of injuries that made her insurers doctor wince. Not a penny from her insurers and I've had to fork out for tests etc. Maybe my injuries aren't enough to warrant an insurer to pull their finger out.( Sarcasm) Dissected artery, two strokes, broken neck, broken spine, both hands broken, broken wrist, nerve damage, soft tissue damage and cognitive loss. Unable to bend right wrist or make a fist on that hand and I'm right handed. Walk with a slight limp and have lost all fitness. I'm on blood thinners for the rest of my life. Before she hit me I'd never broken anything and was a fit hillwalker. Now it is going to take me at least a year to get back to a shadow of what I was.

Her claim may have been exaggerated, but her MRI would suggest, it wasn't false. As a safety trainer, I have often commented on the lack of adherence to employee safety by Lidl, and in fact other supermarket chains. How stupid and arrogant does someone have to be, to exercise to that level in public when you have a state pension, and claim in progress. Should the defence not have to show the cctv footage prior to the hearing, it was they who wasted the courts time. I would also ask, how the investigator, got the footage, considering Gyms have clear notices up, saying no photography allowed.
