Hello Stephen, thank you for sharing your valuable insights. While I appreciate the knowledge you share, I have a different perspective on the concept of minimum guarantees in licensing agreements. Personally, I believe that compensation should be directly tied to the licensee's success. If they make money from the venture, then I should rightfully earn from that success. If they do not profit, I accept that as part of the inherent business risk. This approach, in my view, aligns with principles of fairness and ethical business practice. I'm interested to hear your thoughts on this perspective!

Hi Stephen. I'm not sure what you mean at 2:25 when you say minimum guarantee might typically be "25% of sales". Please can you explain a little more?

If you can calculate the gross sales per year, take 25% of that and that could be the minimum guarantee. For example your product produces $1,000,000 in sales a year. Your minimum guarantee would be 25% or $250,000 in sales a year to keep the licensing agreement valid. So they would have to sell at least $250,000 a year.

Hi guys, thanks for the tips. The industry I am looking at will require a patent for sure. Is it common for the company to pay for the patent yet the inventor is still the owner of the patent. Or does the company become the owner of the patent as part of the negotiation normally - and how does that work if I have a provisional patent application?

@@Scott-KZfaqAddict great question. Everything is negotiable. We help people negotiate a licensing agreement where the company pays for the patent, but the inventor still owns it. The reason for this… in case they breach the licensing agreement you still own the intellectual property/the patent.
