The best thing you can do to improve your chances is to get a DBQ, Nexus, or Medical Statement. Unfortunately the VA doesn't want to help veterans as required by VHA 1134 (2). Every veteran should write the OIG and elected officials.

Exact thing happened to me with my mental health but after years of appeals the higher level reviewer finally confirmed my PTSD in service and via my OMAR evidence I submitted previously...After I addressed my issues with previous decisions, she sent it back for duty to assist and told examiner the PTSD diagnosis has been conceded and an opinion was needed...she stated that I have 4 diagnosis from 2 C and P exams, my VA Psychiatrist and a private doctor to include a DBQ so my mental health is service connected...it was sent back on the 20th of June so I'm still waiting.

If he injured it in the service then what happened afterwards was an aggravation of a pre existing injury.

So happy I found this. I’m currently at 90% but unrated for the injury I’ve dealt with the longest. When I finally filed I was denied basically stating too much time lapsed between injury and filing. I filed on my own with little understanding of the process so my filing was probably grossly underdeveloped. Can you provide contact info so we can possibly discuss. Thanks in advance.

Thanks you Rachel, we greatly appreciate you showing us this. I would greatly appreciate your insight into a situation I've experienced during a C&P exam In October of 2023. I had a C&P exam for MST/PTSD of which was denied. During the C&P the examiner noted a "favorable finding" of insomnia but claim it was due to long hours at sea and shore duties and not the tinnitus or migraines that was actually causing the insomnia as I had explained to him. Of course the VA denied the favorable finding along with the MST/PTSD that I was claiming. How do I get the VA to correct and recategorize the favorable finding (even though I did not file for this in the first place) as a secondary to my tinnitus and can this be retroactive to 2023 when the C&P took place?
