Some inaccuracies and/or missing information about this election: 1. Recounts must be state-wide, no provision exists for recounts of cherry-picked counties. 2, The Gore position was that they were not asking for "recount" but that some votes were not counted, and thus he was asking to "complete the count'. Much of the legal positioning revolved around how legitimate this difference was. 3. Courts recognized that in every election, some votes are miscounted or erroneously not counted. This is just a matter of statistics when millions of votes are cast. The expectation is that both candidates will suffer equally from these aberrations, and the net effect will be equal. 4. The Gore position then was clarified to say that because these 4 particular counties were heavily democratic, the aberrations here had an unequal effect, in other words, he was hurt more than Bush. 5. The Gore camp did not particularly want a state-wide count, because this could not be absolutely relied upon on to benefit him, it could just as easily have hurt him. As an example, many thousands of absentee ballots from servicemen would arrive and be counted. These ballots often arrive late and are not counted (even though legally they should be), and servicemen vote overwhelmingly Republican. Florida has historically had a large number of servicemen. 6. The Gore position crystallized around the idea that he wanted to "complete the count" in these four counties, and to do so the recounters must attempt to interpret what the voters INTENDED when they cast their vote. 7. The courts eventually rejected this position. Their judgement was that government must treat voters like adults. Government does not go to the voter's houses, and drive them to the ballot, nor sit in the voting booth explaining to them which button to push. Government must rely upon the voter to take himself to vote, to examine the ballot himself, and to select his candidate, and ask for assistance if he finds the ballot confusing. 8. Likewise, the courts rejected the attempt to call the desired actuon "completing the count", instead of "recount", and judged that a recount can only be done state-wide, and according to the laws of the state. A candidate may not demand a recount in only a few counties, or violate other state laws relating to time limits for requesting and completing a recount. 9. Similarly, the courts decided that a candidate may not demand that ballots which were discarded because they were not completed correctly (ie: hanging chad) should be re-examined to try to determine what the voter INTENDED. If the voter failed to use the voting machinery correctly, his vote does not count.

What really made the Florida Recount into the fiasco which we all remember was Winner-Take-All. That's the game where the Big Two Parties play for all of a state's electors by winning the minimal popular majority possible; it also shuts out any potential third-party candidate from the tally. Winner-Take-All put all 25 Florida electorships at stake. If that state had vote-by district like in Maine or Nebraska - where only two electors are chosen statewide, the rest by congressional district - then only three electorships, not 25, would have been at stake in a recount. Florida would have split 14-11 for Bush. Not that anyone would have cared because, instead of Bush 271-266 Gore, the final tally would have been Bush 260-277 Gore. You read that right: Gore would have won the 2000 Election if Florida had vote-by-district. Funny how the mainstream media never picked up on this.
@BenjaminWirtz9 жыл бұрын
Yes and I have 2 things that could help with this. The Maine-Nebraska method, is opposed to the winner take all, it is proportional electoral votes. As for giving a third party a better chance, I think ranked choice voting would help. Of course the two parties have such a strangle hold they wouldn't' allow that and would even cheat to avoid it.

One of the things that killed Gore was 2 fold...1) the elian Gonzalez issue. A lot of Cubans who would have voted for Gore went out in huge numbers (highest ever) and voted Bush. A lot of Cubans felt betrayed by Clinton and gore was guilty by association. 2) Miami had a VERY popular cuban mayor named Alex Penelas at the time. He denounced Gore and said something to the effect of Gore was a low class garbage of which Gore said Penelas was one of the most vile people he has ever met. That to did not help him. Add in florida being run by his brother (bush) and so on, and well that's also how an election (at least fla) is lost.

I agree. I know why Gore chose Lieberman. He was known as very squeaky clean and very religious. However, he was also boring as hell. Gore should have done one of two things that could have saved his campaign as far as picking a VP. 1. Pick out a running mate who is more well known and/or is very likable, and very charismatic and exciting that would energize more Democratic voters to the polls. 2. Pick out a running mate from a big key battleground State that could help you win. Say if he would have picked Sen. Bob Graham from Florida at the time, or a Rep. Dick Gephardt from Missouri, one who would appeal to more voters, that could have helped him win the election. Instead, he chose Joe Lieberman who had as much personality as a dried up piece of toast.

robtoe10 We need the electoral college. We are not a direct democracy and we do not go by the popular vote for an important reason, and that is so that 3 states wirh high populations do not throw the election. Electing the president based off of what the densly-populated urban centers wants is a great way to exclude most of the nation. The EC gives the most even and equal cover of power to everyone. And the fact that 3rd parties do so poorly is entirely because of the way people vote. Despite what people say, they are satisfied with the 2-party-system.

Good example of how independents drive elections. The turnout was so awful for this election, the bases ended up canceling each other out. 2016 is another good example. Huge amount of undecideds on 2 very unpopular candidates late into the cycle. One candidate had the bigger Presidential base, but needed enough indies to bring home a electoral victory while the other needed a big enough indie surge to squeak out a electoral victory with a popular vote victory being close to impossible. Indies swerve to the other candidate late in the process and create another electoral victory "surprise". Independents control elections. Period. People talk about based, but those undecideds are usually not affiliated with either party.
@rzxwm1012 жыл бұрын
The 2-party system is horrible in our country. There is no change, and both parties are very much alike. Any third party can't even compete with the 2 main parties, whom has rigged the election process to exclude and ignore 3rd party candidates. I'm sure there are issues with multi-party systems too. I personally prefer a system where people would vote on issues, and the candidate who most embody those issues is selected.

@Jaxen908418 жыл бұрын
Somehow, Mr. Hughes seems to be lacking in the actual mechanicals of what happened here. If I may be so bold.... According to our United States Constitution, (Article 2, Section 1, Clause 2) State Legislators are empowered to chose the state electors to the Electoral College, nobody else. The Florida state legislature was Republican. The left leaning Florida Supreme Court stepped in at the request of the Al Gore campaign. The court never had any business to do that, but they were intent on directing the Florida election board to recount the votes under increasingly flawed standards. Recounting in only a few districts for example. The Supreme Court intervened in the 2000 Florida election not to chose a President, but to reign in the Florida Supreme Court from over stepping its authority. According to the Constitution, the Florida State legislature was the only body responsible for settling this issue, not the Florida Supreme Court. On November 26, 2000 after Florida's returns had been certified by Katherine Harris, Governor Jeb Bush sent a Certificate of Ascertainment to the Archivist of the United States certifying the election of the Republican slate of Electors to the Electoral College as required by federal statute. Once Jeb Bush did that, no authority, State or Federal, Legislative or Judicial, could force him to withdraw the certification. Now, his certification could have been challenged in Congress when the Electoral College votes were counted, but federal law recognizes no other authority, other than the Governor, to certify the Electors. Second, once the electoral votes were counted in Congress, a challenge of the Florida vote would have required a majority vote in each house of Congress. An unlikely scenario since the House was controlled by Republicans in 2000. You need both houses to do it, but the Republicans controlled the House of Representatives. Even if that hurdle had been jumped, the House would then have been required to chose the President of the United States by a majority of the State Delegations. Again, in 2000, the House was controlled by Republicans. Had a challenge still been made, the Senate, which was split 50/50 along party lines, would have selected the Vice President with the Pres′ident pro tem′pore. Al Gore, the sitting Vice President, and running for President, would have essentially voted himself into office. He would have had the deciding vote if both parties voted 50/50. That was the only path Al Gore had to the Presidency, but it was never going to get that far.
