I had a similar story but was lucky as the other persons insurance company paid out in full in the end .Whilst reporting my accident details etc my insurance company offer me a FREE courtesy bike & arranged collection of my bike for assessment. Bike arrived and was told too sign for delivery it was only after a few weeks I cottoned onto it actually being a hire bike so got it picked up & then prayed I would not be left with the bill.

Every rider should at least talk to a motorcycle lawyer if they get into an accident. After talking to mine after a low-speed crash I found out that half the stuff I was told by the police on the scene and my insurance company was a lie. Even if you have to pay for a couple hours of their time it's so worth it.

Police don't won't the paperwork, my Mrs was knocked off her bike doing a turn, it was her right of way, and cage driver came straight across a yellow line and hit her side on, I was there, and copper threatened to nick me as I was advising my Mrs not to say a thing at the time, as she was in shock, copper tried to get her to admit some blame, what he didn't know was that she was a senior insurance broker of 11years, and I know the local law better than most of the cops here, she got a full pay out, even though the other party tried to put the blame on her.

@@BeanieBiker_AutisticRider Yep, not sure what country you're in but the cop that was dealing with me kept trying to get me to say I was riding my bike with a broken rear brake. He thought I was because I went down on the right side of the bike and I couldn't show him the tab and kept telling me he was doing me a favor by not writing me a ticket for riding too fast when I was going the speed limit. That's when I learned to never admit to anything on the scene to anyone until you talk to a lawyer.

They are a complete and utter shambles the lot of them.

When I got hit and it went to court the hire charge was reduced by the judge. They know it is overpriced and my lawyer had authority to negotiate the hire charge. So there was an understanding in place already that they're gonna be cheeky but it will just end up getting reduced. The law firms your insurance offer you are just call centres who might hire a lawyer if, in the rare occasion, it goes to court.

44Teeth - thanks for this insight. Also after an accident where other party is to blame (and you are fully comp) it is becoming more common for your insurance company to advise you to deal direct with the other person's insurance company so that you can get your excess back. I had a hire bike from Plantec a few years ago. I was concerned about the delivery note being a long hire agreement so got them to confirm on the phone & email that I would NOT be liable for the cost if the insurance companies found me in any way liable. They categorically said I would not liable for the hire bike costs and that Plantec take the risk and the cost when they offer it. I don't know if this was really true or not ? Luckily my helmet cam caught the accident on video and the car driver was found 100% liable so I won the claim anyway, but I'll never know if I could have been hit with expensive bike hire charges if it had gone the other way or 50/50 ! These firms are lying to get a signature through false pretences, which is FRAUD ! They should be bloody shut down and judges awarding these innocent victims getting caught out by these liars !

As mentioned in the video this appears to be the "Paralegal sausage factories" so is this something that can be avioided by selecting insurers, or for example when does a legal entity such as white dalton get appointed and how can we avid the bad apples. Other than not taking an unnecessary hire bike how can we spot and avoid getting ourselves in these situations?

The problem is the law of liability and negligence. Both are not linked strongly enough with the law to mitigate losses. The law needs changing so that mitigation of losses must be present and evident in any claim for negligence at the point of claim. If not then the claim should be invalid.

They do this on cars too,, someone crashed into my car so my insurance company told me to get a hire car etc. The damage to my car was small £1500 but the garage had my car for a month and the hire company charged my insurance £10,000 for 30 days and they wanted me to go to court then the threats started but it got sorted. So beware of the 3rd party hire companies, you can contact the underwriter direct and get them to deal with your claim not the broker that’s what I did in the end the underwriter was really helpful and basically told the broker what they was going to do 👍

Had this same situation. Broken brake lever and scratched body panel they made my bike a Cat C. They took the bike to 'inspect' after the crash and when taking my bike gave a replacement (I had a Divi 600 and got a Bandit 1200). After a month of calling every day to them I finally got through and demanded they return my bike and take the 'replacement'. Best choice I made. They did everything to keep it which to me was a theft and I threatened legal action to get back my bike. Same thing, thousands charged to guilty party for hire and storage also 'inspection'. Bike came back filty - and the delivery guy showed me photos... the 'storage' is not even covered just a dirty old yard whith out proper security. After that I stopped claiming anything. Do it myself.

Hi, so what is he saying then that if you have a crash, you should always go through your insurance even if the crash isn't your fault. When I had a crash previously I was given a courtesy bike for about 2 months racking up a similar bill but I haven't been charged for that. The bike was under 4th dimension to be repaired and they gave the courtesy bike but I was told it was repaired with all kawasaki parts. I went through the 3rd party insurers though and they put me into contact with a claims management team. I do remember though when the courtesy bike was dropped off there was quite a lot of signing done and I remember worrying about the cost but was told it would be charged to the 3rd party.

@1coverracing

So the important reason why this happens is that the insurer, or the accident management company who may have got your details from one of the insurers or a variety of other methods, gets a large commission. In the car world where this is even more common, you might be paying 450 quid a day for a golf which you could walk into hertz and get for a quarter of that - and whoever got you into it is getting a hefty commission in effect (it can be a referral fee or other things). It's best avoided unless a) you're sure it's the other person's fault, not just "yeah of course it was", and b) you actually need it. I work for an insurance company and we just tinned a 60,000 hire bill for a porsche which our policyholder had tapped the back of, doing 2k of damage - but we were fairly lucky to screw them on it. Often we'd be lumped with a large portion of that bill, and it's always you that pays for it in the end...

Just amazes me, through all of this and the detailed explanation there are still comments about '...insurance company scum...' and the like. Who 'owns' us the customer?; the Insurance Broker. Who do we call first when we are in an accident?; the insurance Broker's appointed 'paralegal sausage factory'. Who do you think creams off the fees from these credit hire and credit repair (in non-Fault claim scenarios) claims?; the 'paralegal sausage factory'. These (broker) profits come from admin fees, cancellation fees, instalments charges and yes, kickbacks from the "paralegal sausage factories" for introducing us - the customer - to them on a claim; the insurer is left picking up the cost and every £1.00 paid by them in awards less than £0.30 does to the injured victim. There's a reason why these accident management firms are privately owned and don't publish their annual accounts....

I’m lost, I’m from Yorkshire I’m not the fastest haha 😂...if the accident isn’t your fault surely all claims go onto the other parties insurance and if the accident is your fault all claims go onto your own insurance, so hire & storage costs will go to where accident fault is?

The problem is unscrupulous companies are exploiting that logic, to a point where the other party's insurance can go to court and claim those fees are unreasonable. Said unscrupulous companies then come after individuals for the money.

I have a "friend" who also has a dirty little secret, he takes it out and plays with it at the weekend too, it does NOT involve any grinding of paralegal sausage though... ... ...
