@@lucybee3361 She listens but this is a civil court , the abuse can only be tried at the criminal court and once the wife chose not to go to the criminal court its obvious they don't want to jail their husband. I don't think its right for the judge to complicate marital issues brought to her for resolution. The law requires the judge to first try and reconcile couples before granting divorce. Divorce is not automatic in Nigeria

The Judge only advised them to seek help from marriage professional to which both man and woman agreed. Judge also told them that after counselling they should come back if their position on divorce does not change. What is wrong in that? Secondly the couple are not living together so no one is endangered, thirdly on the issue of violence, this can only be tried at the criminal court. The wife is obviously not ready to jail her husband she would have gone to the criminal court, the Judge is smart to see through this. The judge can only grant what is sought for. The judge told her to come back after six weeks for divorce if things does not change, that's what the law mandates her to do

I dont think the judge said the wrong thing here my dear. The decision is very right. Before anything else these two people once loved eachother. Judge Funmi didnt say they should live together so put any chance for violence away and think objectively. This is marriage not courtship. I am amazed at the judge's counselling and solution to help it work again before striking her final decision. Very inspiring for aspiring judges.

I am so disappointed with this episode and how the Judge handled the situation. The Judge needs to educate on domestic violence. I feel she should have been strict with the husband about him even slapping but she wasn’t. She needs more experience

The judges decision was to protect her. If wife insist on divorce and the husbande does not want, he will kill her and the judge knows this. It happens a lot in America. Divorce initiated by wife means the wife will soon die.

Nobody is going to be beaten much less to death with this judgment, they are living apart already, she knows him inside out, she claimed to have known him as an angry man before marrying him, he has beaten her three times in fifteen years which I condemn but he may be able to improve on himself after the marriage counseling, they are adults, the judge left the line open to grant a divorce if the marriage counseling has no positive influence. This is not western world but Nigeria, Nigeria law does not encourage divorce, the law mandates a judge to first reconcile couples and where it fails she can grant divorce. That's what the judge has done. Issue of domestic violence can only be tried at the criminal court and its obvious the wife does not want to send her husband to jail that's why she refused to press charges at criminal court. This judge is smart and highly competent. I advice you to get yourself familiar with Nigeria law

For some people that think the judge is biased, she did the right thing regardless who is at fault. For me both sides have got their blame, she needs to start keeping her martial issues between her and the husband either current or new one or else she would have the same problem in her new relationship. And the man has some anger issues that needs to be sorted before it becomes deadly. Lastly, marriage or even living with someone is not as easy as people make on the social media, remember your siblings action then think of such things happen in 10 or 20 times, that's marriage, sometime sweet or sometimes bitter. They both need counselling.

Understand this if you don't know, marriage is not a game of hurt me I hurt you in return, marriage is meant to be filled of good memories. If your wife, husband or partner hurt you, you don't have to take to revenge to score point, best solution is sort the situation or bow out peacefully. In this life we are not meant to make things difficult for each other.

Seeing this woman's story is so beautiful and her stoic demeanour brought tears to my eyes. While I was relieved to see that humanity still exists in the comments I also felt a touch saddened by the multitude of criticism of the Judge's advice. Everyone is looking for someone to blame, when I think the problem of inequality is very complex and cannot be solved from the outside looking in. Often third world countries have a complete political system which needs to be dismantled. It's like complaining about the spec of dust in someone else's eye without seeing the entire log in ones own. Stories like this are the price we pay for living in our relatively sheltered bubbles. How many of the people disapproving of the Judge's advice know anything about the rich tapestry of Nigerian culture and traditions? I am not saying every Nigerian is affected by the socio-economic issues that arise with poverty (fun fact; Nigeria is the richest country in Africa). But we know domestic violence is common internationally in lower demographics. You can't judge this case by western culture and ideals, the woman is not coming over to a 2nd or 1st world country where her survival is less dependant on customs and traditions, or her ability to bare child (albeit, I have heard that Nigerian culture is fast evolving).

Scripture also says that divorce is permissible in cases of adultery. Once again, this man has given his wife permission to leave the marriage. @@YT4Me57 Divorce is permissible in the case of adultery but they are rules also to that effect. They must remained unmarried except one of them is dead. So, to this effect you must understand that if he or she remarries another, he or she commits adultery. And if you sleep with another, it is also a sin. But the scriptures said, love is the greatest commandment: thus we must forgive to be forgiven. If GOD forgives our trespasses, why not forgive those who wronged you too so that you can also be forgiven your trespasses? GOD is faithful even when we gave him every reason to turn HIS back on us. Like the scriptures said, For GOD so love the world that he gave HIS Son as a propitiation for our sakes. As it is also written: But GOD commended HIS love towards us while we were yet sinners not when we were perfect.

@ Lurman Nesbary - l agree with you to an extent. But that's the reason the Judge is a "Judge" they look at the circumstances of the situation and the likelihood of it happening again. And the result she advised "Anger Management" classes to help the man. Can you put your hands on your chest and say you have never created (it does not have to be physical) out of anger or frustration or attempted to? Jesus said in the Bible and l quote " if anyone of you have never sinned before be the first person to "cast" or throw the stone". He was referring to the lady that the Israelite wanted to Stone to death for committing an act of "adultery". I rest my case.

@ Ozioma O- don't let your emotions cloud your sense of reasoning/judgements. He did not cheat on her for 15 years. That was never said in court not even by the woman! So where did you get your own information from? The child they are talking about is 9 months old and they have been married for 15 years. The man said the reason he went out was because his wife and her family believed he was the one with a problem and he was being insulted because of that. Hence, he tried another woman and she becamepregnant. Whilst l do not condone what the man did l can understand his predicaments. And the insults were not coming from members of his own family but from his own wife and his wife's sister! The woman never once said in court that her husband's family insulted her for not bearing a child for her husband or did she? We need to be careful with comments we post and not to be narrow minded about a situation or go the "gender" way which is typical of most women.

Those of you blaming the Judge need to understand how the Nigerian court system works in marital situations. Judges are always reluctant to pass a divorce judgment even when it's obvious. It would help if you find out how much it costs in Nigeria to process a divorce. The idea is to discourage couples and find common ground to make the relationship work.
