Football is a multibillion dollar business with a multibillion dollar tax bill, and there is no league which is more lucrative or pays more tax than the Premier League and its twenty clubs.
Now world football's biggest and richest league is at the centre of a tax scandal though, accused of having avoided hundreds of millions - if not billions - of pounds worth of tax, predominantly through the structuring of agents' fees and players' image rights deals.
So in this video, HITC Sevens takes a look at those accusations, the counter-arguments, and how likely an impending reckoning might be.

Those of us who can't avoid tax have no choice but to lose a significant amount of our earnings that we could really do with in the current financial climate. The ones who can exploit these loopholes CAN afford to pay tax but won't. And in a nutshell that's pretty much everything wrong with the world isn't it

Great video as always. I think you should make one about Argentine football and how much of a mess it is right now, there's 28 teams in the first division and the league format was changed mid-season. I think it'd be interesting to highlight it considering that we're currently world champions but have a disastrous league.

Tax rules are what they are, and it's in a person's or company's best interest to minimize their own liability. Governments put loopholes there on purpose to benefit themselves and their backers/friends/family etc. The fact that they, and the tabloids, tend to focus their ire on footballers is entirely a class issue. I'm pretty sure you've talked about that before. What are the chances that clubs and agents are taking advantage of players in issues like this? Often working class, and focused on football rather than education from a young age. They know the tabloids will eat them up as scapegoats

Cristiano Ronaldo has literally only ever moved clubs for tax avoidance purposes. He moved to Spain as soon as they lowered their top income tax rate in 2009, then when Spain increased tax on top earners, he immediately moved to Italy who had just reduced their top tax rate, then moved to England to the only club that would agree to his wage demands, and then got off to the depths of society as soon as an opportunity to pay 0% income tax arose.

It’s not tax avoidance though like even you could pay less tax it’s just you don’t have an accountant who knows how to pay less taxes. It’s actually funny to see people react like you because you don’t understand taxes, I don’t understand taxes, we don’t understand taxes because we’re not the HMRC or accountants and yet people like you think you know what these people should be paying when you don’t. They use loopholes created by the HMRC

This must’ve taken ages to research! Thank you for tackling a very dry subject that is very important. Do you think the players actually understand all these tax laws and avoidance measures? I would be very surprised if they were fully aware of what’s going on because it’s extremely complicated. Many regular people cannot understand the cryptic acronyms and numbers on their own paycheck in their own language in their own country. Having said that, I do understand why they are held responsible for anything that has their signature on it. Thank you very much for the video!

Alfie you should really consider doing a video on the Bosnian men's national team, from being ranked 13 in the world in 2014 and qualifying for the World Cup in Brazil, to not qualifying for a single tournament since, yet managing to win their uefa nation leagues group, but genuinely hitting our lowest point with a 2-0 defeat to Luxembourg. Aging players, players who represent other national teams that are eligible to play for Bosnia but aren't seeming interested, just the genuine geopolitical mess that Bosnia is with how the Dayton agreement was meant to simply end the Bosnian war yet became the country's de facto constitution. I think it would make for a very interesting video, and could even span additional videos like how Velez Mostar are forced to play away from their original stadium in Mostar as it is on the Croatian side of the river, with their old stadium being taken over by Zrinjski Mostar. A club that was actually banned in Yugoslavia because of their nationalistic origin.

This may be new to football but it is not new to some industries. The creative industry (actors, directors, writers etc) runs on a similar fashion between the publisher (Paramount, Sony, Netflix etc) and the "contractors" (actors, directors, writers). So if they do go after football players over image rights, then it will become a precedent to all the above. I doubt this can of worms will be opened.

The agent wouldn't get the amount after tax from the the footballer they would get the full £500k (but it will be after the football has been taxed on it), less vat for their services as they are likely registered as a company. The only difference is between the two situations is that the club could claim it as an expense and reduce their corporation tax. Agent would get the same fees either way

I have to be honest, no matter how much someone earns, the amount of tax that has to be paid to the country is absolutely outrageous. Seriously, F that. And the fact that big companies are paying very little tax to get even richer while employing a lot of people who then pay a lot of taxes on their earnings is...I can't even find words for this. It should be completely illegal. I bet the players of Austrian Wunderteam didn't have to pay so much tax 😇✌.

I mean, if the club pays any part of the agent's fee, shouldn't the agent then pay income tax on that, seeing as it was a payment made by a business (that business then claiming that tax back for exactly this reason)? So if the club pays a player, who then pays the agent, the agent shouldn't pay income tax on that, because that income has already been taxed. That is not the case with any amount paid by a business to that individual.

A scandal that doesn’t exist Yh crazy stuff Every single player and agent is paying taxes they’re just using the HMRC or other tax body rules to pay less That’s not a scandal it just shows that taxes are less for rich people as they can afford accountants who know how to pay less tax It’s impossible to complain about this type of thing because the only way they can do this is because the people who collect the tax say they can do this

@@tetrafootball professional gamblers don’t pay tax because casino winnings aren’t taxed are they avoiding tax or are they just following the rules made by the taxman. That’s what it all comes down to if the hmrc had stricter tax rules then maybe they’d pay more tax but they want to pay the minimum amount and the hmrc let them as they made the rules

I should be so lucky to earn enough to be on 50%tax but that's NEVER how the top earners look at it... They should count themselves lucky that it's not at 90% as it once was over a certain limit...

I don't see how you can fault the clubs, agents, or he players. From your own words they are doing nothing more than following the wording of the tax regulations that are in place. So it's not a scandal or a scheme. It's the advantage of having tax lawyers and accountants that now how to interpret the laws. It's called loopholes, and it's the fault of the governments that write the laws, that these loopholes exist.

This is a classic case of "Rules as Written" versus "Rules as Intended". Let me give a simplified example of it: You've just baked a cake and your child wants to eat it, but you baked it for a party happening later that day. You say to your child "keep your hands off the cake". The child then walks over to the cake and, hands behind their back, takes a big ol' bite of it. Now, they kept their hands off the cake. They interpreted the rules correctly. Their hands were nowhere near it. By your definition, that wasn't a scheme, they just used a loophole by interpreting the law. Realistically, though, they knew they were purposefully misusing the rules to their own advantage, and that's where this comes in. Now, of course, lawmakers have a much higher level of responsibility when it comes to writing ironclad laws that don't allow for shenanigans, but at the same time, doing something you shouldn't just because it isn't explicitly written somewhere is still wrong. That's why there's court cases for this type of thing; the burden is on the prosecution to prove that the clubs are purposefully skirting laws in order to avoid paying higher tax. It's also the difference between avoidance and evasion, as Alfie talked about in this video.

HMRC and their equiv in other countries poke themselves in the eye but not attempting to tax income made overseas but British subjects therefore, for example, F1 Drivers bugger off to Monaco so they pay no tax at their actual home country (and in many cases, the actual home and workplace of their team)[not trying to display bias here but think Hamilton and Mercedes] - that is plain wrong. The US on the other hand does not care if you work in a tax ex nation, eg KSA, their IRS want their share and pursue it too. If companies house in the UK were to apply the rules to eg EPL teams many would be wound up as they trade while insolvent or rely heavily on fatcat owners bailing them out of huge debt holes. Is the game corrupt - absolutely and that starts right at the damn top - FIFA. Tax reduction is one thing, evasion and avoidance is another. Time to start binning those found guilty.
