The Persona 5 Protagonist or aka, Joker, highlights many sociocultural issues that are unique to Japan's criminal justice system. This is due to Persona 5 and P5 Royal's unique premise, which deals particularly with Japanese cultural issues. This video analyzes Joker's character under the appropriate sociocultural context.

Recommend reading: "The Japanese Way of Justice: Prosecuting Crime in Japan" Davi T. Johnson. It lays out the process of investigation, arrest, interrogation, trial, conviction and sentencing. While the the 99% rate is _true_ there are mitigating factors: prosecutors are appointed, not elected, so they don't have the pressure of a punishment-hungry electorate, prosecutors are given vastly more time and resources to conduct investigations then their American counterparts and, crucially, prosecutors are the only officials that can press charges; if a prosecutor doesn't think they're guaranteed a victory, they don't prosecute. Finally, a failed prosecution will derail a prosecutor's career, which hopefully acts as a deterrent to bogus or frivolous prosecution. But... if an innocent person gets charged, prosecutors will go to extreme lengths to protect their career, and the reputation of the Japanese procuracy.

This puts into perspective a small detail they added in Royal that can go unnoticed. P5 Royal changed the Rental Shop mechanics to an annual membership where you don't have to return the movies you pick up anymore. They ask Joker to sign the contract for the membership and Morgana, who's in his bag as usual, comments on how his hands were shaking while signing the papers. Joker has a trauma from being charged with assault, likely suffered enormous abuse from the Police and was forced to sign a confession under duress.

That's after the fact. Joker was most likely not beaten after the Shido incident as we would have been shown or told like what happened after Sae's palace. Joker signing the paper was just normal anxiety regarding signing his initial confession to the assualt of Shido.

As someone who has visited Japan for work nearly every year for the past 30 years, and who does not look like "The Typical Westerner" (I'm 7' tall, weigh well over 350lbs, powerlift as a hobby, haven't had a haircut in many years, have a large beard, but wear nice suits for work), I can tell you that I have been hassled by the Japanese police so many times. I have had trips where I have been stopped every single day that I was there (and sometimes I'm there for up to 3 months), and often multiple times per day. I work with the Japanese government, and they actually assign someone to hang out with me full-time while I am there, to mitigate and minimise the police harassment issue. Over the years, I've accumulated a lot of stories regarding both Westerners and native Japanese being railroaded by the police. it's a real issue. In many countries, a bored police officer can be a bad thing, but in Japan, it can be a dangerous thing.

I've already seen other comments talking about Ace Attorney, but it's highly recommended if you want more satire of Japan's justice system. One thing I'll add is it really relates to what you said about defense attorneys in Japan: the idea of Phoenix Wright as the loveable underdog hero comes across as weird to some westerners, who are used to defence lawyers being demonized. In Japanese fiction, it's more common for prosecutors and judges to be demonized, and... it should be obvious why from the subject matter of this video. The fact that all the playable lawyers in the series get basically no respect in both the court and daily live seems pretty accurate too. (The one time Edgeworth takes over as defense, he's so surprised at the drastic change in attitude that he wonders if there's a giant "kick me" sign attached to the defense's bench) 13:37 Not only that, he's willing to go out of his way to get arrested again and endure all that once more, just as part of their plan. I think the term "Enzai" showed up in Ace Attorney, pretty late into the series. In Dual Destinies someone has a plush rhino that comes from a compaign against it. It got localized as "Bum Rap Rhiny", but from playing the Japanese demo I think the equivalent phrase was "Enzai yamate kudaSAI" (it being a rhino is a pun of "sai" meaning rhinoceros) The whole issue with Maruki's reality I think also relates to abuse victims and those who've suffered tragedy. Maruki wants to help by making it so those traumatic experiences never happened. It's true that what happened to all these people was awful and shouldn't have happened, but I feel Joker and the Thieves' position is that pretending it never happened would be an insult to all the growth and strength they've shown in moving past their hardships.

You’re right about Ace Attorney. It was one of the things I thought of too since I got a bit obsessed with the games. I saw some videos with real defense attorneys talking about the first anime episode or the first case of the game, but I had an issue since they were AMERICAN lawyers. Which is fine and an interesting look into the legal world, but ultimately ineffective at grasping the point. There was no jury in Japan, you were guilty until proven innocent, and you were basically screwed because prosecutors didn’t lose (not ti mention the first case is tutorial so Phoenix being unsure is partially a way to tell a player “you may not know how to do this, but...”). This gives specific and neuansed motivatiobs people overlook, but I won’t go into detail because spoilers and because I’d be here for hours. While the game is localized in America to make puzzles easier and some details are lost, I think it holds strong to it’s core meaning. I hear people complain about how the police aren’t helpful and how defense attorneys should stay out of crime scenes and this is also a culture gap. It’s a satyr so parts are exagerared, but it really holds to it’s idea of showing just how dumb the legal system was. An analysis like this for themes and characters in AA would actually be very fascinating honestly. Same as I hear people complain how harsh people are of Joker’s record, but that’s the point. A lot of that was mentioned in the video though.

Another great video! I'm kinda grimly fascinated by the "guilty until proven innocent" mentality of the Japanese justice system ever since discovering Phoenix Wright was actually a satirical look at the "hostage" justice system. It was sort of a rude awakening when I realized how screwed up it was. But I didn't know about denying lawyers. Oof. And, another good game that involves the justice system, honor and shame, I'd check out "Judgment", from Ryu Ga Gotoku studio. It's very interesting and requires basically no previous Yakuza knowledge, so it's a good place to start the series too. And, with Joker, his sense of justice and his will of rebellion are deeply connected. Not only is Joker, due to his experiences, more likely to doubt power figures, but in my reading he is also very well aware of what it feels like to be wronged and having nowhere standing for you. And that goes all the way back to the justice system, and how someone wrongfully convicted like Joker feels completely left out by the system's workings. And, last but not least, really appreciate you linking the sources on the description. Makes for a pretty good way to branch out on the things you present! Keep up the good work!

Being Asian (Chinese) and American, I understand both sides pretty well, shame vs guilt. It's still really really sucks that Japan is such a mess in their social issues and criminal justice. I remember watching another person's playtrough in Sae's Palace, they mentioned just how the 99% conviction rate is a huge issue esp due to prosecutions being biased and went on a longer tangent about this issue, esp Sae's stress as a prosecutor. @@Chameleonradio Yet in Americs I have legal protections thst even *exist on paper* to raise complaints. We seen many cases of people held for murder charges where they got the wrong guy. Lost 10-15 years of hos life. Now me I don't know if you could *ever* put money on that but the fact they try is something. In America they need more than just "I think". They need to place me, they need probable cause, to even get to trail. They have strict rules to follow and if not not only may if void any legal trouble because now it can't be told what is true and what is bs, but can cost *alot* of money. That's because it even exists as words on a sheet. Compare that to what I understand is nothing at all like thst. Just trust the authority it knows what it is doing. I will still take the US infinite out of infinite in that legal prospective so at bare minimum my chances at fighting something bogus will be better. Being pulled in for shoplifting and questioned isn't the same as being held with no court proving guilt of the accusation you murdered your child with no way to even get a lawyer. Loved the video Lady, I was looking forward to it and I was most definitely not disappointed! On the game side of things, Joker is one of those characters that shows subtle consideration for the Player and Character dissonance. In many RPG's the writers will either try to give the protagonist a full character and personality without taking the actions of the Player into account or vice versa, making them a blank slate with no interesting character traits in order for the role-play aspect to be front and center. While either extreme does work for certain games, I've found a lot of other games try to provide a middle ground between the two, which ends up pleasing very few in the end. However, what the developers of Persona 5 did with Joker provides a very good example of that middle ground protagonist. He isn't just a blank slate for us to insert ourselves into, as he possess' his own backstory that's integral to the plot along with motivations and wants that gives his actions and our choices as the player meaning. If we as the Player are able to understand Joker and see what he as an individual is trying to do or wants in the end, then we are able to see his story come full circle as opposed to ending it early and getting a "false" sense of satisfaction whether that be through the "Bad", "Selfish", "Good", or "Ideal" endings. Only by seeing who Joker is and how he continually takes the long road towards freedom do we finally receive the "Real" ending of Royal. A very similar idea to what Persona 4 did with it's "True" ending but more character driven on Persona 5's part, I've personally found anyway. Also, you're video has definitely made me think when it comes to the issues present in Japan. I thought I knew how harsh the Japanese justice system was but I had no idea they were allowed to hold someone for 23 days without having to file charges. That is a very terrifying prospect on top of the prosecutors ability to block access to your lawyer, as well as the mental and physical abuse of their suspects to force confessions out of them. It really shows how they received that 99.3% conviction rate...

Wow great comments on the "silent RPG protag" and the player/character dissonance. When you put it this way, you can really see how Joker (especially in Royal) is a great balance of this, since the "main story" for the P5R true ending has much better narrative execution, in large part thanks to all the new confidants (Akechi, Maruki, Kasumi).

While I do like Makoto Yuki of Persona 3 more (as it was the first persona game I ever played and he has a special palce in my heart as a person protaganist) Joker is a great character and he definatly has much more of a personality than other games before; while it is true that the player gets to pick his responses, I do find it interesting said responses range from normal logical answers, to sarcastic and even silly responses at times, and it shows that Joker even as a silent protagonist has a sense of humor and a likable personality. Even Morgana comments at one point that Joker is special, that for some reason he is a catalyst that other potential persona users and confidants are drawn too, on one hand Igor I am sure definatly played a hand in that, but the rest is just Joker being himself, free to take off his mask and show his true self to the people closest to him.

Across Asia, a criminal conviction is particularly damaging. That relative used to be a celebrity and ran afoul of a current pseudodictator's war on drugs, so the impact of the *arrest* was even more for us. It's been more than 5 years and it still hurts, so the P5 franchise is the closest I have got to closure.

Many have already mentioned Ace Attorney as good satire on the Japanese criminal justice system, but I wanna go to bat for a personal favorite of mine. It doesn't deal with the criminal justice system, but it deals with how teenagers who go against societal norms are villainized in education and ostracized by most adults. It's a slightly old series called 'Gokusen'. The main character is a teacher with a family background in organized crime, so the idea of one's family reputation playing a big part in the individual's personal life is also prevalent, as the main character has to navigate keeping her grandfather's business a secret to not get fired from her teaching job.

I knew the japanese police was unfriendly but to think they were this inhuman and that a video game actually portrays it as it is truly is insane. I'm from the EU and stuff like this would have the cops themselves get thrown into prison instead of the other way around. It truly shows what happens when people care more about reputation then human decentcy. I've always found Joker to be more in line with western views then japanese anyway and this truly shows it.

It's scary and how they got away with this for so many years. 3: The fact that they force you to look down and not in the eyes, is more of a indicator not of respect in the world, but more of submission and denigration And i thought that my country is f* up... Great video! I actually sometimes work with the police in my area as an interpreter and I've seen firsthand what goes on in an interrogation room. I have worked only with foreign suspects/criminals. I can't say this is true for all places in Japan, but at least where I have worked in my city the suspect was allowed a lawyer, and the detective called one right away whenever the foreign suspect/criminal requested it. There was no camera and the detective let the suspect know that ("there is no camera, you know? You aren't being recorded here, but once you go to the higher-level interrogation room, everything will be recorded. I can see that you are just saying lies, it will look bad in court. If you want to set the record straight, now is your time to do it". As an interpreter, I can't do my job for 12 hours so it is limited to around 3~4 hours (usually I work around 2 hours) (I also get a lot of money per hour so it will cost them a lot to have me in there for hours on end) I haven't seen first-hand what it's like for a Japanese person to be interrogated so I'm sure it's very different and most likely does go beyond how many hours I spent in the interrogation room.

@@LadyVirgilia I'm wondering how that'd work for Persona 4, as spinoffs fleshed out Yu Narukami's personality a lot, making him feel a bit generic in the original game by comparison. Via dialogue choices there's some vague hints at Yu being a bit of a weirdo (all the things he can eat in the fridge, being able to spend whole days talking to cats) but also very empathetic and a bit of an amateur therapist, as well as disliking being alone. But it's not as pronounced as it is in the anime. P3's MC meanwhile is supposed to be read as an apathetic loner at first who gradually opens up to other people, at least that's how I see it. How I've viewed P3's Social Links vs P4's. In P4's Yu is solving other people's problems. But for Makoto/Minato P3, it feels like the Social Links are the ones changing HIM.

@@brookeneeley396 Because 99.9% of P4 players pursue the harem route, and I hate it. (If you look at KZfaq S Link footage, you'd never know the platonic routes exist) Yu is always established as being very charismatic though, and all the girls are implied to have crushes on him either in the anime or at some point in their S Links. There is no "True Ending". Unlike P5 original which explicitly called the ending the "True End" in the achievements, P5R's achievement simply says "The Path Chosen" and triggers no matter which you chose. The devs call them the "Stay" and "Return" ending, stating that the intent is to show that there is "no one path to justice.". You can even see the lack of bias in the fact that they both have their own unique credits sequence treated as an actual ending unlike the "Bad" endings of P5 where it is a plain credits crawl with ominous music, much like P4's bad endings.

Great video! It touched on a lot of things I knew existed, but didn't understand the full story of (such as shame culture and the severity of the justice system) One thing I am curious about that I haven't really heard about from a Japanese perspective is Sojiro's and the teachers treatment of Joker early on in the game. Kids can be cruel without reason no matter where you live and even playing persona at first I didn't really question the peer bullying, but from an American perspective the way the adults treat joker right out of the gate seems harsh to the point of emotional abuse (you know besides Kamoshida and other villian characters). You did go over why Joker moved to a new city, and that makes much more sense than a lot of fandom theories I've heard, but are warnings like the ones Sojiro and Principal Kobayakawa give early in the game commonplace especially considering they should know of the false confession?
@Redpoppy80

Japanese society is really hypocritical in this aspect. They have an obsession with people "not causing or being an inconvenience" to their family or close friends but at the same time they do have a rather strong moral code that is imprinted in people from their youth on up. If you get in trouble, it is your fault and they can't be bothered to hear otherwise but if you do the same thing and win then everyone will more or less treat you like a hero. The mask and presented story matter more to the average Japanese then the truth in this type of thing. Something else that is related is how overworked Japanese people are. They have a word for it "Karoshii" and it translates to dying from overwork which is a very real thing over there. Many "Salaryman" as they call themselves often work over 100 hours a WEEK and this obviously leaves them with no time for literally anything else. Kamoshida says this during his breakdown but Japanese society will demand absolute perfection and many people break under the stress and are immediately discarded for someone, more capable. It is kind of a remnant from the Samurai era but when Japan wants to train someone they pretty much have only one method which is "conditioning" someone by putting them in constant stress with the expectation that they don't break or they will be deemed a failure and be discarded, which for many Japanese is equilvalent to a death sentence. It is like how blacksmiths would forge their Katana's by heating scum metal to sift out impurites to be discarded and then pounded and folded dozens of times, sometimes over a hundred times to get the core and seperate cutting edge just right. But if the blade breaks during forging, it is discarded and restarted from scratch. The Japanese are unsure about their culture because they are starting to wake up to the fact that their culture is toxic and self-destructive but they really don't know how to fix it in their current system which is under the foot of the USA after their fall in WWII. I will say though that despite all of their problems, when something happens which affects everyone, everyone will band together and do ANYTHING to weather the storm and survive as a family.

i don't know if you know the ace attorney game series, lady, but you explaining the nuances of japanese socioculture in this video makes me not only understand the persona series so much better, but also makes me privvy to a lot of different details and implications i missed in law/detective centred japanese game series like ace attorney. this makes so much sense to me. i'm from indonesia and although we do adopt several aspects of a collectivist society, as a south east asian nation, it isn't as firmly grounded. i dont know much about my own country's laws, but i'm definitely a bit more familiar with a western take of the courtroom system which in my personal opinion, is definitely more fair only in the sense that no matter what the motive for a crime -- let's say murder -- is, the act of murder itself is still a crime worth punishing (hence why the reason for murder is not as important as the evidences). you giving us this background is so much appreciated. for someone who loves true crime, too, this insight gives so much context and explanations, so thank you so much. you earned yourself a subscriber!

This video is really insightful when it comes to seeing the game from a Japanese societal point of view. However, one of the aspects of the game that I find isn't really discussed enough is the portrayal of relationships between the protagonist and older women in positions of power (namely Takemi and Kawakami). It makes me wonder what Japanese laws are with regards to teachers dating students or doctors dating patients because in Western society, it would be seen as a power imbalance and could very much lead to prosecution and deregistration. Especially in the context of Kamoshida's arc, it seems inconsistent that there's an option to date a teacher. Makes me wonder if Japan have the same laws regarding doctor patient relationships; it's hard to believe a doctor that's so dedicated to their work would turn around and do something that could compromise their career and trust.

@LadyVirgilia This video is fantastic and concise but detailed, addressing one of a few major issues I have with Japan's governance and societal order systems. Issues that I know can be done better, but a systemic and pervasive strain of corruption, which is not new, has been maintained that hold the nation back and keeps the people from living as full of life as they could. I will offer one rebuttal: this is not "True Collectivism or Confussionism" in philosophy and is more of an authoritarian parasitic hijacking. Because in "Real" Collectivism and Confussionism, though the group takes priority and a tiered system of authority exists, so too are avenues of confronting the abuses of the abuses and corruption. This also, in theory, overturns any labeling of deviant and shamefulness in society's eyes by exposing such being placed wrongfully. In this corrupted version of these philosophies, these means of defense and confronting those who abuse their standings do not exist. Replaced with trust through a fear style of "Do not wrock the boat" thinking. Even if you know something is wrong, you act like it's right out of fear of being labeled a deviant. It creates an illusion of justice and stability rather than a reality, akin to the world's social order in Orwell's 1984. At the end of the day, resolving this issue can not be done by simply reforming the Judicial System but also by addressing a Social Order of this Corrupted Confusionistic Thinking, which has been a systematic creation since the Tokugawa Shogunate, as a way to create a controlled society that could maintain isolationism. Yes, this is an issue across East Asia, but Japan, as much as I felt at home there, takes this issue to new heights. Thus as someone that loves Japan and hopes someday to live later years of my life there, I know the nation is capable and wish to see it do better.

May I suggest a minor change to the intro, though? I get that you're japanese-american, so it's something outside of your perspective. When you say phrases like "western individualistic values", it kind of irks me a little. You see, I'm Brazilian, and although US values influences our society a lot, latin culture in general is quite different and I don't think matches any side of the duality you propose of collectivism vs individualism. Rather than complicate matters further, I just want to suggest swapping "western" by "american" or even "eurocentric". Not sure what fits best. But I speak as a latin person, I'm sure even western europeans have their gripes with the "western culture" shorthand. I won't complain if you don't change it though. Writing this, I'm not sure myself on how to change it. I'll keep waiting for more!

Sorry this is a Wikipedia link, but this explains my intended meaning in the broadest way. en.wikipedia.org/wiki/Western_culture and I find that this image is a nice reference of which distinctions I'm using, at least when it comes to my current understanding of cultural studies (though Sinic + Japanese have *many* similarities). I'm always learning new things though en.wikipedia.org/wiki/Western_culture#/media/File:Clash_of_Civilizations_mapn2.png Latin American cultures are definitely their own thing! I can't speak from my own *personal* experience of course, but I'm grateful for what I do understand of it from Latinx friends. I will try to draw greater distinction in future videos by using the term "Western Eurocentric values" perhaps. Thank you for sharing this suggestion and your perspective! ^^

I have to wonder if Japanese police investigators realize their carriage of justice dishonors them by making a mockery of justice and the system. The expected average of negative cases is about 1 in 3, so a 75% conviction rate through natural execution and no artificial tinkering would be a sign of a healthy justice system, or at least one minimizing undue harm. The investigator's job is to suss out those false positives and drop a bad or faulty case just as much as it is to pursue true positives to a conviction.

I doubt it. They're probably happy to up their numbers to either benefit in their career or to avoid getting criticism for not working hard enough. With collectivist societies the individual is only allowed to fit with the expectations of others. If others are convinced you're a criminal: who the fuck are you to question it? You're a nobody and the government/police/group-with-power are to be obeyed. *Edit: I wrote a few sentences here, but it didn't save? Whatever... I agree that an innocent being wrongfully accused is, of course, morally wrong. Even if we ignore morality and only care about the end result then innocents being wronged legally is still undesirable. However, if the idea of an individual's right being observed is not present, then the innocents will be put away with the guilty and that's that. Also, unfortunately, in any part of the world, the police's job is not to find truth. Nor is it the prosecutor's. The judge/jury are the ones that determine guilty/not guilty after examining evidence (in the American legal system). Of course, the prosecutor SHOULD avoid prosecuting those who are clearly innocent, though that seems to be a less popular opinion nowadays. America and Britain (at least, more than the rest of the world... it is getting worse in recent years) insist that the police use truth and evidence before making arrests and have trials using evidence and the judge/jury, in theory, is supposed to protect the rights of the accused from the inevitable mistakes or wrongs that will eventually happen.

I like several things about Japan, but its criminal justice system is not one of them. It's barbaric as fuck. It baffles me how a society that's more intelligent than most western countries could create such a narrow-minded system.

5:45 guess I must just be a ignorant american, but I'm understanding the explanation, but honestly I'm too much of a ryuji to understand collectism and other political stuff, but the huge beginning of P5 got me thinking do these people even have basic morality xD, not like I'm asking for a knight in shining armor, but if people are so hard wired to be the way they are in japan, why are there people rooting for the theives at all throughout the game lol? I'm sure I am probably coming off as real ignorant american with a naivé perspective, but I'm trying to understand 😂

Even if Japan is more collectivist than the US, that doesn't necessarily mean there aren't gonna be at least a few stragglers taking the Phantom Thieves' side
