Garda scandals: Clare Daly asks Commissioner about her own summons to court

During a robust round of questioning of Garda Commissioner Nóirín O’Sullivan and two members of her senior management, Clare Daly used her own personal experience with traffic policing to examine the current scandals around fixed charge notices and breath testing.
At a Justice Committee hearing this morning, the Independents4Change TD was trying to establish a correct timeline on when the gardaí knew there was an issue with court summons - and when they fixed it jrnl.ie/3314766

It happened to me also. Garda officer Lee Cummins abusively brought me to the Garda Station and falsely a cussed me of being " highly intoxicated + obstructing an garda officer to do his job"

HERE IN NEW YORK CITY OUT IN LONG ISLAND AROUND 3 YEARS AGO I GOT A TICKET BY A HYDRANT WHICH COST ME $130 AND A $15 DOLLAR SURCHARGE A TOTAL OF $145. MONTHS LATER I RECEIVED A NOTICE THAT I OWED ANOTHER $135. BEING A MAN OF RIGHTOUS PRINCIPLE I REFUSE TO BE EXTORTED. 3 MONTHS LATER I RECEIVED A NOTICE FROM A COLLECTION AGENCY I NOW OWED. $425. I AGAIN IGNORED IT AND LEFT IT IN GOD'S HANDS. IT BEEN 11/2 YEARS NOW AND NOTHING. THE SYSTEM ITSELF IS A CRIMINAL.

Paid fine for a motoring offence, on the paperwork it stated that if i pay it in time, i will not be prosocuted, 8 months later Garda at the door. I honestly thought i was about to be told my parner has been killed and wont be coming home! Anyways it was a summons to court where i had to plead guilt for an offence i already had been punished for. Only to be fined even more money! There were 300 odd people in the court that day, i was the only one to have paid the fines. Nobody else paid the fines and yet i was punished the same as others. How is that fair?

did you ask for photographic evidence that the fine was placed on the vehicle, or a speeding fine, all cases are photographic in one way or another.

I've had 5 or 6 court fines in my life ranging from 80 to 300 pounds or euros and never paid one of them. A guy from the guards called to the door saying I owed x amount and was I going to pay. I told him I hadn't got any money but I could maybe pay 5 or 10 euro a week. He said that's grand and told me to go to the local station each week and ask for himself and I could pay it off that way(I thought it very strange paying that way by the way). Anyway, I never went up and paid anything and haven't heard anything in about 12 years. The first fine I got in court was on the day of my 21st birthday (50 pounds) and never paid and never heard anything of it again. That was 30 years ago.

A summons is just an invitation, you dont have to go to any court unless you have actually hurt someone. ie caused harm loss or injury

While it is good that there is some questioning of garda it's only because this involved a TD. What about all the other abuses by gardai. That they generally abuse the public in Dublin and lock them up based on the dispersal laws they themselves campaigned for. No one stands up to the gardai in this country the politicians, the judiciary are afraid of them as they operate as a cohesive family, they operate as mafia. If people can be locked up and have their lives destroyed for not obeying a garda's order to leave an area then the gardai themselves should be held to higher standards and should be held to account for abusing the public. The real problem is the legal system which is subservient to the gardai, solicitors and barristers don't defend their clients in this country they don't give legal advice they operate as admin just to present you in court they will barely utter anything to defend you.

I like the badges on your shoulder, pitty about the professionalism of your staff. I wouldn’t and will not have any document signed without my knowledge or consent. Your staff walked into my school at 10 years of age to single me out you will never ever take the pen out of my hand again. Do I make myself clear.
