As long as there is corruption with the authorities in different departments including in Courts, people cannot expect justice. Mostly our Judicial and Police system are criminal-friendly. The more you have money, there is more chances of justice in your favour.

Absolutely, explained in details by the Advocate of Supreme Court. It is irrelevent to say that present laws i.e. IPC, CRPC are not colonial law due to amendement it by the time and various judgement. Hence, the new laws should be explain in.details. Everybody knows that India“s pilice modus operandi.

The laws seem to have made for harrasment of common people and opponents of the rulling party and are massively impractical. The discussion is very helpful. Please provide similar interpretation for the other two laws.

Law was not made to give justice to common people when queen ruled , it was in fact was to enforce whatever they passed as lagaan. Ambedkar copied them to conveniently push britishers agenda because it favored to keep the society divided . See the reservation go up and up till it becomes 100 percent then they will enforce the virasat to snatch hard earned wealth by father to give to his kids , go to leech and rohingya vote Banks.

Is there a chance that there would be a review of the shortcomings of the new codes? There would be anarchy and only escalation of load on the courts all over. I really feel there should be deferment of the date of implementation.

What is the difficulty in amending “ unfair” provisions based on experiences once in 6 months till stabilisation? All misuses can not be envisaged in advance? Any policy can be questioned.

Well, the SHO has greater degree of Responsibility, and Accountability as to WHY HE HAS NOT TAKEN UP criminal investigation or FILE an FIR, as needed. He could be susoended or even, DISMISSED for misconduct

In a nutshell, Bhadrajee, the laws would come down heavily on criminality, in whichever form, or modus, while, simultaneously, seeking to fast-track criminal investigations Most importantly, THE PUNISHMENT WOULD NEED TO COMMENSURATE wilh the CRIME, and BAIL, now becomes on Case to case basis, and not a matter of RIGHT, or PRIVILEGE, especially in rural India

Dear The Print, Please see 4:50 onwards. Please tell your distinguished legal luminary that no state amendments are in limbo as they have all been repealed. Secondly, atleast I and people of my skill, experience and understanding know it very clearly that all the previous state amendments have also gone away with the repeal of the old laws to which they were all added. Since the gentleman says clearly that he doesn't know whether the state amendments would be operative or not...please tell him that that they would not be. I hope you will really bring some good, senior and experienced lawyers who have put in at least three decades or more in specialised practice rather than the phoney introduction that Mr. X is an advocate in the Supreme Court. There are some advocates in the Supreme Court who are much poorer performers than the advocates in the Civil Courts.

The new 'Bharatiya' laws are not only idiotic, but also pernicious!! I've been saying this ever since these 'laws' were 'passed'...! These new laws are 70-80% copy-paste from the old laws without any substantial changes (this even many lawyers have averred!) One can logically argue that if there is so much overlap between the old & new ones, then what the heck is the need to bring in the new laws, which, by themselves, would lead to a ton - a TON! - of logistical & practical issues!?!?! As is usual with this govt., this is an absolutely idiotic, un-thought-out move; doing things just to do something!); but/and wherever the laws actually have been changed, most of the changes (not all, but most) have been made to make the laws much more stringent; giving too much power in the hands of police/DM/govts! This would, obviously, lead to even more police corruption - bribery, police brutality, etc.! Human & individual rights have been relegated to a distant second place! This is very dangerous & will lead to a police state, and more harassment of citizens; more stifling of freedom of speech/expression & more unnecessary/frivolous cases, thus, further clogging the Indian judicial system! In short, the new laws are asinine & pernicious both in concept, policy & practice! Just like Agnipath/Agniveer scheme was the most idiotic & pernicious thing to occur to the Indian military & national security, so are these laws for Indian legal system, judiciary, and individual rights & freedoms...!! Yet another classic example of BJP's ineptness of framing laws/policy...Beyond a certain point, ineptness can't be distinguished from malice...and I am beyond being charitable now, and I genuinely think this was done deliberately by BJP in order to make India a more police state...in order to retain power, and try to rule in perpetuity... And, the Judiciary has let the people down with their indifference & pusillanimity...!

When set of experts drafted it, and not just political expediency , it is premature to fault them even before the implementation of the change. Argumentive Indians can continue to argue and no time frame is enough. Blame NDA but they have guts to pull all the legislations, reforms, policy decisions. Whenever they failed like in case of agri reforms, I won't blame opposition but NDA.

The expert seems misinformed on a lot of grounds and having minimal experience with criminal matters as they happen. First the audio video part is so that the integrity of the arrest, search and seizure done by police is questioned less in the courts. 2. Preliminary enquiry, as a tool, will allow Police stations to ask their DSP rank officer for permission to conduct PE before they register. We have seen a lot of times FIRs are done just to harrass the other party at times victim to bring them to the compromise table. This way such "naagriks" will be provided "suraksha" by those who tend to use FIR as a tool by making up facts. This will also reduce the pendency in courts. Further, even if Police does not register FIR the victim if wronged by Police can approach the SP or the court who then shall ask the preliminary enquiry report for their decision.To conclude, while the expert points out a few good points but most of his viewpoints I feel are very pro litigation and not pro justice.

In cases of illegal possession of land or theft in absence of the person, it will become impossible to file FIR without approaching the criminal court.

@@Achintyanath While I agree a few cases might be there but the SHO doesn't have the discretion to conduct PE it is with his supervisory officer who is a gazetted officer of the DySP rank and given the rising accountability it is my personal experience that senior police officers would dare to go the burking way and even if they go there are safeguards. As for land issues, most of the time these are of civil nature and the Honourable Supreme Court time and again has given judgements citing this upcoming trend of converting a civil nature case into a criminal case just to make police a party and harass them by showing the fear of criminal action.

@@prashantkiran6869 Actually the powerful people in society use the Supreme Court order cited by you to influence the Police to label cases of illegal possession as civil matters. That is why most people are afraid of buying plots of land nowadays. Already Police is misusing its power under influence from powerful people in society and now it has even more power to misuse it further.

@@prashantkiran6869 If the illegal occupiers are powerful people then whether DSP, SP, ACP supervise, the ranks do not matter. The complainant is labeled by the Police as a harasser and has to approach the criminal court. In the criminal court the Police never files report and pressurizes the complainant to compromise out of court with the illegal occupier. Very few people have the resources or patience to keep fighting case for two or three years just to register a FIR. This is the existing state of things. The new laws will make the situation worse.

@@Achintyanath First it takes days under the erstwhile 156(3) of CrPC to get the FIR regd. via court. Secondly, the court will ask for the report and police has to submit the report, police is not left with a choice here. Also about the corruption part, that’s a blanket statement, having worked in the dept. I know there are instances of corruptions but there are enough checks that no one returns without getting a proper hearing and FIR is just a small thing. Rest we will have to see how are apprehensions fold out in the coming days with respect to PE.

The use of the word "decolonization" defending the new laws, is indeed, a misnomer, Bhadrajee. Besided, laws need to attuned and reformed to changing times in the Indian jurisprudencial system. I just wish to ask your good self, Bhadrajee, what detriment could pissible occur to a honest, LAW-ABIDING indian citizen with the enforcement of these reforms?

I don’t agree with you on that Handcuffs rambling. Everyone arrested should be handcuffed and that is the end of it. Focus should be on the free and fair trials if wrongly accused person come out as winner than handcuffs are not a big deal. His reputation has recovered. Our focus should be on giving police better equipment and training on how to behave with public. Give them cars and proper training and decent uniform, remove all those ranks Sipahi etc. give them body cams and when they arrest body cam should be on if not that person should held accountable strictly. Then after we have teams of forensic and educated and trained police then you can implement these new laws with modification other than hand cuffs. Because it is important that we pay attention to police security too. So handcuffs are not big deal

Why should rape and murder accused 's face be covered while being brought to courts? Why should medical examination of accused be done by taking him to a government hospital when jail doctors are available.? What if every accused has a setting with the hospital doctors to feign heart ailments or some other serious illness requiring immediate admission in ICU.

Bhadrajee, the handcuff argument is highly CIRCUMSTANTIAL, and 4 FIRs filed simultaneously, is FIRST offence, but if they are successive in chronological order, they are treated as REPEAT offences, not reoeat offenders. Look, you cannot have LAWS CARVED IN STONE, a lot depends on the circumstances, criminal records, if sny, of defenders and the PERPECTIVES taken by local enforcement agencies
