I went to the Nebraska State Capital Building. My wife was taking a tour for her job. I wandered around and ended up on the 4th floor where I found a small office called the Sorghum board. I happen to love Sorghum so I walked in. I walked out with a bunch of nifty little trinkets. Stickers, keychain pressure gauge, and a pocket knife! Just a little penknife, I carry much larger everyday, but I walked in had a chat, was armed by the State, and left with a good story. Nebraska is awesome.

Our government was created and founded upon inalienable rights granted and given freely by OUR CREATORS. Besides that, it was also founded upon the precepts that each individual was HIS/HER OWN SOVEREIGN Authority in title only, able to self govern him/herself, and could not take away the rights/liberties of another human being or own slaves because to do or acknowledge otherwise would invariably nullify the rights of everyone. Yep. It's more like a B for the cop and a D for the auditors. The cop was brusque, but he was correct to request an ID and just doing his job. He could act less like a drill instructor and be a bit more relaxed with the public, of course. The auditors were kind of making stuff up. While it's a shame we're stuck with all this building and airport security, and while there is lots of room for improvement overall, I don't know that having a single officer and a metal detector is all that egregious. He's great at following orders to the letter, but not understanding the law behind the orders themselves; in this case the instructions he was following were correct, but they won't always be, and even when they are he seems pretty bad at actually explaining them, which is going to hurt his case for lawful action in more unclear circumstances down the line when he has to justify himself. If playing door guard isn't his only duty as an officer, I think he should probably get more in-depth training. At 8:48, "any person who refuses to vacate [...] when requested to do so" doesn't say it has to be a security personnel or law enforcement officer like the earlier part of that law does. @moonman239 Жыл бұрын
Not a lawyer here, but this is where intent of the legislature would most likely come into play. If a person who is not a member of Capitol staff requests your departure and you are charged for refusing to obey, a court would likely look at whether that random guest had the authority to remove (or cause to be removed) any person from the Capitol building. For example, a member of Capitol staff could have asked them to tell you to leave. If no such authority existed, the court would likely conclude that you committed no crime.

Government building need to have some amount of security, i mean if i want complete unfettered access to Constitution to put your fingers all over it that should not be allowed, and think the officer acted appropriately stern in order to keep an escalation from occurring without taking a chance on a detraction that could interfere with the safety of the building, from what was read in the video on the law they could have been charged with a valid misdemeanor , i think officers did a great and found a perfect balance, the officer actually deescalated in 3 tiers with only tone and body language, while using polite professional verbal commands while showing a very efficient execution of his duties, that is in my opinion is high functioning professionalism in the extreme, artfully done

@@lady4191 If you are going to "audit government overreach", you need to at least know your rights, correctly, first. Just because there is the 4th Amendment doesn't guarantee you access to a great number of places. Private property. Military bases. Power Plants. Municipal water facilities. Government owns some of those places, and yet somehow, the 4th Amendment guarantee against search and seizure isn't also somehow a free travel pass at the same time. One can be against government and police hostility and overreach AND ALSO be against naïve individuals misinterpreting what the laws actually permit them to do.

In what way is “ensuring public safety” a reasonable exception to an innate human right? I heavily disagree with the courts on their ruling here. It is neither an expectation of, nor the responsibility of the government to provide citizen safety from potential domestic threats, or from the individual and freely chosen actions of another free citizen. The responsibility for government action starts at the point in which the choices of one person violate the rights of another. Violating rights in order to prevent the violation of rights is wild.

When it comes to going into buildings namely court houses, they often will give you less freedoms then on the street or side walk due to the sensitive nature and often require checks, often being both ID and Metal stations. When it may be open to the public, there is history of needing such measures to keep people safe. When the officer could be nicer, he so far from what I seen, is not legally or even morally in the wrong.

Could it be that as the few high ranked public servants are the ones that make the rules, they can make them to suit their feelings? While ATA has shown that the rules are in place, and the Officers can enforce them, it doesn't stop the fact that the rules are essentially wrong to start with.

It is astounding how different the laws in different states are. In my state, as recently as 2 years ago, I could walk into the state capital building with a concealed firearm on my hip, even when the legislature is in session. I'd only have to flash my concealed pistol license to demonstrate that I have one, since open carry was prohibited in the capital. That was because the state constitution has a stronger version of the second amendment than the US Constitution. Unfortunately, our governor and legislature have recently decided to ignore the 130 year long interpretation of the state constitution in order to be "one of the big boys" like Newsom and Hochul.
