I think what you are failing to understand is that criminal cases such as this are not plainly judged on the basis of moral and ethical value judgments. It's all on judicial ethics. Explains why people kill and get away with it in the court of law. It's not a question of morality.

Society sets the moral standards flowing from the natural law, meaning you are suggesting he should be in court because he caused abortion and death.
