I don’t think all shareholders of companies have duties to all other shareholders like this video suggests. He would have to have some sort of seat on the board or majority ownership or something like that. There are plenty of private placements in companies that do not make it so that the shareholders have a duty to the underlying company. I do think it’s somewhat of a conflict though because he would have his own interest in benefitting the raiders with information he might gain working for fox. But that doesn’t mean he has a duty to the raiders. He does probably have some duties to fox though.

Shareholder supremacy has been in effect for 40 years
@is0sceles
@is0sceles 13 күн бұрын
While I agree, I think it depends on whether he would simply be an owner/shareholder or whether they'd give him some decision-making power, and it seems unlikely that they wouldn't, even in an unofficial capacity. Unlike any other large corporation with thousands or millions of retail investors making up the base of shareholders, Tom Brady is probably getting invited to various events with the primary owner(s), chiefly Mark Davis, and will probably receive emails / phone calls / texts here and there about what he thinks about this year's draft pick or that strategy for some upcoming game or whatever else you can think of related to football decisions, not that he would make the decisions outside of a coach/GM role, but they'd probably pick his brain and entertain his ideas given how much he knows about the game. That said, I still agree he doesn't have a "duty" here, just an "interest." And I also disagree with Florio's assertion that the duty is to help the Raiders win. It's an interest to see the Raiders earn more money or reach higher valuations. Winning can help that, but it's indirectly related.

It’s not as big of a conflict as Florio is making it seem. He could theoretically park his “equity” into a quasi-blind trust type situation where he doesn’t get to actually work, promote or affiliate with the Raiders while broadcasting. The equity stake stays parked, and he gets no benefit. Plus- having an ownership stake doesn’t make you automatically bound by a fiduciary responsibility. The responsibilities are based on contractual agreement and you can contract around anything.

I’d bet good money he pays himself a salary from the team because it makes the tax liability more favorable for him. That would make him an employee. Not really my point, though, even if the hypocrisy is blatant, but what’s new for the NFL? No, my point was to lament the fact Jerry is an unforgivably mediocre GM. He’s been really good as a scout and better than average at the draft, but he’s terrible with personnel management from player contracts to coaching staff. Since it became the Jerry Jones Show, Cowboys are always the bridesmaid (good enough to be relevant, not good enough to truly contend), which sucks as a fan.

@sportsavant2937 11 күн бұрын
Stupid competitive? Would you buy a growing business if you have a chance? Especially, the person who sell a stake of that growing business to you at a 70% discount would you not buy it? Manning failed to purchase the Broncos because the NFL didn't want him to buy it. But with Brady, the only sticking point is that 70% discount he is getting. Other owners don't want that to affect their own franchise's value. Brady has many owners in support of his purchase. He just doesn't have all of them. I believe in order for someone to be able to sell or purchase an NFL franchise, they need the approval of all the owners. This is why they are still negotiating and Brady needs Robert Kraft to help persuade the other owners.

1:30, this seems incorrect. First, an owner does not have a duty to help the team "win." I understand what Florio means, but as an owner, he has an interest in the entity EARNING MORE MONEY or having a greater value. Winning helps (as it brings along more fans, who bring along more money), but it's just a proxy toward more money, and it's questionable how much exactly does one win help increase a team's value. It probably affects some teams more than others, and the Raiders seem to be one of those teams with such a diehard core fanbase that they're not going to stop going to games because of some losses.

The real question: will Brady be more like Tony Romo or Jason Witten as an analyst?

Romo is super obnoxious so hopefully Brady is more like the guy he's replacing in Greg Olsen.

He's an owner, he doesn't have a fiduciary duty to the company. The company has a fiduciary duty to him, Right?

Mike now your just reaching ! No if he is a part owner he does not have a obligation to spy on other teams while working with fox .that ludicrous to think that he would have to no matter what .for such a great sports journalist you can cause so much drama that doesn't have to be done .I get it's your job to report and give your thoughts on anything NFL but you take certain things to a place it doesn't have to be .you as a journalist are not supposed to bias towards certain players and team but they doesn't stop you from doing that .and doing it a lot I might add .

Brady is really not smart, it was his ex, the power behind him, and I don't think he is very well well liked by the owners!! Brady is going to get unofficially Blackballed from every owner, and out of football.. don't think the nfl cannot tell fox sports No he is not going to broadcast our games. the nba and mlb are already doing this

Hey just for a sec think of it like this think about how he lives who he is if anything were to happen to Mr Davis God for bid knock on wood I think he would want the goat to take over as owner since he has no children. That is how he became owner

Brady has a discount on his ownership because who he is has a value over the cash he is bringing to the table. If a team is worried about Brady seeing one of their 6 trick plays, just don’t play those 6 trick plays when Brady is there…

Tammy just can't live without drama and the attention that he thrives on like the air he breaths....for a laugh check out his pathetic video he put out a few weeks ago of him doing sprints with no shirt on...worse than a twelve year old girl on social media.

Brady seems hellbent with ruining his career reputation with the Roast, trying to be an owner while signing an incredible contract for broadcasting, and living the GOAT thing to the extreme. He should realize that if others are saying you are the GOAT, he doesn’t need to to waste his or our time trying to play the part.

There is no way any team wants Brady the Broadcaster in their locker room right now. It's too soon and he's too connected to too many league figures. NOT TO MENTION Brady is a known, admitted and convicted cheater.

There is no passion, loyalty and city allegiance in this American Football game. The idea that a Football team would leave a city for money and tax breaks is blasphemous in Europe and a potential death sentence to the team. In the USA, fan loyalty is meaningless and money is the ultimate god of American Football.
